The "Project Sites" clause defines the specific locations where work related to the project will be performed. It typically lists or describes the physical addresses, facilities, or areas that are considered part of the project scope, and may include provisions for access, security, or site-specific requirements. By clearly identifying the relevant sites, this clause ensures all parties understand where obligations must be fulfilled and helps prevent disputes over the boundaries or responsibilities associated with different locations.
Project Sites. A Project Site is a work location established by the Company, which may include project offices and/or a construction site. A Project Site is set up to support a project at or near a nuclear site, at which the Company has been contracted to perform project work for that client. For clarity, a “nuclear site” includes: a nuclear power station, a decommissioning or decontamination project site or a project site at a nuclear waste management facility, including in the earliest stages. For clarity, if the Company’s headquarters is moved, in whole or in part, from Sheridan Park/Montreal to another location, the new location is not considered a “Project Site” for the purposes of Article 22.05 (“Seniority”). The Montreal Office is likewise not a “Project Site”.

The Applicant shall secure Project sites that endure for the Summer Performance Periods provided for in accordance with the terms and conditions of this Agreement, or for another timeframe identified and agreed to as part of Addendum 2 hereof. The terms and conditions of the agreements secured by the Applicant with third parties and/or Customers with respect to Project sites are independent of the Company, and the Company shall not have any responsibility or incur any liability pursuant to such agreements. At any time during this Agreement and outside of any Summer Performance Period hereunder, the Applicant may remove, replace, or add any unit (i.e., any whole or part of an ESS solution) associated with a Project site or Customer, provided that any such change shall not modify the Load Reduction Guaranty (as hereinafter defined), and provided further that any such change shall be made in accordance with any applicable safety requirements. Prior to the Operational Date, the Applicant shall provide to the Company a list identifying all sites and Customers of Projects installed or to be installed by the Applicant. For each such site or Customer, the Applicant must meet the applicable M&V requirements. The Company will verify with the Applicant which sites and Customers are eligible under this Agreement.

Project Sites. The PP LGU shall provide sites or grant land use rights for the septage and/or sewerage facilities (such as the ieSSTP-PP) as selected by the JVC under terms and conditions to be agreed between the JVC and the PP LGU.

b) DTIDCL confirms that upon the Project Sites being handed over pursuant to the preceding sub-Clause (a) the Concessionaire shall have the right to enter upon, occupy and use the Project Sites to make at its costs, charges and expenses such up-gradation and improvements in the as may be necessary or appropriate to implement the Project and to provide the Project Facility and Project Upgrade subject to and in accordance with the provisions of this Agreement.
c) The list of Project Sites shall be reviewed jointly by the Concessionaire and DTIDCL to identify if any Bus Shelters are on the planned BRT corridors and such Bus Shelters shall be removed from the list attached at Schedule A and the Concessionaire shall have the option to identify additional equal number of Bus Shelters. DTIDCL shall endeavor to ensure to provide minimum 1397 locations (Consisting of 4 distinct zones i.e. ▇▇▇▇-▇, ▇▇▇▇-▇, ▇▇▇▇-▇ & Zone-4) for new shelter construction with equal advertising value and which are to be mutually agreed to have sustenance of the Project In.
Project Sites. The Project Sites are sufficient and appropriate in all respects for the development, siting, design, engineering, construction, ownership, operation, maintenance and use of the Project as contemplated by the Transaction Documents.
