Common use of Seniority of Employees Who Transfer Outside of the Bargaining Unit Clause in Contracts

Seniority of Employees Who Transfer Outside of the Bargaining Unit. Except as provided for in this Section, employees who transfer outside of the bargaining unit shall not have seniority. It is understood, however, that an employee within the bargaining unit may be promoted to a position outside the bargaining unit, including a management position. Such employee shall continue to retain the seniority the employee had prior to leaving the unit, but shall not accumulate any seniority while out of the bargaining unit, except as provided below. If, in the discretion of the Prosecutor, such employee is returned to the bargaining unit, the employee shall be placed in a job where the employee's seniority will allow. Discharge of said employee while the employee is outside the bargaining unit shall automatically cancel all seniority and since the employee is outside of the bargaining unit and is not covered by this Agreement, the employee's discharge shall not be subject to the grievance procedure. Employees who may be promoted in accordance with the provisions of this Section shall, for the first fifteen (15) days, accumulate seniority in their classification. It is further understood that such employee may request return to the employee's former classification within fifteen (15) days without loss of seniority in said classification and notwithstanding the provisions of any prior agreement.
