Review of Field Conditions. The Contractor shall take field measurements and verify field conditions and carefully compare such with the Contract Documents before commencing the Work. Errors, omissions or inconsistencies discovered shall be reported to the Architect at once. The Contractor and each Subcontractor shall evaluate and satisfy themselves as to the conditions and limitations under which the Work is to be performed, including, without limitation (1) the location, condition, layout and nature of the Project site and surrounding areas, (2) generally prevailing climatic conditions, (3) anticipated labor supply and costs, (4) availability and cost of materials (except for unforeseeable serious material shortages), tools and equipment, (5) availability of temporary utility service and (6) other similar issues. The Owner assumes no responsibility or liability for the physical condition or safety of the Project site or any improvements located on the Project site. Except as set forth in subparagraph 10.1.2, the Contractor shall be solely responsible for providing a safe workplace. The Owner shall not be required to make any adjustment in either the Contract Sum or Contract Time in connection with any failure by the Contractor of any Subcontractor to comply with the requirements of this Subparagraph.

Review of Field Conditions. By executing this Agreement, Contractor represents that Contractor and all Subcontractors and sub-subcontractors have visited the Work Site, familiarized themselves and investigated all local conditions of the area where Work is to be performed, such as local weather, labor Agreement, codes and zoning ordinances, traffic restrictions, utility company regulations, noise and vibration limitations, trash dump site availability, and other site conditions, as applicable to the Work, correlated personal observations with requirements of this Agreement and have accounted for all such conditions in Contractor’s bid. If Contractor performs any activity or Work in violation of applicable laws, Contractor shall assume responsibility for such performance and shall bear costs for correction to the satisfaction of Broward Health. Additionally, Contractor is required to verify that the portions of this Agreement prepared by Contractor or any of its Subcontractors that are performing design-build services comply with applicable laws and shall promptly report to Broward Health in writing any nonconformity discovered by or made known to Contractor as a request for information in such form as Broward Health may require. If Contractor fails to perform such obligations, Contractor shall not be entitled to an extension of time or additional compensation on account of differences between this Agreement and existing conditions and shall pay and be responsible for (without reimbursement by Broward Health) such costs and damages to Broward Health as would have been avoided if Contractor had performed such obligations.
