Reduction in Funding. (a) Without limiting other rights under this Agreement, the Agency may reduce the Funding agreed but not yet paid to the Recipient under this Agreement by giving at least 20 Business Daysnotice to the Recipient: (i) (Loss of Funding) if the Agency does not receive sufficient funds from the NSW Parliament or the Commonwealth Government to provide the Funding for the Activity; or (ii) (Change of policy) if there is a change in NSW Government policy which affects the Funding Program or the Activity. (b) If the Funding is reduced under this clause the Agency will: (i) agree with the Recipient any necessary consequent variation to this Agreement, for example, by way of reduction in scope of the Activity; and (ii) pay the Recipient’s reasonable, substantiated costs (other than loss of profit or income) necessarily and directly incurred as a result of the reduction in the Funding and any consequent variation to the Agreement (“Reduction in Funding Costs”), provided that: A. the Recipient uses its best efforts to minimise its Reduction in Funding Costs; and B. the total amount of Reduction in Funding Costs payable will not exceed the total amount of unpaid Funding forfeited through reduction in the Funding under this clause 7 (Reduction in Funding).

Reduction in Funding. Either party may terminate the agreement due to a reduction in funding which might interfere, in any way, with its fulfillment of the agreement. At least 10 calendar days’ notice will be provided unless shorter notice is unavoidable due to special circumstances.
Reduction in Funding. In the event that State and federal funding for the payment of services under this contract is reduced so that payments to the contractor cannot be made in full, this contract shall terminate, without liability to the State, unless both parties agree to a modification of the obligations under this contract. The effective date of such termination shall be ninety (90) days after the contractor receives written notice of the reduction in payment, unless available funds are insufficient to continue payments in full during the ninety (90) day period, in which case the Department shall give the contractor written notice of the earlier date upon which the contract shall terminate.
Reduction in Funding. In the event there is a reduction of funds made available by County to Contractor under this or subsequent agreements, the County of San Diego and its departments, officers and employees shall incur no liability to Contractor and shall be held harmless from any and all claims, demands, losses, damages, injuries, or liabilities arising directly or from such action.

Reduction in Funding. The State of Kansas’ current financial situation does not make it possible for SRS to make firm, unalterable financial commitments. In the event SRS determines lack of funding requires a modification of this agreement, SRS reserves the right to renegotiate terms and conditions of the agreement with the CDDO. The CDDO agrees to cooperate with SRS in negotiating and mediating this agreement should SRS determine that such modification is necessary to manage the resources available to SRS. In the event SRS is subject to a formal funding reduction or allotment, SRS reserves the right to alter or adjust the payment amounts or terms of this agreement to meet funding reductions or allotments by sending a written notice of such alterations or adjustments to the CDDO 30 days before such alterations or adjustments become effective. Should the CDDO believe there is a need to modify other terms or conditions of the agreement, SRS will, in good faith, negotiate regarding the terms of the agreement.

Reduction in Funding. The County reserves the option to prospectively reduce the amount of this Agreement in the event that funds allocated to the County that are identified sources of revenue for purchasing services via this contract do not become available for use in purchasing said services. The County agrees to promptly notify the contracting Contractor of any reduction in funding by state, federal, or other officials.

In the event of a reduction in funding for Adult Basic Education or Life Management, reductions in staff, if necessary, will be determined by the Administration taking into consideration a unit member's individual certification or other demonstrated skills or expertise. However, should a mid-year reduction in staffing be necessary as a result of a reduction in funding, reduction in staff shall be made on the basis of length of service within the affected area. B. In the event that a unit member who has two consecutive years of service is excessed due to a reduction in funding as described in Paragraph "A" above, that member shall have recall rights for eighteen months into openings which develop in a program for which he/she is qualified.
Reduction in Funding. In the event a material reduction occurs in annual funding below the amount for the prior Fiscal Year, K12 may terminate this Agreement effective (i) immediately upon written notice, if notice or publication of such reduction is given prior to the commencement of the school year to which such reduction is applicable, provided K12’s written notice is provided to the other party within sixty (60) days of the notice or publication of such reduction or (ii) sixty (60) days following written notice by K12, if notice or publication of such reduction is given during the school year to which such reduction is applicable.
