Non-Smoking Building. The Building is a non-smoking building. Smoking is not permitted in any area of the Building including but not limited to Tenant suites including the Premises, private offices, corridors, restrooms, stairwells, parking garages and/or lobbies. Neither Tenant nor any of its employees, agents, guests or invitees shall smoke in the Building and Tenant will enforce this requirement with respect to anyone in the Building on behalf of, related to, or at the request of Tenant.

Non-Smoking Building. In accordance with the Surgeon General of the United States, to maintain a healthy work environment, Landlord designates the Building a non-smoking building. It is Tenant's responsibility to see that all staff and clientele are made aware of this policy and its enforcement.

Non-Smoking Building. Columbia Square is a non-smoking building. Tenant, its agents, employees and invitees are prohibited from smoking within the Building or the Premises. Tenant shall at all times keep and maintain its Premises as a "nonsmoking" area and shall require its employees, agents, and invitees to do the same. Landlord shall have the right, in its sole discretion, to terminate the Lease at any time after Tenant's third failure to observe the no smoking rules. Whether or not Landlord exercises such option, Tenant shall be solely liable for all costs and expenses associated with cleaning or maintenance required because of smoke damage of any kind.

Smoking within the building is a lease violation subject to lease termination. Lessees further agree that any ashes or cigarette butts occurring from Lessees or Lessees guests smoking outside the building will be promptly disposed of in a safe manner into the trash containers provided by Lessors for trash pickup. There is a $20 fine per occurrence anytime Lessors must remove cigarette butts from anywhere on the property except these trash containers.
