Publication, Reproduction and Use of Material. No material produced in whole or in part under this Agreement shall be subject to copyright in the United States or in any other country. The CITY shall have unrestricted authority to publish, disclose and otherwise use, in whole or in part, any reports, data or other materials prepared under this Agreement.

Publication, Reproduction and Use of Material. Except as specifically authorized by UNIVERSITY in writing, information and other data developed or acquired by or furnished to CONSULTANT in the performance of this Agreement shall be used only in connection with services provided to UNIVERSITY.

The WFRC shall have the authority to publish, disclose, distribute and otherwise use, in whole or in part, any reports, data, or other materials prepared under this Agreement. Original documents, methodological explanations, drawings, designs, and reports generated by this Agreement shall belong to and be the property of WFRC in accordance with accepted standards relating to public works contracts. Any additional copies, not otherwise provided for herein, shall be the responsibility of WFRC. Documents, including drawings and specifications, prepared by CONSULTANT pursuant to this Agreement are not intended or represented to be suitable for reuse by WFRC or others. Any reuse of completed documents, or use of partially completed documents, without written verification or concurrence by Consultant for the specific purpose intended will be at WFRC’s sole risk and without liability or legal exposure to Consultant; and WFRC shall indemnify and hold harmless Consultant from all claims, damages, losses, and expenses, including attorney’s fees arising out of or resulting from re- use or misuse.

The AHA shall have unrestricted authority to publish, disclose, distribute and otherwise use, in whole or in part, any reports, data or other materials prepared under this Agreement. In addition, the AHA shall have unlimited rights in data first produced in the performance of this Agreement; form, fit, and function data delivered under this Agreement; data delivered under this Agreement (except for restricted computer software) that constitute manuals or instructional and training material for installation, operation, or routine maintenance and repair of items, components, or processes delivered or furnished for use under this Agreement; and all other data delivered under this Agreement unless provided otherwise for limited rights data or restricted computer software.

All documents, including reports, studies and other materials developed, produced or generated by the Service Provider or its sub-grantees or subcontractors as part of the performance required under this Agreement are referred to herein as the “Grant Documents”. DRAFT Service Provider and the MCWN shall have the mutual right to publish, distribute, and use all Contract Documents without permission of or payment to the other Party. The Service Provider will not publish or permit any other person to publish any Contract Documents without advance notice to the MCWN. The Service Provider shall acknowledge MCWN as providing funds for any such publication, and shall accede to any request by MCWN that appropriate disclaimer language be incorporated into the publication.

The WFRC shall have the authority to publish, disclose, distribute and otherwise use, in whole or in part, any reports, data, or other materials prepared under this Agreement for this project or for program communications purposes. Original documents and related source files, methodological explanations, drawings, designs, and reports generated by this Agreement shall belong to and be the property of WFRC. All files associated with the completion of the scope must be provided to WFRC upon completion of the scope prior to the payment of the final invoice.
Publication, Reproduction and Use of Material. A. Should the County elect to reuse work products provided under this Contract for other than the original project and/or purpose, the County will indemnify and hold harmless the Consultant from any and all claims, demands and causes of action of any kind or character xxxxxxx as a result of reusing the documents developed under this Contract. Additionally, any reuse of design drawings or specifications provided under this Contract must be limited to conceptual or preliminary use for adaptation, and the original Consultant’s or subcontractor’s signature, professional seals and dates removed. Such reuse of drawings and specifications, which require professional seals and dates removed, will be signed, sealed, and dated by the professional who is in direct supervisory control and responsible for adaptation.

In addition to Article XXIII, herein no material produced in whole or in part under this Award shall be subject to copyright in the United States or in any other country. Grantor shall have unrestricted authority to publish, disclose, distribute and otherwise use, in whole or in part, any reports, data or other materials prepared under the Agreement.
