Notice Timing. Consistent with 5 C.F.R. § 351, after notice to the Union, the Agency will provide notice of RIF or TOF action to affected employees of no less than sixty (60) full days. Individual RIF or TOF notices must include the following information:
A. The action to be taken, the reason for the action, and its effective date;
B. The employee’s competitive area, competitive level, retention subgroup, service date, and three most recent performance ratings of record received during the last four (4) years;
C. The place where the employee may inspect the regulations and records pertinent to this case;
D. The reasons why any lower standing employees in the same competitive area are being retained;
E. Grade and Pay retention information applicable to the employee receiving the notice;
F. Information on reemployment rights;
G. The employee’s right to grieve the action under Article 38, Negotiated Grievance Procedure.
H. The option to either grieve the action under Article 38, Negotiated Grievance Procedure or to the Merit Systems Protection Board if the employee alleges the RIF action is a Prohibited Personnel Practice under 5 U.S.C. § 2302.
Notice Timing. Within seven days after the receipt of a Transfer Notice the Company Directors shall serve a copy of that Transfer Notice on all the Shareholders other than the Proposing Transferor. In the case of a deemed Transfer Notice the Company Directors shall similarly serve notice on all the Shareholders (including the Proposing Transferor) notifying them that the same has been deemed to have been given.
Notice Timing. The Noteholder shall promptly notify the Issuer of any Change in Law of which it actually becomes aware for which it determines to demand compensation under this Section 9(c). Notwithstanding clauses (i) or (ii) of this Section 9(c), the Issuer shall not be required to compensate the Noteholder for any increased costs or reductions suffered or incurred more than 90 days prior to the date that the Noteholder notifies the Issuer of the Change in Law giving rise to such increased costs or reductions and of the Noteholder's intention to claim compensation therefor.
Notice Timing. If, following discussions under clause 10.2, the employment of one or more Employees will be terminated on redundancy grounds, the Company shall provide to the Employee whose position has been made redundant (“the Redundant Employee”) five weeks’ notice of termination or payment in lieu of all or part of the notice period.
