Partial Redundancy discontinue a particular academic program in whole or in part, provided that the academic priorities of the University no longer warrant such a program; or
Partial Redundancy. If the academic priorities of the University no longer warrant the continuation of a particular program, in whole or in part, whether for financial or academic reasons:
(i) the program shall not be considered discontinued, in whole or in part, for layoff purposes unless the discontinuance has been approved by Council. The University shall notify all employees potentially affected by the program discontinuation of the Council meeting at which the program discontinuation will be considered. A copy of the notice of the meeting will also be sent to the Association. A grievance in the case of layoff for reason of partial redundancy shall be subject to the same limitations as in the case of tenure (Article 15.18);
(ii) before any employees are laid off, the Employer shall determine whether some or all layoffs could be avoided by:
(a) economizing on other areas of expenditure,
(b) transfer to another academic program as specified in Article 29.9,
(c) retraining as specified in Article 29.10,
(d) early retirement as specified in Article 29.11;
(iii) employees shall be laid off and recalled according to seniority as specified in Article 29.6;
(iv) employees who are to be laid off shall be notified according to Article 29.7;
(v) employees who are laid off shall be entitled to the severance benefits specified in Article 29.8 or whatever Assisted Early Retirement Plan may be in effect at the time;
(vi) only employees in a discontinued program shall be subject to layoff due to a Partial Redundancy.
Partial Redundancy. The Board is obligated to teachers partially included in the redundancy pool in the third year after such teachers are initially declared redundant only for that portion of their time that has been assigned by the Redundancy Committee to teaching credit and/or non-credit courses.
Partial Redundancy. 4.4.7.1 Where, as a result of reduction in funding, part of the employee’s position is made redundant and the portion of redundancy is greater than 25% of the contracted hours of employment, the employee will be made redundant in accordance with the provisions of this Clause, unless the employee otherwise accepts the new reduced hours of employment. Where an employee accepts the new reduced hours of employment no redundancy payment will be made.
4.4.7.2 Where as a result of reduction in funding, the employee’s position is made redundant and the portion of redundancy is less than 25% of the contracted hours of employment, the employee will reduce their hours of employment accordingly and no redundancy payment will apply.
Partial Redundancy a) Where an Employee is transferred to lower paid duties by reason of redundancy, the Employee must be given one school term's notice and the College may, at the College's option, make payment instead, of an amount equal to the difference between the former rate of salary and the new rate of salary for the number of weeks of notice still owing.
b) Where an Employee is given notice of partial redundancy, the Employee may within one month of receipt of such notice elect to declare the position wholly redundant in which case all provisions of this clause in relation to total redundancy will apply.
c) Where partial redundancy is accepted by an Employee a pro rata compensatory redundancy payment in accordance with Clause 31.6(a) will be provided to the Employee at the date when the partial redundancy takes effect.
Partial Redundancy. 41.4.1 A partial redundancy payment which arises as a result in the reduction or alteration of a position(s) or hours shall be paid in line with the following formula:
41.4.2 Existing weekly rate at ordinary hours minus the new weekly rate at ordinary hours multiplied by 2 weeks for each year of service or part thereof to the maximum of 22 weeks’ pay.
41.4.3 A Salary Maintenance payment which arises as a result in the reduction or alteration of classification shall be paid on a weekly basis in line with the following formula:
41.4.4 Existing weekly rate at ordinary hours minus the new weekly rate at ordinary hours paid according to the table in 41.6.
Partial Redundancy. (a) Where an Employee is transferred to lower paid duties by reason of redundancy, the Employee must be given one school term's notice and the School may, at the School's option, make payment instead of an amount equal to the difference between the former rate of salary and the new rate of salary for the number of weeks of notice still owing.
Partial Redundancy. (a) Where a teacher is transferred to lower paid duties by reason of redundancy, the employee must be given 12 weeks' notice and the School may, at the School's option, make payment instead of an amount equal to the difference between the former rate of salary and the new rate of salary for the number of weeks of notice still owing.
(b) Where an employee is given notice of partial redundancy, the employee may within one (1) month of receipt of such notice elect to declare the position wholly redundant in which case all provisions of clause in relation to total redundancy will apply.
(c) Where partial redundancy is accepted by an employee a pro-rata compensatory redundancy payment in accordance with clause 46 will be provided to the teacher at the date when the partial redundancy takes effect.
Partial Redundancy. Where the Head of School can substantiate with a detailed written statement that the volume of work in any section of the School has diminished to such an extent that a partial redundancy in working hours by an employee is necessary, the employee may agree to accept the partial redundancy or may, within one (1) month, elect to declare the whole position redundant in which case all the redundancy provisions expressed in this clause will apply. Where a partial redundancy is accepted, pro-rata compensatory payment will be made in accordance with the provisions of sub-clause 18.1(B).
Partial Redundancy. 28.3.1 Where a Teacher is transferred to a reduced workload by reason of Partial Redundancy, the Teacher must be given seven (7) term weeks' notice and the Employer may, at the Employer’s option, make payment instead of an amount equal to the difference between the former rate of salary and the new rate of salary for the number of weeks of notice still owing.
