News Access. Rehearsals or performances may be recorded within a call time of one hour and transmitted in BBC News and Factual programmes reporting current events under the following terms: up to 2 minutes transmission time no payment over 2 minutes transmission time £24.40 Nothing in these arrangements shall prevent any artist requesting the BBC not to record a performance for this purpose. The artist shall not be required to exceed contracted duties nor alter nor repeat a performance for the purpose of retakes. The recording may be used in whole or in part as required without payment if the contribution did not attract payment in the first instance.

News Access. 1. News items which include the musical performances of musicians may be recorded under the terms of this code of practice without the further agreement of the MU or those it represents. 2. Such news items may only be “communicated to the public” (as defined under the Copyright Designs and Patents Act 1988 (as amended) (“the Act”) at section 20) in news bulletins and/or arts and music magazine/listings programmes, and may not be communicated to the public in general magazine, documentary or any other type of programme, without the musicians’ written consent and the payment of a fee to be agreed with the MU. 3. The broadcaster/production company filming the news item shall ensure that all recording of the musicians’ performances shall be completed within one hour of commencement of filming. 4. The maximum duration of recorded performance that may be communicated to the public in one news item shall be: (i) one minute of featured music (i.e. not background or otherwise incidental), and/or (ii) one minute of non-featured music (i.e. heard in the background of an interview or under a voice over) In the event the duration of the recorded performance communicated to the public in one news item exceeds these time limits then the broadcaster/production company shall pay the musicians a fee to be agreed with the MU. 5. Nothing in this code of practice shall prevent any musician requesting the broadcaster/ production company not to record his or her performance and the broadcaster/production company shall not record a musician who has made such a request. 6. The broadcaster/production company shall ensure the musicians are not called upon to exceed the duties for which they are contracted and are not directed to alter their performance or repeat it for the purpose of retakes for the recording of the news item. 7. News items made hereunder must be first communicated to the public within eight days of the recording date, unless the prior written agreement of the MU is obtained, but thereafter may be communicated to the public throughout the world in perpetuity for the purposes of reporting the news and/or as archived news items. 8. Provided news item recordings are made and used strictly in accordance with this code of practice, the MU agrees on behalf of those it represents not to require any written consents to be obtained from or further fees to be paid to the musicians. 9. News Access. Musicians engaged under this Agreement will permit Orchestra of the Swan to make news recordings for any of those on the Authorised List: BBC, ITV Companies, London News Network, BskyB, Reuters Video News, London TV (What’s On), or to invite any of those on the Authorised List to make their own news recordings provided that the maximum recording time of each news recording shall be sixty (60) minutes. News recordings shall not be made by or for Five or any other satellite or cable broadcaster (except BskyB). Any requests relating to a news recording for a third party that is not on the Authorised List shall be referred to the Media Department, Musicians’ Union, 00-00 Xxxxxxx Xxxx, Xxxxxx XX0 0XX. Those on the Authorised List shall be advised by the Orchestra of the Swan that where consent is granted, use of the News Recordings in programmes other than those specified shall automatically attract the fees due under the appropriate agreement with the Musicians’ Union to which such party is subject. Each News Recording may be broadcast by a broadcaster on the Authorised List in network news bulletins, local news bulletins and ‘round-ups’ and arts and music magazine programmes and listings programmes or on the website of the Orchestra of the Swan provided that the maximum transmission time of performances by the musician included in each such programme shall be limited to two (2) minutes, subject to the following limits: • one minute of recorded performance where the music is featured (i.e. not background or incidental) • one minute of recorded performance where the music is not featured (e.g. as background to an interview or voice over) • in the event of the transmitted duration of the performance of the musician exceeding the transmission time limits specified above, the appropriate points due under Appendix 1 above will be allocated. • all further and secondary exploitation of the News Recordings shall not be permitted without the Orchestra’s Musicians’ Union Xxxxxxx first being notified of same and agreement being reached with the Musicians’ Union.
News Access. 19 The Musicians’ Union warrants on behalf of its members that for the purposes of news reporting: 19.1 the BBC shall be entitled to have access to rehearsals and performances forming part of an existing engagement, for the purpose of making audio and/or audio-visual recordings subject to a maximum duration per news item, as follows: 19.1.1 featured performances: 1 minute, and 19.1.2 background use (i.e. incidental to the subject of the news item): 1 minute 19.1.3 For Local Radio packages: short extracts of more than one performance are permitted, subject to:  a maximum of 30 seconds per artist/song in any one package  a maximum of 2 minutes filmed footage 19.2 written consents shall not be required from individual Musicians.

(b) Recordings made for news access can subsequently be used by the Company for promotional/marketing purposes without any cost or allocation of points provided that the Company complies with the time limits under the MU News Access Agreement.
