CYCLONE PROCEDURE.
(1) If the Company Stands Down an Employee because of the threat of a cyclone, the Employee shall be paid for the Project Working Hours occurring during the Cyclone Stand Down Period but only if:
(a) at the commencement of the Cyclone Warning Period, the Employee reports for work and continues to work as directed until released by the Company at the commencement of the Cyclone Stand Down period;
(b) following the "all-clear" the Employee resumes duty in accordance with the Company's direction; and
(c) during the Cyclone Stand Down Period, the Employee is ready, willing and available to present for work if requested to do so by the Company.
(2) Notwithstanding the provisions of this subclause, an Employee who prior to the Cyclone Stand Down Period has commenced an Additional Overtime shift shall be paid what would have been earned on that shift but for the Cyclone Stand Down.
(3) Employees must remain ready, willing and available to perform cyclone preparation work and to return to work if requested by the Company during the Cyclone Stand Down Period. If an Employee is not ready, willing and available to perform work as requested by the Company prior to and during the Cyclone Stand Down Period, that Employee shall not be entitled to pay for that day.
(4) An Employee who is required to remain at work or who is called out to work during the Cyclone Stand Down Period shall be paid for all time worked at penalty rates but not so as to exceed a maximum of double time, unless the day concerned is a public holiday in which event the maximum payment, subject to other provisions of this Agreement, shall not exceed 2.5 times their Ordinary Hourly Rate.
(5) If an Employee is temporarily demobilised from the Karratha region because of cyclone conditions or associated with cyclone conditions and is requested to hold themselves in readiness, the Employee shall be paid 7.2 hours per day at their all purpose rate for ordinary time they would have worked, up to 36 hours.
(6) If an Employees mobilisation to site is delayed because of cyclone conditions or associated to the cyclone conditions and the Employee remains available for mobilisation, the Employee shall be paid 7 .2 hours per day at their all-purpose rate for ordinary time they would have worked, up to
CYCLONE PROCEDURE a) The following shall apply when, because of a cyclone, the company stands down employees employed under this Agreement.
b) Each employee who:
i. At the commencement of the cyclone period reports for and remains at work until otherwise directed by the company;
ii. And following the "all clear" resumes duty in accordance with the direction of the company; shall be paid for the normal rostered ordinary time and overtime hours occurring during the stand down.
iii. Notwithstanding the provisions of this subclause, an employee who prior to the stand down due to a cyclone has commenced an overtime shift shall be paid what would have been earned on that shift but for the stand down.
c) An employee who, on any day during the cyclone stand down is required for work and is requested to do so by the company and is not willing or available to work when so requested is not entitled to pay for that day.
d) An employee who is required to remain at or who is called out to work during the period of time in which the operation has been stood down during a cyclone shall be paid for all time worked at single time in addition to the rate he/she would have received other than for the cyclone.
e) After the "all clear" has been given each employee shall be notified by the company of: • the time at which normal operations are to resume; and • the time at which employees are to resume work; and an employee who does not present for work at the time required by the company is in respect of that day, entitled to payment for time worked only.
CYCLONE PROCEDURE. The Pyrenees Installation Offshore Construction Project is in an area that is prone to cyclones. In the event that the Project is impacted by the effects of a cyclone, the following provisions shall apply.
11.1 If an employee’s mobilisation is delayed and the employee is placed on standby then payment shall be in accordance with Clause 10.3 provided that the employee remains available for mobilisation and mobilises as soon as advised by the Company;
11.2 If an employee remains on the offshore facility but is unable to work, then the employee shall be paid as if actually working the scheduled offshore roster;
11.3 If an employee is evacuated from the offshore facility to a shore based location, but not demobilised to the capital city airport closest to their residence, then the employee will be paid as if actually working the scheduled roster; and will be provided with accommodation and meals during the time the employee is to remain on standby.
11.4 If an employee is demobilised to the capital city airport closest to their residence prior to the expected completion of the period of scheduled offshore duty the employee, if no longer required, will be terminated. However, in the event that the employee will be required to remobilise for further duty offshore, then the employee shall be advised of such and will be paid in accordance with Clause 10.3 for each day on standby. In the event that an employee leaves the offshore facility prior to the completion of the employee’s rostered shift, the employee will be paid for the hours actually worked and the appropriate travel allowance prescribed in subclause 12.4. Employees will be advised of which situation is applicable at the time.
CYCLONE PROCEDURE. 37.1 This clause shall apply when, due to a cyclone, the Employer stands down Employees employed under this Agreement.
37.2 Each Employee who:
37.2.1 at the commencement of the cyclone period reports for and remains at work until otherwise directed by the Employer; and
37.2.2 following the 'all clear' resumes duty in accordance with the direction of the Employer, shall be paid at the appropriate Base Rate of Pay during the stand down.
37.3 An Employee who commenced working additional hours prior to the stand down due to a cyclone will be paid what they would have earned on that shift but for the stand down.
37.4 An Employee who, on any day during the cyclone stand down:
37.4.1 is required for work and is requested to do so by his/her Employer; and
37.4.2 is not willing or available to work when so requested, is not entitled to pay for that day.
37.5 An Employee who is required to remain at, or who is called out to, work during the period of time in which the operation has been stood down during a cyclone shall be paid for all time worked at single time in addition to the rate the Employee would have received other than for the cyclone.
