Ongoing Construction. Grantee shall notify County at least ten (10) business days prior to the commencement of any construction in any Rights-of-Way. Grantee shall not open or disturb the surface of any Rights-of-Way or public place for any purpose without first having obtained a permit to do so in the manner provided by law. All excavation shall be coordinated with other utility excavation or construction so as to minimize disruption to the public.
Ongoing Construction. Producer acknowledges that there is ongoing construction taking place on the roof of a building or building(s) on the Property. Such construction and activities associated therewith shall be permitted to continue during the period of Producer’s access to the Property. Producer shall not limit, restrict or interfere in any way with any construction activities taking place on the Property.
Ongoing Construction. Unit Owner acknowledges that the building may be under going construction in connection with Sponsor’s obligations under the Offering Plan to convert the building to condominium ownership. The Work by the Unit Owner shall in no way interfere with, delay, impede or conflict with any work being performed by Sponsor or its representatives or any building applications, filings, permits pending with the Buildings Department filed on behalf of Sponsor. Unless otherwise agreed to in writing by the Condominium Board, Unit Owner shall coordinate any and all Governmental Agency filings with and through the firm of Metropolis Group, Inc. 000 Xxxxxxxx, Xxxxx 000, Xxx Xxxx, XX 00000 (phone: 000-000-0000) at Unit Owner’s sole cost and expense.
Ongoing Construction. The Property is adjacent to or near other properties that have been or may be developed after Purchaser has accepted possession of the Property. Until development or construction of particular phases of the Project is commenced, portions of the Property including parking areas may be utilized for (a) storing of construction materials or equipment; or (b) a staging area in connection with the construction. The roadways in and around the Property will be used by construction vehicles and equipment for ingress and egress to the construction sites. Purchaser understands and acknowledges that the development, construction and/or sales of the Project or such other properties may result in noise, dust, increased traffic and other nuisances or annoyances to persons within the Project, and may limit Purchaser’s access to portions of the Project. Care must be taken around construction sites, as certain hazardous conditions relating to the construction may exist for a period of time. In addition, continued development of additional phases of the Project and areas around the Project may cause dust in and around the Property for a number of years. Purchaser acknowledges and understands that Seller will make efforts to minimize dust, but that it is an inevitable result of the ongoing construction. PURCHASER ACKNOWLEDGES AND HEREBY WAIVES ANY RIGHTS, CLAIMS OR ACTIONS WHICH PURCHASER MAY NOW HAVE OR WHICH MAY ACCRUE IN THE FUTURE AGAINST SELLER AS A RESULT OF ANY DAMAGE TO PURCHASER’S PROPERTY, INCLUDING ANY PERSONAL PROPERTY, ANY INCONVENIENCE, ANNOYANCE, OR NUISANCE CAUSED BY ANY SUCH ONGOING CONSTRUCTION ACTIVITIES. THE TERMS OF THIS WAIVER SHALL SURVIVE THE OCCUPANCY BY THE PURCHASER OF THE PROPERTY AND THE DELIVERY OF THE UNIT DEED FOR THE PROPERTY.
Ongoing Construction. The Promoter clarifies that the Complex is a large- scale development and there may be block-wise/partial completion given by the competent authorities for different blocks. The construction work for the remaining building(s)/tower(s)/phase(s) in the Complex will continue till completion certificate in respect of the last building/tower/phase in the Complex is received. The Allottee understands that there will certain construction activities which will cause noise/movement of vehicles for loading/unloading of construction materials and this may cause unavoidable inconveniences to them. The Promoter will not be held responsible for the same. The Promoter, however, will follow the rules/ regulations prescribed by the Municipal and/or Civic Authorities having jurisdiction over the Complex.

  • During Construction Upon request of the Owner the Contractor shall submit written proposals for unit prices to be applied in the event Change Order Work is authorized by the Owner to be performed under Case (b).

  • DAF Construction The DAF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Developer and Connecting Transmission Owner agree on another mutually acceptable deadline, the Developer shall deliver to the Connecting Transmission Owner and NYISO “as- built” drawings, information and documents for the DAF, such as: a one-line diagram, a site plan showing the Large Generating Facility and the DAF, plan and elevation drawings showing the layout of the DAF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Developer’s step-up transformers, the facilities connecting the Large Generating Facility to the step-up transformers and the DAF, and the impedances (determined by factory tests) for the associated step-up transformers and the Large Generating Facility. The Developer shall provide to, and coordinate with, Connecting Transmission Owner and NYISO with respect to proposed specifications for the excitation system, automatic voltage regulator, Large Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • Legal Construction If one or more of the provisions contained in this Agreement shall for any reason be held invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provisions and this Agreement shall be construed as if it did not contain the invalid, illegal, or unenforceable provision.

  • ICIF Construction The ICIF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Parties agree on another mutually acceptable deadline, Interconnection Customer shall deliver to Transmission Provider and Transmission Owner “as-built” drawings, information and documents for the ICIF, such as: a one-line diagram, a site plan showing the Generating Facility and the ICIF, plan and elevation drawings showing the layout of the ICIF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer’s step-up transformers, the facilities connecting the Generating Facility to the step-up transformers and the ICIF, and the impedances (determined by factory tests) for the associated step-up transformers and the Generating Facility. Interconnection Customer shall provide Transmission Provider and Transmission Owner with Interconnection Customer’s specifications for the excitation system, automatic voltage regulator, Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • Project Construction The Contractor agrees to provide continuous on-site supervision on each Job Order, while progress on the project is being accomplished. The Contractor’s Project Manager will ensure:

  • New Construction If this contract is for a Property that is newly constructed and the new construction option is selected, coverage begins on day one (1) of month thirteen

  • Special Construction If, after an order is placed, Xxxxxxx finds that third-party special construction services are needed to build, configure or install any additional facilities and/or equipment necessary for Verizon to provide Access service, Verizon will notify the Customer of any such special construction charges. If Customer does not accept the special construction charges, Customer may terminate the order(s) affected by the special construction charges, with no cancellation fee(s).

  • Contract Construction 6.27.1 The parties acknowledge that each party and its counsel have reviewed this CONTRACT and that the normal rule of construction to the effect that any ambiguities are to be resolved against the drafting party shall not be employed in the interpretation of this CONTRACT or any amendment or exhibits hereto.

  • Agreement Construction Headings or captions to the provisions of this Agreement are solely for the convenience of the parties, are not part of this Agreement, and shall not be used to interpret or determine the validity of this Agreement. Any ambiguity in this Agreement shall not be construed against the drafter, but rather the terms and provisions hereof shall be given their reasonable interpretation.
