Rights of Authority. This JPA Amendment shall not be interpreted as limiting or restricting the rights of Authority under the Authority JPA. Nothing in this JPA Amendment is intended to alter or modify Authority Transportation Uniform Mitigation Fee (TUMF) Program, the PACE Program administered by Authority within the jurisdictions of its Regular Members, or any other programs administered now or in the future by Authority, all as currently structured or subsequently amended.
Rights of Authority. 7.2.1 In addition to the other rights as specified elsewhere in this Contract, the Authority shall:
a. have the right to direct Operator to provide additional Bus Service that in the opinion of the Authority are emergency situations;
b. have the right to adjust Fleet Deployment Plan;
c. have the right to levy Damages and/ or Penalty as provided in this Contract and in the event the Operator fails to make payments of such Penalty within 7 (seven) days of receipt of written notification from the Authority in this regard, the Authority shall have the right to deduct the amount in question from the payment of the O&M Fee and/ or appropriate the same from the Performance Security of the Operator;
d. have the right to issue operating instructions or any other advisory instruction/s as deemed necessary to maintain highest standards of Bus Service including safety, functionality and operationality of the Bus Service.
Rights of Authority i. If in the reasonable opinion of the Authority, the Concessionaire is in material breach of its obligations under this Agreement, the Authority may, without prejudice to any of its rights under this Agreement including Termination thereof, by notice require the Concessionaire to take reasonable measures for the fulfilling its obligations under this Agreement.
ii. In the event that the Concessionaire, upon notice as per 7.1(d) (i) above fails to take reasonable measures for the fulfilling its obligations under this Agreement do make good the material 8To be retained as applicable. breach within a reasonable period, the Authority may take over the performance of any or all the obligations of the Concessionaire to the extent deemed necessary by it; provided that such taking over by the Authority shall be of no greater scope and of no longer duration than is reasonably required. Provided further that any costs and expenses incurred by the Authority in discharge of its obligations hereunder shall be deemed to be O&M Expenses, and the Authority shall be entitled to recover them from the Concessionaire in accordance with the provisions of this Agreement along with the Damages specified therein.
Rights of Authority. If (i) the Lessee shall fail or neglect to commence the diligent Restoration of the LMM Airport Facility or the portion thereof so damaged or destroyed, (ii) having so commenced such Restoration, the Lessee shall fail to diligently complete the same in accordance with the terms of this Agreement or (iii) prior to the completion of any such Restoration by the Lessee, this Agreement shall expire or be terminated in accordance with the terms of this Agreement, the Authority may, but shall not be required to, complete such Restoration at the Lessee’s expense and shall be entitled to be paid out of the Restoration Funds for the relevant Restoration costs incurred by the Authority. In any case where this Agreement shall expire or be terminated prior to the completion of the Restoration, the Lessee shall (A) account to the Authority for all amounts spent in connection with any Restoration which was undertaken, (B) immediately pay over or cause the Depositary to pay over to the Authority the remainder, if any, of the Restoration Funds received by the Lessee prior to such termination or cancellation and (C) pay over or cause the Depositary to pay over to the Authority, within 30 days after receipt thereof, any Restoration Funds received by the Lessee or the Depositary subsequent to such termination or cancellation. The Lessee’s obligations under this Section 13.3(b) shall survive the expiration or termination of this Agreement. To the extent the Authority is a loss payee with respect to any such insurance proceeds or otherwise receives insurance proceeds with respect to the destroyed or damaged portions of the LMM Airport Facility, the Authority shall deposit (or cause to be deposited) all such insurance proceeds with the Depositary for application pursuant to this Agreement.
Rights of Authority. The SFWGA will assign a Contest Director to the event. The Contest Director will have full authority of all activity in and around the contest areas for the duration of the event. Contest areas include the gymnasium, staging area, access doors and foyers, and warm up areas. Designated event time begins one hour prior to the first scheduled performance of any participant (color guard, percussion, solo, or exhibition) and ends one hour after the conclusion of the last performance of any participant. No activities, solicitations, announcements, banners, ad hoc performances, or changes to traffic flow, seating, or facilities may occur without the prior written consent of the Contest Director. The Florida Federation of Judges Association will assign a Chief Judge to the event. The Chief Judge will have full authority over all judging aspects of the competition, including scores, Judges’ seating areas, dinner and break times, and the scheduling of Critique.
Rights of Authority. As a party to this Declaration, Authority is entitled to the following rights:
a. Authority has the right, but not the obligation, to enforce all of the provisions of this Declaration.
b. Any amendment to the Declaration shall reqmre the written consent of Authority.
c. This Declaration does not in any way infringe on the right or duties of the City of Riverside to enforce any of the provisions of the City of Riverside Municipal Code including, but not limited to, the abatement of dangerous buildings.

(i) If in the reasonable opinion of the Authority, the Concessionaire is in material breach of its obligations under this Agreement for Operations & Maintenance of Domestic Cruise Terminal , the Authority may, without prejudice to any of its rights under this Agreement including Termination thereof, by notice require the Concessionaire to take reasonable measures for the operation & maintenance of Domestic Cruise Terminal .
(ii) In the event that the Concessionaire, upon notice as per 7.1(d) (i) above fails to handle domestic cruise terminal as per Agreement within a reasonable period, the Authority may take over the performance of any or all the obligations of the Concessionaire to the extent deemed necessary by it for handling of domestic cruise terminal at the berth; provided that such taking over by the Authority shall be of no greater scope and of no longer duration than is reasonably required.
