Common use of Personal Sick Leave Clause in Contracts

Personal Sick Leave. (1) An employee is entitled to use any accrued personal leave for absence due to personal illness or injury. The employee is entitled to use accumulated personal leave as sick leave if the employee has already used the current year’s sick leave component of the personal leave entitlement as personal sick leave.‌ (2) An employee’s entitlement to sick leave is conditional on the employee promptly notifying the Company of any illness or injury that will cause the employee to be absent from work, and the approximate period of that absence. (3) An employee is required to produce a medical certificate for any absence of 2 days or more. In the event that a medical certificate is not provided for any period of sick leave in excess of 2 days, the period of absence will be treated as annual leave or unauthorised leave without pay at the Company’s discretion. (4) Leave taken by the employee under clause 16.3(1) is deducted from the amount of personal leave under clause 16.1.
