Normal Hours and Roster Consultation Requirements and Roster Changes. Employees may have their normal, or rostered (scheduled) hours, (40 on average per week), on any of the seven days of the week and anywhere within the 24 hour daily cycle with, on average, two rostered days off for each week. Some positions require rosters over “weekend days” and at varying times of the 24 hour daily cycle. However, some employees may be appointed to positions enabling them to work an eight hour period of duty including a 30 minute paid meal break, Monday to Friday in the period between 0700 and 1800. For employees working 24-hour rosters normal shift hours for full time employees will be a minimum of six, and a maximum of 10 hours, and an average of 40 hours per week on a roster cycle including on average at least two days off per week over the roster cycle. Affected staff will be consulted prior to the implementation or discontinuation of a roster. Their submissions, and those from the Association and any local roster committee, will be considered by the District Commander before a final decision is made to implement or discontinue a roster. Notice must be given 14 days before the first day of a roster cycle, of any shift changes within that cycle. In the case a shift changes that relate to special operations, the notice period is 7 days’ before the first day of the roster cycle. However, prior to the commencement of duty, rosters may be varied to meet an emergency situation that could not have been reasonably foreseen. Where rosters need to be changed and a rostered day off is cancelled the day off will be deferred as owing to be taken as soon as practicable. By agreement the employee may, from time to time, alter their rostered hours. Employees may agree to work their rostered shift in split periods of non-continuous duty. An employee working under the Flexible Employment Option (FEO) policy may work amended rostering conditions that differ from standard provisions as set when FEO is agreed or reviewed. Employees may change shifts one with another, provided they first obtain approval of the supervisor and time shall be recorded as worked by the substitute employee.

Nothing in this Section III.D affects Practitioner’s responsibility to refrain from (and liability for) billing Federal health care programs for items or services furnished, ordered, or prescribed by an excluded person. Practitioner understands that items or services furnished by excluded persons are not payable by Federal health care programs and that Practitioner may be liable for overpayments and/or criminal, civil, and administrative sanctions for employing or contracting with an excluded person regardless of whether Practitioner meets the requirements of Section III.D.
