Registering for the Service. 4.1. By opting into the Service, you confirm that you are least eighteen (18) years old and a registered and active M-PESA Subscriber for at least six (6) months immediately preceding the date of your application to register for the Service. We reserve the right to verify the authenticity and status of your M-PESA Account and transactions and may decline your application if we are not satisfied that you have met these minimum requirements. 4.2. You may register for the Service on more than one MSISDN provided that these terms and conditions will apply to each M-PESA Account that may be registered in your name. 4.3. Safaricom and NCBA may exchange any of your Personal Information held by them in respect of provision of any Safaricom or NCBA products and services including the M-PESA Service. Such Personal Information includes but is not restricted to your phone number, name, date of birth, ID or Passport Number and such other information that will enable us to identify you and comply with the regulatory “know your customer” requirements. 4.4. You also hereby agree and authorize us to use information relating to your use of the M-PESA service, M-Shwari Service, M-PESA System and other Safaricom products as we shall require for purposes of delivering the Services (“M-PESA Information”). 4.5. You may opt in to the Service solely by way of an electronic application made by you using your Equipment via the USSD or Safaricom App. 4.6. You hereby agree and authorize us to obtain and procure your Personal Information from the Government of Kenya’s repositories which, includes but is not limited to IPRS and you further agree and consent to the disclosure and provision of such Personal Information by the Government of Kenya to us. 4.7. You hereby further acknowledge and authorize us to verify your Personal Information in our custody against the information received from the Government of Kenya repositories (including but not limited to IPRS) in your respect. 4.8. We reserve the right to request further information from you pertaining to your application to register for the Service at any time. Failure to provide such information within the time we require may result in a decline of your application to register for the Service. 4.9. Our acceptance or decline of your application to register for the Service shall be communicated through an SMS sent to your Safaricom registered mobile phone number (MSISDN) associated with your M-PESA account and or Equipment. Registering for the Service. 3.1 To access the Service and become a user of the Service (“User”) you will need a FreemarketFX account (“Account”). To open an account, you must Sign up. You can do so by using the Sign up form on the Site at xxx.xxxxxxxxxxxxxxx.xxx. 3.2 You agree to provide true, accurate, current and complete information about your organisation (including your directors, beneficial owners and other officers, as relevant) as required by us when you apply for our Service (“Registration Data”) and maintain and promptly update the Registration Data to keep it true, accurate, current and complete throughout the duration of our agreement with you. 3.3 You are responsible and liable for all activities conducted through your Account. When we receive an instruction through the Account from you (including any User acting on your behalf), using your security information (as outlined in clause 5.2) we will deem such instruction as authorised by you. 3.4 To register for our Service, you must: 3.4.1 be an organisation; 3.4.2 be at least 18 years of age (if you are an individual registering on behalf of an organisation); 3.4.3 be capable of entering into legally binding contracts under the law applicable to your country of registration (where you are a Business Client); 3.4.4 only access the Site and use the Service when in a country that permits access to the Site and use of the Service; 3.4.5 use a valid business email address as your point of contact for registration; and 3.4.6 agree to comply with these Client Terms and Conditions. 3.5 Freemarket will notify you by email using the email address provided by you once your application has been accepted and from the date of such notification you may use the Service.

We confirm that you are now a Pokea Pay Limited customer. We reserve the right to verify the authenticity and status of your wiGO Pay Network Status and M-PESA Account and transactions and may decline your application if we are not satisfied that you have met these minimum requirements.
Registering for the Service. 4.1 You must provide us with an email address that you regularly use and intend to use regularly (i.e., no disposable email addresses) and/or a permanent mobile phone number that you intend to use for an extended period of time (i.e., no “burner” numbers). The following applies for mobile phone numbers before registering: · The number provided is a valid mobile phone number (e.g., phone number is not a landline, Voice over IP, or Google Voice). · The mobile phone number is active and in the member’s name or the member is associated with that account. · The mobile phone number is associated with a U.S. Mobile Network. · The mobile phone number is not an international number (e.g., does not have an international subscriber identification module (SIM) Card). 4.2 Once registered, you: i. Authorize us to withdraw funds from your designated account to send money to another User either at your initiation or when accepting a send money request sent by another User. You agree to maintain sufficient available funds in the same designated account for each transfer you request or respond to until the transfer is completed. Transfer requests will only be completed if sufficient funds exist; and ii. Authorize receipts of money sent to you or requested by you through the Service from other Users. Money sent to your email address or mobile phone number will be deposited to the USAA account you designate when you register for the Service. iii. Must send or receive money at least once in the last 18 months to avoid deactivation of your registered mobile phone number or email address. iv. Agree that you are responsible for the full amount of any transaction we credit to your funding account which is later reversed for any reason. You agree that we may withdraw the full amount, or any portion, of any reversed or disputed transaction, plus any applicable fees, from your funding account or from any other account you have with us, without prior notice to you. v. Authorize mobile phone numbers deactivated by the carrier to be deactivated from Send Money with Xxxxx.

Once registered, you may: i. authorize a debit of your account to send money to another User at your initiation or at the request of that User; and ii. receive money from another User at that User’s initiation or at your request, subject to the conditions of the Section below titled “Requesting Money.”

Receive money from another User either at that User’s initiation or at your request (contingent upon us making such request functionality available through the Service), subject to the conditions of the Sections below titled “Requesting Money” and “Future Functionality.”
