Site Restrictions. Developer hereby understands and agrees that the nature of the retail and entertainment components of the Project are critical to the approval of the public incentives offered by the UG and the State in connection with this Agreement. Further, Developer understands and agrees that the Project is required to be unique, including destination entertainment and retail users that are not currently available in the State. Site Restrictions. A. The work under this Contract shall proceed only in such a manner as to cause the least possible interference with public and employee use of the building.
Site Restrictions. Gene Logic acknowledges and agrees that all GeneChip Products and Probe Arrays purchased pursuant to this Agreement may only be used at Gene Logic's sites listed in Exhibit 2. Additional sites may be added or new sites may be substituted for old sites during the Term by Gene Logic pursuant to written notification to Affymetrix. Affymetrix reserves the right to charge a "Site Fee" for additional sites.

Pursuant to Section 34 of the Lease, Landlord has agreed that Landlord shall develop a building on the Building 3 Site that is substantially of the same design as the buildings that constitute the initial Premises, including, without limitation, substantially the same amount of parking and substantially the same landscaping.
