Payment for Vacation. 1. An employee, when terminating employment with the Employer, shall be compensated for vacation leave earned and accrued to the date of separation, provided that new employees who are discharged or who resign during their six (6) month probationary period shall not be entitled to compensation. 2. An employee who has served in higher or lower positions on temporary appointments shall be paid for vacation leave at the rate of pay appropriate to the classification in which he/she worked the majority of the time in the six (6) month period immediately prior to the effective date of the vacation leave taken. 3. Payment for vacation immediately prior to leaving on an authorized vacation may be made at the request of the employee, provided the request is made at least ten (10) days prior to the vacation period and the authorized vacation is not for less than ten (10) working days. After such payment, the employee must take his/her vacation for the entire period for which payment was made. 4. Vacation pay shall be paid for a maximum of ten (10) hours at the employee's basic rate of pay, exclusive of special or premium pay for employees assigned to a 10 hour shift/4 day work week and a maximum of eight (8) hours at the employee’s basic rate of pay, exclusive of special or premium pay for employees assigned to an 8 hour shift/5 day work week. 5. Transit Operators must use “Available to Use” vacation hours by December 31 of each calendar year. Hours remaining after this date shall be paid to the employee in February. These hours may not be carried over into another calendar year without prior approval.
