Standbys Sample Clauses
The 'Standbys' clause defines the terms and conditions under which standby letters of credit or similar financial instruments are used to guarantee performance or payment in a contractual relationship. Typically, this clause outlines the requirements for issuing, maintaining, and drawing upon a standby, such as specifying the issuing bank, the form of demand, and the circumstances that trigger a draw. By establishing clear procedures and obligations related to standbys, the clause provides assurance to the beneficiary that they will receive compensation if the counterparty fails to fulfill their contractual duties, thereby mitigating credit risk and enhancing trust between parties.