37.6 After the 'all clear' has been given, each Employee shall be notified by the Employer of:
37.6.1 the time at which normal operations are to resume; and
CYCLONE PROCEDURE. 6.1 Where, under the direction of the Company, work Employees are performing under this Schedule is interrupted due to a cyclone the Employees shall be paid 8 hours at the applicable Hourly Rate of Pay for Ordinary Hours for each Rostered Working Day for the period of the interruption providing they remain ready, willing and able to be mobilised, when directed, by the Company, to the Company’s nominated transport supplier in Perth within 6 hours of notification.
6.2 Where an Employee is already mobilised to the Work Site and required to remain at work or if they have been called out to work during the period of time during which the operation has been stood down during a cyclone the Employee shall be paid for their normal Rostered Hours of Work the Employee would have received other than for the cyclone.
6.3 An Employee’s failure to comply with this clause may result in disciplinary action up to and including termination of employment.
CYCLONE PROCEDURE. 6.3.1 The following shall apply when, because of a cyclone, the Company stands down employees employed under this Agreement.
6.3.1.1 Each employee who:
6.3.1.1.1 at the commencement of the cyclone period reports for and remains at work until otherwise directed by the Company;
6.3.1.1.2 and following the “all clear” resumes duty in accordance with the direction of the Company;
6.3.1.1.3 shall be paid 7.2 hours at the ordinary rate of pay, up to a maximum 36 ordinary for holding themselves in readiness for work during the stand down.
6.3.2 After the “all clear” has been given each employee shall be notified by the Company of:
6.3.2.1 The time at which normal operations are to resume;
6.3.2.2 And the time at which employees are to resume work;
6.3.2.3 And an employee who does not present for work at the time required by the Company is in respect of that day, is entitled to payment for time worked only.
6.3.3 The notification maybe directly to the employee by a Company representative or by special announcement broadcast by radio and/or television.
6.3.4 Where, on the day following the resumption of normal operations or on any subsequent day an employee cannot, because of damage caused to the operations by the cyclone be usefully employed, the Company may stand the employee down without pay.
6.3.5 The above provisions do not prevent the Company from terminating the employment of an employee due to the inability to provide useful work as a result of a cyclone.
CYCLONE PROCEDURE. 7.1 Where, under the direction of the Company, work Employees are performing under this Schedule is interrupted due to a cyclone the Employees shall be paid 8 hours at the applicable Hourly Rate of Pay for Ordinary Hours for each Rostered Working Day for the period of the interruption providing they remain ready, willing and able to be mobilised, when directed, by the Company to the Company’s nominated transport supplier in Perth within 6 hours of notification.
7.2 Where an Employee is already mobilised to the Work Site and required to remain at work or if they have been called out to work during the period of time during which the operation has been stood down during a cyclone the Employees shall be paid for their normal Rostered Hours or Work which the Employee would have received other than for the cyclone.
7.3 Where an Employee returns to their Assembly Point or has not mobilised, such Employee shall not be entitled to receive an Offshore Allowance provided for in clause 5 of this Schedule.
7.4 An Employee’s failure to comply with this clause may result in disciplinary action up to and including termination of employment.
CYCLONE PROCEDURE. The following procedure shall apply if the Company stands down an Employee because of a cyclone (‘cyclone stand down’).
46.1 An Employee shall be paid for his or her normal rostered shift (including ordinary and overtime hours) during a cyclone stand down if:
(a) At the commencement of the cyclone period the Employee reports for and remains at work until otherwise directed by the Company; and
(b) Following the ‘all clear’ the Employee resumes duty in accordance with the Company’s direction.
46.2 If the Employee had commenced an overtime shift prior to the cyclone stand down, the Employee shall be paid what they would have earned on that shift but for the stand down.
46.3 If the Employee, at any point during the cyclone stand down:
CYCLONE PROCEDURE. The following shall apply when the employer stands down an employee due to a cyclone alert during the employee’s rostered work cycle. This entitlement does not apply to a casual employee. Each permanent employee who:
36.2.1. at the commencement of the cyclone alert period reports for and remains at work until otherwise directed by the employer; and
36.2.2. following the “all clear” resumes duty in accordance with the direction of the employer, shall for each rostered shift occurring during the cyclone alert period be paid for ordinary hours per rostered shift occurring during each day of the stand down up to a maximum of thirty-two (32) ordinary hours' pay. Such hours are to be paid at the employee’s ordinary rate. After the “all clear” has been given the employee shall be notified by the employer of:
36.3.1. the time at which normal operations are to resume; and
36.3.2. the time at which employees are to resume work, and an employee who does not present for work at the time required by the employer, is not entitled to payment for the stand down period. Where, on the day following the resumption of normal operations or on any subsequent day, an employee cannot, because of damage caused to the operations by cyclone, be usefully employed for a period over one day the stand down clause may be applied by the employer. Distant workers under clause 15 who are transported from site to their point of hire during a rostered cycle or shift due to the safety precautions of a cyclone, the stand down clause may be applied by the employer. Distant workers under clause 15 who are prevented returning to site to start a rostered cycle or shift due to the safety precautions of a cyclone, the stand down clause may be applied by the employer.
CYCLONE PROCEDURE. Where, under the directions of the Company, the On Duty Period for an Employee is interrupted due to a cyclone, the Employee shall continue to be paid 12 hours per day at the Flat Hourly Rate of Pay, in accordance with the Employee's Work Cycle for the period of the interruption, provided the Employee is ready, willing, and able to remobilise or mobilise when directed to do so, If the Employee continues to work on the Facility longer than the Employees rostered Work Cycle the employee will be paid Overcycle Rates.
