Phase 3. This phase will continue until participants are discharged and will include the following:
Phase 3. Xxxxx 0, Xxxxxx to Market, consists of the continuation of all Phase 1 and Phase 2 elements (except those that have been completed or due to other circumstances cannot be continued) and, in addition, may consist of the following elements: (a) Generation redispatch and coordination, as described in Articles VIII and XII (pursuant to NERC Policies 5 and 9); (b) Consistency in calculating energy prices at the market borders as described in Section 12.3.1; (c) Additions to, or deletions from Items (a) through (g) of Section 3.3.1 and Items (a) and (b) of Section 3.3.2, to which the Parties may agree from time to time, including agreements prior to initiation of Phase 2 and in accordance with Section 3.1, or as ordered by the FERC.

The agency worker works in phase 3 as soon as the agency work employment contract is continued after completion of phase 1-2 or when entering into a new agency work employment contract with the same employment agency within a period of six months after completion of phase 1-2. b. Phase 3 lasts a maximum of three years and during this phase, a maximum of six agency work employment contracts without agency clause can be agreed. c. In phase 3, the agency worker is always working on the basis of an agency work employment contract for a definite period of time without agency clause, unless an agency work employment contract for an indefinite period of time without agency clause has explicitly been agreed. d. The three-year period and the number of six agency work employment contracts without agency clause (as referred to under b.) are added up as long as any interruption between two agency work employment contracts does not exceed six months. In that case, the interruption period is included. If there has been an interruption of six months or more between two agency work employment contracts, the counting of phase 1-2 starts at zero again. e. If the agency worker was already working in phase 3 before 1 January 2022 and has a fixed-term agency work employment contract that was entered into before this date with an end date on or after 2 January 2023, this contract may exceed the term of three years without the agency worker transferring to phase
Phase 3. If phases 1 and 2 have been completed and a new temporary employment contract is entered into after an interval of 26 weeks or longer, phase 1 will start anew. If phases 1 and 2 have been completed and the activities are continued or a new temporary employment contract is entered into within 26 weeks, the temporary worker will be deemed to be in phase 3. 1. The counting of phase 3 a. Phase 3 lasts 52 calendar weeks. During this period a maximum of 4 fixed-term temporary employment contracts may be entered into. b. If there is an interval of 13 weeks or longer but less than 26 weeks between two phase 3 temporary employment contracts, the counting of phase 3 will start anew. c. If there is an interval of 26 weeks or longer between two phase 3 temporary employment contracts, the counting of phase 1 will start anew. d. An interval of less than 13 weeks between two phase 3 temporary employment contracts will count towards the period of 52 calendar weeks. 2. The following provisions apply when a phase 3 temporary employment contract is entered into: a. A temporary employment contract may be entered into for a specific calendar period or for the term of a project that is objectively definable. b. Each time a phase 3 temporary employment contract is entered into, the employer and employee are once again free to determine the term of the temporary employment contract. c. A temporary employment clause may not be applied during the phase 3 temporary employment contract and the employer is under an obligation to continue to pay the wages of the temporary worker. 3. The following provisions apply at the end of a phase 3 temporary employment contract: a. A temporary employment contract ends by operation of law on the specified date or on completion of the project. b. A fixed-term temporary employment contract may be terminated early, provided that provision for this has been made in the temporary employment contract and that valid notice of termination is given. c. Unless the temporary worker terminates the registration, the situation provided for in Article 6 will arise again as a result of termination of the temporary employment contract by operation of law. d. Notwithstanding Section 668a, subsections 1 to 4, in Book 7 of the Netherlands Civil Code, successive phase 3 temporary employment contracts will not be converted by operation of law into open-ended temporary employment contracts until the phase 4 conditions have been fulfilled.
