Rights and Obligations of the Principal. 4.1 The principal as controller shall be obliged to ensure compliance with data protection regulations according to the GDPR and other relevant rules with regard to data protection. The principal shall be obliged in particular to respect the principles relating to the processing of personal data pursuant to Art 5 GDPR and to guarantee the rights of the data subject, especially pursuant to Art 12 – 22 GDPR.
4.2 The principal has the right to give instructions to the agent according to Art 28 para 3 lit a and Art 29 GDPR. The principal shall give the instructions in written form.
4.3 The principal shall be entitled to demand compliance from the agent with regard to the technical and organisational safety measures to be taken by the agent under the GDPR within the meaning of clause 6 by submission of appropriate evidence.

3.1.1. The Principal shall be entitled to exercise control over the Agent’s activities as to the fulfillment of his agency functions and authorities stipulated in the present Agreement.
3.1.2. The Principal shall be entitled to give binding instructions to the Agent, related to the conditions of fulfillment of obligations being the subject of the present Agreement.
3.1.3. According to the terms and conditions of the present Agreement, the Principal shall be entitled to request and obtain the Agent’s detailed report on fulfillment of the Agent’s obligations assigned to him for the fulfillment of the present Agreement.
3.1.4. The Principal shall be entitled to conclude agency agreements with any other persons without any limitations, at the Principal’s discretion and on the Principal’s terms.
3.1.5. The Principal shall be entitled to carry out activities similar to the Agent’s Activities hereunder in any place and within any territory individually and without any limitations.
3.1.6. The Principal shall be entitled to expect that the Agent will conscientiously fulfill all terms of the present Agreement upon the most favorable for the Principal terms and in due time.
3.1.7. The Principal shall be entitled to dispose at the Principal’s discretion and on the Principal’s own account of all and any information obtained by the Agent during the execution of the present Agreement.
3.1.8. The Principal shall be entitled to obtain an accurate and detailed report from the Agent within the time limits prescribed by the present Agreement.
3.1.9. The Principal shall be entitled to render informational support and other assistance to the Agent during the execution of the present Agreement, which includes representation of the Agent on the official website of the Principal and in other accessible information sources.
3.1.10. The Principal shall be entitled to establish Customer relationships in an appropriate for the Principal way, which includes refusal to open an account, to accept orders, closure of account within the scope of the agreement concluded with the Customer, as well as to change any terms and conditions of the present Agreement informing the Agent with due advance.

Rights and Obligations of the Principal. 3.2.1 The Principal is obligated to promptly accept the Agent's reports, all the documents provided thereby and everything performed thereby in accordance with the Agreement. 3. The Principal shall help the Candidate in developing specific skills including language skills for acquiring work experience.
4. The Principal shall contribute to the development of a pool of well-qualified, open-minded and internationally experienced young people as future professionals.
5. The Principal shall provide quality learning experience and facilities to the Candidates.
6. The Principal will not be liable to get the Candidate placed in a Company of the Candidates choice.
7. That upon successful completion of the Classroom training and submission of all assignment & completion of Exams, then, the Principal shall absorb the Candidate in its own Organisation as Intern and provide a stipend of Rs 20,000 PM to Candidate for maximum 6 (Six) Months.
8. The Principal shall organize Candidates Interview with various organizations for their gainful employment.
9. The Principal shall not be responsible to provide any special classes / sessions in case the Candidate fails to attend the scheduled classes / sessions.
10. The Principal shall put its best efforts to ensure that placement of the Candidate is for a Gross Salary package (including Boarding/Lodging/Travelling etc) of at least Rs. 30,000/- (Rupees Thirty thousand) per month, if the Candidate gets placed in a Company situated in India, or; at least Rs 85,000/- (Rupees eighty-five thousand) per month in case of placement in a Company situated outside India.
11. The Principal’s liability shall cease to exist when the Candidate gets placed during the 6-month stipendiary period.
12. The Principal shall absorb the candidate after 6 months of paid internship, if the candidate fails to get any job from various employers.
Rights and Obligations of the Principal. (1) The Principal is solely responsible for assessing the permissibility of the commissioned processing as well as for safeguarding the rights of those affected.
(2) The Principal shall document the issue of all orders, partial orders or instructions. In urgent cases, instructions may be given orally. The Principal shall confirm such instructions in documented form without delay.
(3) The Principal shall inform the Contractor without delay of he detects errors or irregularities during the inspection of the results of the order.
(4) To a reasonable extent, the Principal is entitled to monitor the adherence to regulations governing data protection and the contractual agreements at the Contractor’s premises himself or through third parties, in particular by gathering information and inspection of the stored data and the data processing programs as well through other on-site examinations. The person entrusted with monitoring shall be granted access and viewing rights to the extent required. The Contractor is obliged to provide the necessary information, demonstrate processes and maintain records as necessary to conduct an inspection.
(5) Inspections at the Contractor’s premises shall take place without any avoidable disruptions to the operation of his business. Unless otherwise indicated by urgent reasons to be documented by the Principal, inspections shall take place after appropriate advance notice has been given and during the Contractor’s business hours and not more often than every 12 months. Provided the Contractor provides proof that the agreed data protection obligations have been implemented, as provided for under Chapter 5 (8) of this Agreement, an inspection shall be limited to random samples.
Rights and Obligations of the Principal. Since this Agreement is being concluded on a non-exclusive basis, the Prin- cipal may at any time engage other agents within the territory of Switzerland with similar sales and marketing services and activities.
