Shipping Dates. Shipping dates quoted represent a reasonable estimate of the time required for manufacturing at the time of order acceptance or quotation. These dates will not be construed as promises or contractual agreements to ship or deliver goods unless specifically agreed to in writing.

Shipping Dates. Palm may ship before the scheduled shipment date, but not to arrive earlier than OEM Partner's requested delivery date. Palm will promptly notify OEM Partner if any order or part of an order cannot be filled or if there will be any delays in delivery. Palm will use all reasonable efforts to ship on indicated dates but will not be liable for failure to do so. If Palm fails to ship on the scheduled ship date, OEM Partner may reschedule without charge.
Shipping Dates. 4.1 NeoPhotonics will use commercially reasonable efforts to meet any shipping date(s) indicated in the quotation; provided however, that NeoPhotonics will not be liable under any circumstances for its failure to meet such shipping date(s). Any shipping dates provided by NeoPhotonics to Buyer are best estimates only.
Shipping Dates. The ship date will be stated by Av-DEC in the purchase order confirmation according to Av-DEC's best estimate, but will not be binding on Av-DEC. Av-DEC will notify Buyer as soon as reasonably possible if Av-DEC anticipates a shipment date materially different than specified in the purchase order to enable the best possible delivery alternative to be determined. If such delay is caused by Av-DEC, Av-DEC will provide a revised shipment date confirmation upon written request from Buyer. A delay in shipment or delivery will not entitle Buyer to cancel, unless shipment has not commenced within thirty (30) days from the estimated ship date stated by Av-DEC in the purchase order confirmation. Buyer will have no other remedies for breach as a result of delay or non-delivery of products and is not entitled to make and hereby waives any claim for damages, consequential loss or other loss due to a delay in the delivery or non-delivery of any products.
Shipping Dates. Following Seller’s receipt of Xxxxx’s purchase order, Seller shall issue an order acknowledgement. Ship dates, as stated in Seller’s order acknowledgements, are estimates and subject to change. Unless otherwise specifically agreed to in writing, Seller does not guarantee a particular date for shipment or delivery of goods quoted. Seller shall be compensated for any and all extra costs and expenses incurred by delays attributable to Buyer. Seller will make every effort to fill orders within the time stated, but under no circumstances will Seller be responsible for any damages arising out of or owing to any delays in delivery. Seller is under no obligation to pay air freight or expedite fees on late shipments. Delay in delivery shall not relieve Buyer of its obligation to accept remaining deliveries.
