Ordering of Materials. The quantities set out in the Schedule of Quantities have been carefully determined from calculations based on data available at the time and should therefore be considered to be only approximate quantities. The liability shall rest entirely and solely with the Contractor to determine before ordering, the required types and quantities of the various materials required for completion of the Works in accordance with the Specifications and the Drawings issued to the Contractor for construction purposes. Any reliance placed by the Contractor on the estimated quantities stated in the Schedule of Quantities issued for tendering purposes, or measurements made by the Contractor from the drawing issued for tendering purposes, shall be entirely at the Contractor’s risk, and the Employer accepts no liability whatever in respect of materials ordered by the Contractor on the basis of Tender Documents.” “Neither housing nor shelters are available for the Contractor's employees, and the Contractor shall make his own arrangements to house his employees and transport them to site. Ordering of Materials. Bargaining unit members shall be provided instructional supply and equipment requests. Such supply and equipment requests shall be returned to the treasurer's office not later than May 15 to allow the Board sufficient time to develop budgeting plans for the coming school year.
Ordering of Materials. Where Evolve Plumbing Services Plumbing orders materials on behalf of the Customer, the Customer will be liable to reimburse Evolve Plumbing Services Plumbing the costs of such materials (even where the Customer instructs Evolve Plumbing Services Plumbing to order incorrect materials). Refunds will not be provided unless otherwise agreed by Evolve Plumbing Services Plumbing in writing. If Evolve Plumbing Services Plumbing determines that additional materials are required for the provision of the Services then the Customer will be liable for the payment of any additional materials (except where caused by the negligent act or omission of Evolve Plumbing Services Plumbing).

Ordering of Materials. 6.1 Insofar as the purchaser supplies parts to the supplier, the purchaser shall retain title thereto. Any processing or remodelling by the supplier shall take place on behalf of the purchaser on the supplier's own account. If the purchaser's goods under retention of title are processed together with other items not belonging to the purchaser, the purchaser shall acquire joint title to the new item in the ratio of the value of the purchaser's item to the other processed items at the time of processing. The supplier shall hold such sole or joint property in safekeeping for the purchaser. 6.2 If the item supplied by the purchaser is inseparably mixed with other items not belonging to the purchaser, the purchaser shall acquire joint title to the new item in the ratio of the value of the item under retention of title to the other mixed items at the time of mixing. If mixing takes place in such a manner that the supplier's item is to be regarded as the main item, it shall be deemed agreed that the supplier shall transfer joint title to the purchaser on a pro-rata basis. The supplier shall hold such sole or joint property in safekeeping for the purchaser. 6.3 Insofar as the collateral rights to which the purchaser is entitled under 6.1 and 6.2 exceed, by more than 20 % in terms of the net value, the purchase price of the goods provided by the purchaser to the supplier under retention of title, the purchaser shall release collateral rights at the supplier's request. 6.4 The purchaser shall retain title to its tools. The supplier shall use such tools exclusively for manu- facturing the goods ordered by the purchaser. The supplier shall, at its own expense, insure the tools belonging to the purchaser against fire damage, water damage and theft on a replacement value ba- sis. The supplier shall carry out in due time, at its own expense, any and all necessary servicing and inspection work. The supplier shall immediately notify the purchaser of any and all malfunctions. If the supplier culpably omits to do so, damage claims shall remain unaffected.

  • Delivery of Materials In the event of any expiration or termination of this Agreement, Contractor shall promptly provide the JBE with all originals and copies of the Deliverables, including any partially-completed Deliverables-related work product or materials, and any JBE-provided materials in its possession, custody, or control. In the event of any termination of this Agreement, the JBE shall not be liable to Contractor for compensation or damages incurred as a result of such termination; provided that if the JBE’s termination is not for cause, the JBE shall pay any fees due under this Agreement for Services performed or Deliverables completed and accepted as of the date of the JBE’s termination Notice.

  • Return of Materials Upon termination or expiration of this Agreement, or upon written request of the Owner, the Recipient shall promptly return to the Owner all physical and digital materials representing the Owner's Confidential Information and all copies thereof. The Owner shall notify the Recipient immediately upon discovery of any loss or unauthorized disclosure of the Confidential Information.
