Network Availability Sample Clauses

Network Availability. The Vyve network shall be available for use by Customer with the Fiber Service provided under the Agreement at least 99.99% of the time as measured over the then current monthly period (“Network Availability”). Network Availabilityshall be calculated by dividing the number of minutes that the Services are available for Customer’s use by the total number of minutes of such calendar month and multiplying the result by 100. In calculating Network Availability, Service Interruptions (as defined below) resulting from the reasons or causes set forth in Section 3.4 of these Additional Terms and Conditions shall not be included in determining whether Vyve has met the applicable performance standard for Network Availability. For example, if the Fiber Service experiences an outage for one (1) day due to a Force Majeure Event, and otherwise experience no other outage or Service Interruption (as defined in Section 5.2) during the applicable month, Vyve will be deemed to have met the Network Availability performance standard of 99.99%.

In the event of a major network outage, NextWave will notify COMPANY of the conditions affecting the customers, including, but not limited to out-of-service events, and high system traffic loads. Any FCC-reportable Network Outages, including disruption of 911/E911 and emergency services will be reported to COMPANY.
Network Availability. Network Availability is the ability to transmit data over the CenturyLink switched Ethernet Network. Network Availability does not mean Customer will be able to reach any site or user on the Internet, nor does it mean any site or user on the Internet can reach Customer, as there are many factors, outside of CenturyLink’s control, that can affect an end-to-end connection. Network Availability is calculated by dividing the average number of minutes that the Services are available for Customer use by the total number of minutes in each calendar month and multiplying by 100.
Network Availability. Network shall consist of the following components that are provided as part of DYONYX’s Services: • Core network infrastructure within the DYONYX data center private cage space, and • MPLS access provided to Customer thru the DYONYX Private MPLS Cloud. For outages related to outside vendors (e.g. TW Telcom), DYONYX will, upon receipt of notice of outage, contact vendor for applicable credit. Said credit will be passed through to Customer. Network Availability. Network Availability is a measurement of the average percent of total time that Ethernet and TDM Service is operative when averaged over a thirty (30) day month (720 hour) period. Ethernet and TDM Service is inoperative when the virtual circuit (“VC”) or port connection (“Port”) status becomes “inactive” and unable to pass traffic due to a fault within Mediacom’s network. Network Availability for Service will be 99.9% for all services on the network.
Network Availability. Network Availability is a measurement of the percent of total time that the Wavelength is operative when measured over a 365 consecutive day (8760 hour) period. For Wavelengths on Seller’s network, Network Availability shall be 99.339% measured over a one thousand (1,000) mile Wavelength for a one-year period. Performance (% Error Free Seconds (“EFS”), while available) is noted in EFS, which is a measure of the percentage of total seconds that do not contain bit errors when measured over a period of thirty (30) consecutive days. For Wavelengths on Seller’s network, EFS shall be 99.076% from POP to POP measured over a one-year period. Network Availability will vary with different circuit lengths.
