PUBLICATIONS AND COPYRIGHTS. Both parties recognize that each organization may have extant work that predates this agreement. If those materials and/or data are used in the course of this work, they remain the property of the original developer. If new materials are developed during the term of the services contract described in Paragraph B.1 above, ownership and copyright of such will be governed by the terms of the services contract.

PUBLICATIONS AND COPYRIGHTS a. Materials developed by the Sponsor regarding the results of any activity supported under this Agreement, and intended for written publication or general distribution, may not be published by the Sponsor without prior written approval of the Corporation. Any such publication shall: (i) acknowledge the support of the Corporation and the State of New York; and (ii) state that the opinions, results, findings and/or interpretations of data contained therein are the responsibility of the Sponsor and do not necessarily represent the opinions, interpretations or policy of the Corporation or the State of New York. b. The Corporation agrees that the Sponsor may obtain copyright to any form, document, publication or report which may be produced as the result of support given or work completed under this Agreement. However, the Corporation and the State of New York expressly reserve the right to a royalty-free, non-exclusive and irrevocable license to reproduce, publish, distribute or otherwise use, in perpetuity, any and all copyrighted or copyrightable material resulting from this Agreement or activity supported by this Agreement. All publications by the Sponsor covered by this Agreement shall expressly acknowledge the Corporation's right to such license.

If new materials are developed during the term of the Agreement, as described in Paragraph B.1 above, each Party shall own all right, title and interest in the materials/data developed by the respective Party.
PUBLICATIONS AND COPYRIGHTS. OMRF will be free to publish the results of the Research Program after providing the Sponsor with a thirty (30) day period prior to publication in which to review each publication to identify patentable subject matter and to identify any potential inadvertent disclosure of the confidential information. If necessary to permit the preparation and filing of U.S. patent applications, the Principal Investigator may agree to an additional review period not to exceed sixty (60) days. Any further extension will require subsequent agreement in writing between the Sponsor and OMRF. As a matter of basic academic policy, OMRF retains the final right to determine the scope and content of any publications. The Sponsor will be acknowledged for the support provided to OMRF in any publication or report resulting from this Research Program.
PUBLICATIONS AND COPYRIGHTS a. OCFS and the State of New York expressly reserve the right to a royalty-free, non-exclusive and irrevocable license to reproduce, publish, distribute or otherwise use, in perpetuity, any and all copyrighted or copyrightable material resulting from this CONTRACT or activity supported by this CONTRACT. All publications by the Contractor covered by this CONTRACT shall expressly acknowledge OCFS's right to such license. b. All of the license rights so reserved to OCFS and the State of New York under this paragraph are equally reserved to the United States Department of Health and Human Services and subject to the provisions on copyrights contained in 45 CFR 92 if the CONTRACT is federally funded. c. The Contractor agrees that at the completion of any scientific or statistical study, report or analysis prepared pursuant to this CONTRACT, it will provide to OCFS at no additional cost a copy of any and all data supporting the scientific or statistical study, report or analysis, together with the name(s) and business address(es) of the principal(s) producing the scientific or statistical study, report or analysis. The Contractor agrees and acknowledges the right of OCFS, subject to applicable confidentiality restrictions, to release the name(s) and business address(es) of the principal(s) producing the scientific or statistical study, report or analysis, together with a copy of the scientific or statistical study, report or analysis and all data supporting the scientific or statistical study, report or analysis.
PUBLICATIONS AND COPYRIGHTS. Each Study Regimen is a multi-site study and a collaborative publication is anticipated. Site agrees that it shall delay publication using its own Study Treatment Data until such time as the collaborative publication is released or eighteen (18) months after the conclusion of the Study Regimen, whichever occurs first. In order to ensure the integrity of meaningfulness of the platform trial model, Site agrees that they shall delay publication of any Study Placebo Data or Xxxxxx Placebo Data until such time as the XXXXXX ALS Platform Trial Executive Committee grants explicit permission to publish it. The XXXXXX ALS Platform Trial Executive Committee will determine a publication strategy and assume oversight of this Article 14. A “Study Publication” is any proposed abstract, manuscript, presentation, publication or similar material containing Study Regimen Data.

PUBLICATIONS AND COPYRIGHTS. Performing Agency shall have the right to present or publish the results of the proposed work and Performing Agency shall provide an early draft of any presentation or manuscript or abstract disclosing such results for review by Receiving Agency prior to first public presentation or submission for publication, at least thirty (30) days in advance in the case of a presentation or manuscript, and at least seven (7) days in advance in the case of an abstract. At the request of Receiving Agency, Performing Agency shall delete any of Receiving Agency’s Confidential Information provided for under Article XII from such presentation, manuscript or abstract. If, during its review period, Receiving Agency notifies Performing Agency that the proposed disclosure reveals a potentially patentable invention, Performing Agency agrees to defer submission for publication, or, if practicable, presentation, for up to sixty (60) additional days, or until a patent application is filed, whichever occurs first. At the end of such seven, thirty or maximum six month period, as the case may be, Performing Agency shall be free to make such presentation or to submit such manuscript or abstract for publication at their discretion.
PUBLICATIONS AND COPYRIGHTS. The Medical College will be free to publish papers dealing with results of research under this Research Agreement, after giving a copy of the paper to FRS and allowing FRS to object to the disclosure of proprietary information, which information will not be disclosed for a period of ninety (90) days or until appropriate patent applications are filed whichever is sooner. FRS will be given full credit and acknowledgment for the support provided to the Medical College in any publication resulting from this research. Original research data will belong to the Medical College. Title to and the right to determine the disposition of any copyrights, or copyrightable material, first produced or composed in the performance of this research, shall remain with the Medical College, provided that the Medical College shall grant to FRS an irrevocable royalty free, non-exclusive right to reproduce, translate, and use all such copyrighted material for its own purposes.

University will not disclose Sponsor's confidential information without permission. Sponsor shall not have editorial rights over manuscripts or presentations, but may comment on implications of publication timing for multiple site studies or request deletion of Sponsor's confidential or proprietary information. If necessary to permit the preparation and filing of U.S. or other country patent applications, the Principal Investigator shall agree to an additional review period not to exceed sixty (60) days. Any further extension will require subsequent agreement between the Sponsor and the University. The Sponsor will be given full credit and acknowledgment for the support provided to the University in any publication resulting from this research. Title to, and the right to determine the disposition of, any copyrights, or copyrightable material, first produced or composed in the performance of this research, shall remain with the University. The University shall grant to the Sponsor an irrevocable, royalty-free, perpetual, unrestricted, non-exclusive right to reproduce, translate, prepare derivative works, distribute, and use all such research data (including any informational database into which such data is entered) and copyrighted material for its own purposes, including, but not limited to, submission to the United States Food and Drug Administration.
