Common use of Rest Periods and Meal Breaks Clause in Contracts

Rest Periods and Meal Breaks. ‌ (a) All employees shall have two 15-minute rest periods and one, one-half hour meal break in each work period in excess of six hours, one rest period to be granted before and one after the meal break, provided the staff to child ratio can be maintained. It is understood that meal breaks and rest periods may be combined subject to operational requirements. Rest periods shall be taken without loss of pay to the employee. (b) Employees working a shift of four hours, but not more than six hours, shall receive one 15-minute rest period during such a shift provided the staff to child ratio can be maintained. Rest periods shall be taken without loss of pay to the employee. (c) An employee shall be entitled to take their rest periods and meal breaks away from the worksite. Where the Employer determines that the meal period cannot be taken away from the worksite, the meal period shall be considered as time worked at straight-time, including the accrual of all benefits of the collective agreement.
