Scope of the warranty. In case of a warranty claim, Seller shall at the sole discretion of Buyer (i) repair the defective goods and/or services at Seller’s own costs, (ii) replace the defective goods and/or services or parts thereof at Seller’s own costs or (iii) reimburse to Buyer the costs of a repair or replacement of defective goods or parts thereof in the case that Buyer choses to conduct the repair and/or replacement by himself or by a third party authorized by Buyer. The parties agree that in the event where the return of the defective goods is not feasible, Buyer shall promptly submit evidence of the defective goods to Seller. The acceptance of the evidence provided by Buyer shall suffice to accept the warranty claim and from Seller shall entail recognition of liability for the defect. In the case of a repair or replacement of defective goods and/or services by the Seller, the Seller shall directly bear all related costs, including but not limited to travel, transport, taxes, fees and charges. In the case of a repair or replacement by the Buyer or a third party authorized by the Buyer, the Seller shall reimburse Buyer all direct and indirect costs incurred thereby, including but not limited to time and material spent, third party charges, travel, transport, taxes, fees and other charges required to replace or repair the defective product or parts thereof.

Subject to the terms of this Warranty, including the specific requirements of Section 1 above, in case of a successful Ransomware attack on CUSTOMER Endpoints covered by the Warranty, as shown in SentinelOne’s logs and other records, SentinelOne will remediate as sole and exclusive remedy to the CUSTOMER, damages equal to the Xxxxxx demanded by the Ransomware, capped at $1,000 USD per Endpoint affected by a Breach, and further capped at $1,000,000 USD for every consecutive 12 months in which CUSTOMER subscribes to the Solution with respect to the affected Endpoint.

Scope of the warranty. Jabiru Aircraft Pty Ltd. (“JABIRU”) warrants that its new and unused engine has no defects in material and/or workmanship for the period and under the conditions described in this Warranty. The owner of the engine agrees that the terms and conditions of this Warranty are exclusive and expressly disclosed, and that the owner accepted them at the time of purchase of the engine.
Scope of the warranty. Unless otherwise agreed in Appendix 7, the warranty period shall be one (1) year for software and two (2) years for equipment after the delivery date, cf. clause 2.5.3. Contingent upon normal, diligent use on the part of the Customer, the Contractor shall, at no additional cost, rectify errors and defects, replace defect parts of equipment and rectify errors in software governed by this Agreement and which the Customer has complained about before the expiry of the warranty period. No damages or other remedies for breach of contract may be claimed for defects that are rectified pursuant to the warranty. Appendix 2 may specify detailed requirements for the maintenance of equipment that must be performed for the warranty to remain valid.
Scope of the warranty. 1.1 The Supplier bears full responsibility for adherence to agreed quality standards for the products. It shall be for the Supplier to ensure an unlimited quality assurance for the products, including a comprehensive inspection of the products. The Supplier warrants that the products are fault-free and comply with the agreed specifications and with recognized engineering practice.
2.1 Warranty payments shall be settled on the basis of an itemized statement of all costs arising for voestalpine and its customers in relation to the defective product. This shall include both costs incurred externally to voestalpine as well as costs internal to voestalpine.

Scope of the warranty. 10.1 The Supplier shall promptly rework, remedy or replace defects, or rectify any breach of the warranties in this Contract, at its sole expense. Such costs include but are not limited to materials, supplies, packaging, transportation, delivery, installation, assembly, dismantling and return of replacement Goods and non-conforming Goods (as the case may be).
10.2 Should defects with the same cause of fault frequently occurring (serial defects), Supplier shall promptly undertake to provide faultless parts for the series/batch of Goods, including any remedy and rectifications and subsequent delivery in accordance with clause 10.1 at the shortest possible notice. Supplier shall be liable for any damage control measures, especially for a pre- emptive exchange of Goods (in whole or parts thereof) if the required exchange is due to defects of the Goods manufactured and/or delivered by Supplier. In this case, the Supplier- shall bear all costs and expenses, including the costs for Goods recall in accordance with clause 10.1.
10.3 The warranty period of the Goods shall be thirty- six (36) months after passing of the risk of the Goods or replacement Goods (as the case may be) from Supplier to Ordering Party unless agreed otherwise in writing between the Parties.
