Performance Deadlines. To the extent one party’s performance of an obligation under this Agreement depends on the other party to provide data or information, a delay in providing the data or information will automatically extend the deadline for performance of the dependent task for a minimum of the time the initial task is complete. By way of example, if Contractor’s reporting depends on receipt of claims data from DVHA and DVHA does not send data for 45 days, Contractor’s deadline to report is automatically extended by 45 days.

Performance Deadlines. Notwithstanding anything herein to the contrary, in the event the final date for performance by either party to this Contract of any condition or obligation hereunder falls upon a non-business day (i.e., Saturday, Sunday, national holiday or local holiday recognized by banks in the locality of the Property), the final date for performance of such condition or obligation shall be extended automatically and without notice until the next succeeding business day, time being of the essence with respect to the matters set forth in this Contract. The termEffective Date”, as used herein, shall mean the last date on which this Contract has been fully executed on behalf of Seller and Purchaser as indicated by the dates adjacent to the signatures of the parties set forth below.

Performance Deadlines. 4.1 Handover of the installation space: within seven calendar days following the execution of the Contract. 4.2 Commencement of the works on the work: immediately upon the handover of the installation space. 4.3 Completion (handover) of the work: no later than within ten calendar days following the commencement of the works on the work. 4.4 Vacation of the installation space: within seven calendar days following the completion of the work. 4.5 The performance of the subject of the work shall follow the approved schedule of the course of works (hereinafter referred to as the “Schedule”), which constitutes an integral part of the Contract. The Schedule shall contain the basic phases of the performance of the subject of the work including the envisaged performance date. 4.6 The performance deadlines set out in the Schedule for the individual phases of the performance of the subject of the work shall be binding on the contractor. Should the contractor be in default with completion of partial phases of the performance of the work pursuant to the Schedule for more than 15 days during the course of works, the client shall be entitled to rescind the Contract. 4.7 The performance deadlines and Schedule of the course of works may be adjusted depending on release of funds from the subsidy granted to the client. 4.8 The contractual deadlines of the performance of the work shall be binding on the contractor. The client shall reserve the right to postpone or delay the beginning of the performance of the subject of the work and further partial phases of the performance of the subject of the work and, with regard to and depending on the amount of the funds available for financing of the work, to extend the due dates of invoices or terminate them before the completion of the work or, as the case may be, suspend the works. In such an event, the client shall be obliged to pay for all works performed and taken over and for the material supplied for the order.
Performance Deadlines. The Builder undertakes to: 1) Begin without delay the study of all of the buildings authorised by the PAZ on the land that is sold or leased to it and to communicate to the Company its final construction project, at least one month before the filing of the building permit application and to present at the same time for the SEM’s approval a phased construction schedule by annual portions. 2) File its building permit application within a period of three months from the date of the conveyance, it being stipulated that unless otherwise provided in such deed, it is the date of signing of the SSP deed (private contract) that is taken into consideration in this regard. 3) Undertake the construction work within a period of four months from the issuance of the building permit. 4) Have completed the construction within a period of 18 months from the issuing of building permits. The execution of this obligation will be deemed satisfied by the presentation of a statement of completion issued by the Builder’s architect subject to verification by the SEM’s architect. Different periods can be stipulated in the deed of sale or lease. The SEM can even grant exemptions in exceptional and justified cases.
