Roof and Walls. Landlord shall have the exclusive right to use all or any part of the side and rear walls of the Premises and the roof for any purpose, including but not limited to erecting signs or other structures on or over all or any part of the same, erecting scaffolds and other aids to the construction and installation of the same, and installing, maintaining, using, repairing and replacing pipes, ducts, conduits and wires leading through, to or from the Premises and serving other parts of the Center in locations which do not materially interfere with Xxxxxx’s use of the Premises. Tenant shall have no right whatsoever in the exterior of exterior walls of the Premises or the roof or any portion of the Center outside the Premises, except as provided in Exhibit “B” hereof.

Landlord shall have the exclusive right to use all or any part of the roof of the Building for any purpose; to erect other structures over all of any part of the Building; and to erect in connection with the construction thereof temporary scaffolds and other aids to construction on the exterior of the Demised Premises, provided that access to the Demised Premises shall not be denied.

Landlord shall have the exclusive right to use any part of the roof of the Premises for any purpose; to erect additional stories or other structures over all or any part of the Premises; to erect temporary scaffolds and other aids to construction on the exterior of the Premises, provided that access to the Premises shall not be denied; and to install, maintain, use, repair and replace within the Premises pipes, ducts, conduits, wires and all other mechanical equipment serving other parts of Landlord's Property, the same to be in locations within the Premises as will not unreasonably deny Tenant's use thereof. Landlord may make any use it desires of the side or rear walls of the Premises or other structural elements of the Premises (including, without limitation, free-standing columns and footings for all columns), provided that such use shall not encroach on the interior of the Premises unless (a) all work 15 carried on by Landlord with respect to such encroachment shall be done during hours when the Premises are not open for business and otherwise shall be carried out in such a manner as not to unreasonably interfere with Tenant's operations in the Premises, (b) Landlord, at its expense, shall provide any security services to the Premises required by such work, and (c) Landlord, at its expense, shall repair all damage to the Premises resulting from such work. Landlord agrees that any such uses contemplated hereunder shall not decrease the size of the Premises nor materially interfere with Tenant's use of or access to the Premises from the Common Areas immediately in front of and adjacent to the Premises, and any such pipes or conduits shall be concealed along the walls and ceilings of the Premises.

Landlord, except as provided herein to the contrary, shall have the exclusive right to use all or any part of the roof or exterior walls and area beneath the floor of the Premises for any purpose, including, but not limited to: erecting signs or other structures on or over all or any part of the same; erecting scaffolds and other aids to the construction, maintenance and installation of the same; and in installing, maintaining, using, repairing and replacing pipes, ducts, conduits and wires and all other mechanical equipment leading through, to or from the Premises and serving other parts of the Project in locations which do not materially interfere with Tenant's use of the Premises. Notwithstanding the terms of this paragraph to the contrary, Landlord agrees to use its good faith efforts to perform any work done by it pursuant to the foregoing, above Tenant's finished ceiling, below the floor or in the demising walls. Any such work shall be done on reasonable prior written notice to Tenant and Landlord agrees to use its good faith efforts to perform such work in such a manner as to minimize any interference with the conduct of Tenant's business in the Premises. In the event the performance of such work exceeds two (2) business days and the performance of same requires Tenant to cease the conduct of its business on a day where it would otherwise be operating, then beginning on the third date of such cessation until the earlier of the completion of such work or the date Tenant reopens for business, Base Rent, Additional Rent and all other charges due and payable by Tenant hereunder shall xxxxx. Landlord agrees that scaffolding erected either on the exterior or interior of the Building of which the Premises form a part might constitute a material interference with Tenant's operation, and Landlord agrees that it will exercise its good faith efforts to limit, from time to time, the existence of scaffolding, which constitutes such material interference, to no more than a consecutive thirty day period.

Tenant agrees to give Landlord access to the Premises for the purposes of this Section 9.6.
