Personal Property Loss - Reimbursement. The District shall reimburse members for personal effects damaged in the performance of duties provided such damage occurs as a result of an action of someone other than the members or of a circumstance for which the school district is responsible. Personal effects shall be defined as those articles pertaining to one’s own person which may include, but not be limited to, eye glasses contact lenses, hearing aids, dentures, watches or articles of clothing. The District will replace other damaged or lost personal property provided: 6.02.1 The use of the property has been mutually agreed upon by the site/program administrator and the employee. If there is no agreement, the employee may appeal to the next level of administration. 6.02.2 The property has been registered with the site/program administrator. 6.02.3 Reasonable provision has been mutually made for the security of the property. 6.02.4 The District will not assume that portion of personal losses covered by private insurance carriers. 6.02.5 The District shall provide employees copies of the form(s) necessary to register personal property under this section.

Personal Property Loss - Reimbursement. The District shall reimburse unit members, up to $500 per occurrence for any loss, damage, or destruction of personal property of the unit member while on duty in the school, on the school premises, or on a school sponsored activity. A unit member may petition the District for reimbursement beyond the stated limit. 1. For the intent of this section “Personal Property” is defined as those items approved on the unit member’s personal inventory form. Items used for instructional purposes shall be reimbursable property, provided the unit member has listed such property on a district provided inventory form. The inventory form is to be updated at least annually at the beginning of each school year or when any additional property is brought in by the unit member. The inventory form is valid for one (1) year only. 2. In the event unit members are reimbursed pursuant to this section, the District shall, to the extent of such payments, be subrogated to any rights of the unit member to recover compensation for such damage or stolen property. The District may file and prosecute an action to enforce its subrogation right in the small claims court if the amount of the claim is within the court's monetary jurisdiction, or the District may enforce its subrogation right in any other court of competent jurisdiction. 3. A unit member filing a claim pursuant to this Section shall file said claim no later than one (1) working day following the damage or loss of the property in question. The District retains the right to inspect all damaged property and to require full disclosure of witnesses, prior conditions and full description of damaged or stolen property. 4. A police report of the incident may be required.

Personal Property Loss - Reimbursement. For loss or damaged personal property, the District will reimburse the teacher in the amount of the insurance deductible claim or reimburse for non-insured items up to a maximum of $500. This may be applied to personal property or automobile damage provided the loss did not result from teacher negligence.

  • Personal Property Insurance Lessee shall obtain, at Lessee's sole cost and expense, a policy of fire and extended coverage insurance including coverage for direct physical loss special form, and a sprinkler leakage endorsement insuring the personal property of Lessee. The proceeds from any personal property damage policy shall be payable to Lessee. All insurance policies required in 6 C) and 6 D) above shall: (i) provide for a certificate of insurance evidencing the insurance required herein, being deposited with Lessor ten (10) days prior to the Commencement Date, and upon each renewal, such certificates shall be provided 15 days prior to the expiration date of such coverage, (ii) be in a form reasonably satisfactory to Lessor and shall provide the coverage required by Lessee in this Lease, (iii) be carried with companies with the a Best Rating of A minimum, (iv) specifically provide that such policies shall not be subject to cancellation or reduction of coverage, except after 30 days prior written notice to Lessor, (v) name Lessor, Lessor's lender, and any other party with an insurable interest in the Premises as additional insureds by endorsement to policy, and (vi) shall be primary. Lessee agrees to pay to Lessor, as additional Rent, on demand, the full cost of the insurance policies referenced in 6 A) and 6 B) above as evidenced as insurance xxxxxxxx to Lessor which shall be included in the CAC. If Lessee does not occupy the entire Premises, the insurance premiums shall be allocated to the portion of the Premises occupied by Lessee on a pro-rata square footage or other equitable basis, as determined by Lessor. It is agreed that Lessee's obligation under this paragraph shall be prorated to the reflect the Commencement Date and the end of the Lease Term. Lessor and Lessee hereby waive any rights each may have against the other related to any loss or damage caused to Lessor or Lessee as the case may be, or to the Premises or its contents, and which may arise from any risk covered by fire and extended coverage insurance and those risks required to be covered under Lessee's personal property insurance. The parties shall provide that their respective insurance policies insuring the property or the personal property include a waiver of any right of subrogation which said insurance company may have against Lessor or Lessee, as the case may be.
