Right to Reopen. Based on official action by the Board of Directors of TEA or the Governing Board of TUSD and upon written notice of said action, either party reserves the right to reopen negotiations of this article or any part thereof, under circumstances where the District or the Association deem it necessary to do so to facilitate the assertion of a legal position.
Right to Reopen. If any court of competent jurisdiction rules that compensation limitations imposed by state law have no effect, and/or provides increased flexibility to the local school district to allow additional compensation for their employees, then the Association shall have the right to reopen negotiations on salary, hourly rates, stipend, and benefit provisions contained herein. This right to reopen shall be available to the Association in the event that legislative actions provide increased flexibility to local school districts to allow additional compensation for their employees. Pending the outcome of such negotiations, salaries shall continue to be paid in accordance with the provisions above. Any additional increase or decrease in salaries resulting from such reopened negotiations shall be applied retroactively to the beginning of the employment year.

A 1. MBUs shall be credited with a total of twelve (12) days of sick leave at the beginning of a school year. For MBUs on extended contract, leave shall be increased according to the additional percentage of the school year worked. For part-time MBUs, leave shall be prorated according to the percentage of the school year worked based on a 7.5 hour day.
Right to Reopen. The City reserves the right to make changes in the plan or coverage that is reasonably required for implementation of the Affordable Care Act, or any other state or federal law or regulation.
Right to Reopen. The lawful provisions of the Agreement are binding upon the parties thereof. The Association shall have the right to reopen negotiations on any change by the District to working conditions not covered by the contract language.
Right to Reopen. Article 7 Mid-Term Reopener
A. At least 30 but not more than 60 calendar days before the end of the 18th month and before the end of the 36th month of this Agreement, the moving Party may serve the other Party with written notice of its intent to reopen negotiations, citing the specific article(s) it wishes to renegotiate and providing a brief explanation of its interests underlying the renegotiation of those articles. The moving Party may reopen up to four (4) articles.
B. The other Party is then free, if it wishes, to reopen four (4) additional articles and shall notify the moving Party in writing within 15 business days of receiving the notice described in 7.1A above. If so, the Party shall specify which article(s), if any, it chooses to reopen, and provide a brief explanation of its interests underlying the re-negotiation of those articles.
C. Until agreement is reached in accordance with the terms of this provision, the current provisions of the Agreement shall remain in full force and effect.
Right to Reopen a. If under applicable Massachusetts law the terms of this Agreement are determined to any extent to be illegal, otherwise invalid, or incapable of being enforced, which unenforceability would materially and adversely affect the economic substance of the transactions contemplated by this Agreement, the Town and the Company shall negotiate in good faith amendments to this Agreement so as to result in neutral economic impact to either the Town or the Company.
b. In the event that the Company enters into a host community agreement or other similar agreement with another municipality in the Commonwealth of Massachusetts that contains financial terms more beneficial to such municipality than this Agreement provides to the Town, taking into consideration the marketplace, number of other operating recreational or medical marijuana facilities in the municipality as compared to the Town, the Company agrees to reopen this Agreement and negotiate an amendment resulting in financial benefits to the Town equivalent or superior to those provided to the other municipality.
Right to Reopen. In the event the Division negotiates an enhancement to any benefit contained herein for Members of the Division not represented by the PBA, the parties agree to reopen negotiations and make any necessary modifications to the terms of this MOA.
