BREAKS BETWEEN WORKING DAYS. An Employee is entitled to a break of least 10 consecutive hours off duty between completion of overtime, weekend work or work on public holidays, and recommencement of their next ordinary working day. For example, an Employee who finishes overtime at midnight will not be required to recommence work until 10:00 am the following day but shall be paid from their normal start time as if they were at work. Where the Employer requires the Employee to recommence work before they have had 10 consecutive hours off duty, the Employee will be paid at double time rates until they cease work. The Employee will then be entitled to be absent until they have had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. The parties agree the 10hour break is important for the purposes of fatigue management. Accordingly, for the purposes of calculating when the 10 hour commences the “completion of overtime” referred to in clause 41.8 shall include the travel time the Employee takes to return directly to their normal place of residence or accommodation.
BREAKS BETWEEN WORKING DAYS. (a) An Employee that works so much overtime that, between the termination of ordinary work on one day and the commencement of ordinary work on the next day, the Employee has not had at least 10 consecutive hours off duty between those times, or on a Saturday, Sunday or Holiday without having had 10 consecutive hours off duty in the 24 hours preceding ordinary commencing time on their next ordinary day will, subject to this subclause, be released after completion of such overtime until the Employee has had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
BREAKS BETWEEN WORKING DAYS. Overtime will be arranged so that, wherever reasonably practicable, an employee does not work more than sixteen (16) hours in any consecutive 24 hour period and so that each employee may have ten (10) consecutive hours off duty in each such consecutive 24 hours. Subject to paragraph below, an employee who works so much overtime that he/she does not have ten (10) consecutive hours off between the end of work on one day and the start of work on the next, will be released until he/she has had ten (1) hours off duty without loss of pay for ordinary working time during that absence. If an employee is instructed to resume or continue work without having had ten (10) consecutive hours off duty, then the employee will be paid overtime at double time until released from duty. The employee is then entitled to be absent until he/she has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during that absence.
