Prevention of Unauthorized Use. Participant agrees that it will comply, and agrees to require any applicable third party to comply, with all reasonable security specifications or requirements of FINRA including, if applicable, the installation of digital certificates for each of Participant’s users, in order to prevent the Service from being improperly accessed, received, used or improperly taken from any of Participant’s, or any applicable third parties, place(s) of business or residence. FINRA shall give Participant prior Notice of any such specifications or requirements. For the purpose of determining compliance with this subsection, at any and all times, any and all individuals designated by FINRA shall have (i) access to the place(s) of business or residence where the Service is accessed, received or used and (ii) the right to observe the access, receipt and use of the Service. Participant acknowledges and agrees that FINRA may use electronic means to verify and ensure Participant’s compliance with the terms of this Agreement including code embedded within the Service.

Prevention of Unauthorized Use. Data Licensee will cooperate with Data Vendors to protect the commercial value of Licensed Data by taking such measures as: (a) retaining all proprietary or restricted use notices included on Licensed Data as received; and (b) not obstructing or modifying proprietary or restricted use notices included on Licensed Data as received; and (c) ensuring that all copies of Licensed Data include all proprietary or restricted use notices included on Licensed Data as received . To the extent Data Vendors do not include any proprietary or restricted use notices on Licensed Data as delivered to Data Licensee, Data Licensee shall insert, at a minimum, the following notice on any copies of Licensed Data that Data Licensee makes: "PROPRIETARY INFORMATION OF DATA VENDOR. USE BY ENTITIES OTHER THAN AUTHORIZED, LICENSED USERS PROHIBITED"; and (d) storing and disseminating Licensed Data using methods, communication mediums and technologies that provide reasonable protections against their unlawful copying and unauthorized access and use.

FINRA shall not include in the Service any computer code designed to harm the operation of Participant’s computer system, or any other associated software, firmware, hardware, computer system or network or provide or allow unauthorized access to the Participant’s system.

Unless otherwise provided herein, the Wikitude SDK and Publisher Products do not track End User behavior or otherwise collect personal data. Prevention of Unauthorized Use. 28.4.1 The Parties agree to cooperate to prevent, identify, and cure unauthorized use or fraud. Each Party shall make available to the other Party fraud prevention features (including prevention, detection, or control functionality) in accordance with applicable Tariffs or as otherwise mutually agreed. 28.4.2 Both Parties shall use all reasonable efforts to prevent, monitor and cure fraud and unauthorized use. Until such time as partitioned access to fraud prevention, detection and control functionality within pertinent Operations Support Systems, such as the LIDB fraud alert and monitoring system, is made available to ANTC, BA shall, whenever fraud alert indicators are activated on ANTC accounts, use all reasonable efforts to immediately inform ANTC of any indications of fraud. The Parties agree to work together to establish processes and mechanisms regarding the provision of such information and to develop fraud detection and prevention systems that will benefit both Parties.
Prevention of Unauthorized Use. LICENSEE agrees that it has no right to use, and it will not use, the PROPERTY outside of the LICENSED TERRITORY or outside of the CHANNELS OF DISTRIBUTION, and that any such use of the PROPERTY would constitute an infringement of TPC's intellectual property rights.

(b) A Party shall promptly notify the other whenever it suspects or knows of unauthorized use of Wholesale Services, Unbundled Network Elements, or any other facilities or services provided hereunder and shall assist the other in the identification of responsible individuals, the preparation and presentation of relevant information to federal, state and/or local officials for the purpose of prosecuting those individuals responsible for the unauthorized use of the Wholesale Services, Unbundled Network Elements, or any other facilities or services and in any legal actions that one or both may bring against third parties responsible for the unauthorized use of any of Wholesale Services, Unbundled Network Elements, or any other facilities or services provided hereunder. A Party shall provide, where requested and where available, any relevant call information, including the number on which the call was received, the translated number, the circuit number, the date and time of call, call duration, switch identification, and identification of trunk type. (c) Both Parties shall use all reasonable efforts to prevent, monitor or cure unauthorized use. If a Party fails to do so and that Party had the ability to prevent the unauthorized or fraudulent use or where that Party had the responsibility to monitor, detect, or cure the unauthorized use and it failed to do so or failed to act promptly to prevent continued abuse, and where such failure was not caused in part by the failure of the other Party to promptly give notice of information in its possession regarding the occurrence of the fraudulent or unauthorized use, then that Party shall bear the entire amount of the liability. If both Parties failed to act reasonably they shall share on a pro rata basis any financial responsibility for the unauthorized use.
