Common use of Overtime rest breaks Clause in Contracts

Overtime rest breaks. 22.5.1 When an employee is required to work overtime after the usual ceasing time for the day for two hours or more, the employee will be allowed to take without deduction of pay, a rest break of twenty minutes in duration immediately after such ceasing time and thereafter, after each four hours of continuous work, the employee will be allowed to take also, without deduction of pay, a rest break of 30 minutes in duration. (Note: A meal allowance is also payable under clause 19.9). In the event of an employee remaining at work after the usual ceasing time without taking the rest break of twenty minutes and continuing at work for a period of two hours or more, the employee will be regarded as having worked twenty minutes more than the time worked and be paid accordingly. For the purpose of this clause usual ceasing time is at the end of ordinary hours inclusive of time worked for accrual purposes as prescribed in clause 18 – Hours of work.
