NON-DISCRIMINATION IN SERVICES. In the performance of this Contract CONTRACTOR shall not discriminate in the delivery of Services as provided in CONTRACTOR’s Plan of Operations and Program Statement, attached hereto as Exhibit A-13, on the basis of race, religion, color, creed, national origin, sex, sexual orientation, age, condition of physical or mental handicap, marital status or political affiliation. CONTRACTOR shall comply with the Civil Rights Act of 1964, Government Code Section 11135 and all other applicable laws and regulations, in addition to complying with the CONTRACTOR’s CDSS, CCLD license. COUNTY and CONTRACTOR agree that CONTRACTOR will accept or reject children for placement consistent with CONTRACTOR’s Plan of Operations and Program Statement and in compliance with CONTRACTOR’s license. Such determination may not be arbitrary and capricious, unreasonable or discriminatory.
NON-DISCRIMINATION IN SERVICES. During the performance of this Agreement:
a. Contractor shall not, on the grounds of race, creed, color, national origin, sex, age, disability, sexual orientation, military status or marital status:
i. deny any individual any services or other benefits provided pursuant to this Agreement; or
ii. provide any services or other benefits to an individual that are different, or are provided in a different manner, from those provided to others pursuant to this Agreement; or
iii. subject an individual to segregation or separate treatment in any matter related to the individual’s receipt of any service(s) or other benefits provided pursuant to this Agreement; or
iv. restrict an individual in any way in the enjoyment of any advantage or privilege enjoyed by others receiving any services or other benefits provided pursuant to this Agreement; or
v. treat an individual differently from others in determining whether or not the individual satisfies any eligibility or other requirements or condition which individuals must meet in order to receive any aid, care, service(s) or other benefits provided pursuant to this Agreement.
b. Contractor shall not utilize criteria or methods of administration which have the effect of subjecting individuals to discrimination because of their race, creed, color, national origin, sex, age, disability, sexual orientation, military status or marital status, or have the effect of defeating or substantially impairing accomplishment of the objectives of this Agreement in respect to individuals of a particular race, creed, color, national origin, sex, age, disability, sexual orientation, military status or marital status, in determining:
i. the types of service(s) or other benefits to be provided, or
ii. the class of individuals to whom, or the situations in which, such service(s) or other benefits will be provided; or
iii. the class of individuals to be afforded an opportunity to receive services.
NON-DISCRIMINATION IN SERVICES. The CONTRACTOR agrees to provide equal opportunity in regard to the services to be provided. The CONTRACTOR agrees that no person who works for the CONTRACTOR or seeks employment with the CONTRACTOR or otherwise falls under the ambit of this contract shall be denied employment or benefits or be discriminated against on the grounds of race, creed, color, national origin, sex, honorably discharged veteran or military status, sexual orientation, or the presence of any sensory, mental, or physical disability or the use of a trained guide dog by a disabled person.

NON-DISCRIMINATION IN SERVICES. No agency which denies service on the basis of color, race, religion, ancestry or nationality, which proselytizes as a condition of service, or whose service is illegal, will be included in CONTRACTOR’s resource file.

i. deny any individual any services or other benefits provided pursuant to this Agreement; or

v. treat an individual differently from others in determining whether or not the individual satisfies any eligibility or other requirements or condition which individuals must meet in order to receive any aid, care, service(s) or other benefits provided pursuant to this Agreement.
b. NON-DISCRIMINATION IN SERVICES. 53.1 Contractor shall not discriminate in the provision of services hereunder because of race, color, religion, national origin, ancestry, sex, age, or physical or mental handicap, in accordance with all applicable requirements of Federal and State law. For the purpose of this Paragraph 53, discrimination in the provision of services may include, but is not limited to, the following: denying any person any service or benefit or the availability of the facility, providing any service or benefit to any person which is not equivalent or is not provided in an equivalent manner or at an equivalent time to that provided to others; subjecting any person to segregation or separate treatment in any manner related to the receipt of any service; restricting any person in any way in the enjoyment of any advantage or privilege enjoyed by others receiving any service or benefit; and treating any person differently from others in determining admission, enrollment quota, eligibility, membership, or any other requirements or conditions which persons must meet in order to be provided any service or benefit.
53.2 Contractor shall ensure that recipients of services under this Agreement are provided services without regard to race, color, religion, national origin, ancestry, sex, age, or condition of physical or mental handicap.
NON-DISCRIMINATION IN SERVICES. The Contractor shall not, on the grounds of race, color, sex, religion, national origin, creed, marital status, age or the presence or any sensory, mental or physical disability:
a. Deny any individual services or benefits provided under this Agreement
b. Provide any services or other benefit to an individual which are different or are provided in a different manner from those provided to others under this Agreement
c. Subject an individual to segregation or separate treatment in any manner related to his receipt of any service(s) or benefits provided under this Agreement
d. Deny any individual an opportunity to participate in any program provided by this Agreement through the provision of service(s) or otherwise, or will afford him an opportunity to do so which is different than that afforded others under this Agreement.
NON-DISCRIMINATION IN SERVICES. Provider shall deliver the Services in a manner that is linguistically appropriate and culturally sensitive to the community to be served. In providing Services to Students under this Agreement, Provider shall not discriminate on the basis of sex, race, color, religion, ancestry, national origin, disability, medical condition, marital status, sexual orientation, age, payor status, or on any other basis prohibited by law. Notwithstanding anything in the foregoing to the contrary, discrimination in the provision of Services does not include limitations on services provided to a particular patient where contraindicated based on clinical protocols or diagnoses.
NON-DISCRIMINATION IN SERVICES. 10.1.1 The Program Manager shall not discriminate in the provision of services hereunder because of race, color, religion, national origin, ancestry, sex, age, sexual orientation, marital status, AIDS or disability in accordance with the requirements of Applicable Laws. For the purpose of this Section 10.1, discrimination in the provision of services may include, but is not limited to the following:
.1 Denying any person any service or benefit or the availability of a facility.
.2 Providing any service or benefit to any person which is not equivalent, or in a non-equivalent manner or at a non-equivalent time, from that provided to others.
.3 Subjecting any person to segregation or separate treatment in any manner related to the receipt of any service.
.4 Restricting any person in any way in the enjoyment of any advantage or privilege enjoyed by others receiving any service or benefit.
.5 Treating any person differently from others in determining admission, enrollment, eligibility, membership, or any other requirement or condition which persons must meet in order to be provided any service or benefit.
10.1.2 The Program Manager shall ensure that intended beneficiaries of this Agreement are provided services without regard to race, color, religion, national origin, ancestry, sex, age, sexual orientation, marital status, AIDS or disability.
10.1.3 The Program Manager shall establish and maintain written procedures under which any person, applying for or receiving services hereunder, may seek resolution from the Program Manager of a complaint with respect to any alleged discrimination in the provisions of services by the Program Manager's personnel. At any time any person applies for services under this Agreement, he or she shall be advised by the Program Manager of these procedures. A copy of such procedures shall be posted by the Program Manager in a conspicuous place, available and open to the public, in each of the Program Manager’s facilities where services are provided hereunder.
