Subsidized Positions. Effective 1/1/94, Employees who are hired into or who are promoted, or who transfer voluntarily into a position which is subject to subsidy conditioned funding, shall be ineligible to displace another Employee in a reduction in force or when the subsidy is discontinued. Employees in positions which are subject to subsidy conditioned funding shall receive written notice whenever the subsidy is discontinued. Employees who are displaced from positions which are subject to subsidy conditioned funding shall receive preferential consideration for a period not to exceed one year when applying for vacant positions within the bargaining unit as provided above. Preferential consideration shall be given only if there are no qualified bargaining unit members with layoff rights who have applied for the position. The Employee shall be entitled to consideration before a non-bargaining unit member is hired for the vacant position, but in no case shall a candidate be placed in a position where s/he lacks the qualifications and ability to perform the duties of the available position.

Effective with the ratification of the 2004-2008 Agreement, displaced Employees (as described in paragraph 1 of this section) who have attained 10 years of continuous service in the bargaining unit on the date of Article 14 written notification, shall be considered “bump eligible.” Employees in positions which are subject to subsidy conditioned funding shall receive written notice whenever the subsidy is discontinued. Employees with less than 10 years of continuous service in the bargaining unit, who are displaced from positions which are subject to subsidy conditioned funding shall receive preferential consideration for a period not to exceed one year when applying for vacant positions within the bargaining unit as provided above. Preferential consideration shall be given only if there are no qualified bargaining unit members with layoff rights who have applied for the position. The Employee shall be entitled to consideration before a non-bargaining unit member is hired for the vacant position, but in no case shall a candidate be placed in a position where s/he lacks the qualifications and ability to perform the duties of the available position. The rights of employees on layoff, as stated here, shall take precedence over Method 2 hiring guidelines and supervisors will not be able to use the Method 2 mechanisms to refuse recall rights of qualified P&A represented candidates in layoff status.

  • New Positions A. Each newly created position shall be assigned by the Employer to the national craft unit most appropriate for such position within thirty (30) days after its creation. Before such assignment of each new position the Employer shall consult with the Union for the purpose of assigning the new position to the national craft unit most appropriate for such position. The following criteria shall be used in making this determination:

  • Float Positions The Employer may establish regular float positions which are consecutive hour shifts.

  • VACANCIES, TERM POSITIONS AND NEW POSITIONS 3001 Subject to section 3002 herein, the Employer agrees to post notices of vacant, term or new positions covered under this Agreement for at least seven (7) days to enable nurses presently in the employ of the Employer to apply for same. Such posting shall not preclude the Employer from advertising outside the site premises. All postings shall state minimum qualifications required, the equivalent to full-time (E.F.T.) and date of closing of the competition.   • Excluded Positions When a College temporarily assigns an employee to the duties and responsibilities of a position excluded from the provisions of this Collective Agreement, the employee's obligations to contribute to the regular monthly Union dues under Article 5.4 and his/her seniority shall continue during the period of such temporary assignment up to a maximum period of twelve

  • Permanent Positions All part-time and full-time positions shall be permanent unless identified as being fixed term in accordance with clause 2.2.5.

  • Posting of Vacant Positions Positions that are not filled through placement of employees from the layoff list or internal transfer list will be posted for a period of at least seven (7) calendar days, during which time, internal and external applicants may apply. The posting will include, at a minimum, a description of the work to be performed, the requirements of the position, the rate of pay and the shift.

  • New Position An approved position not reflected in the current year budget complement.

  • Queue Position The order of a valid Interconnection Application, relative to all other pending valid Interconnection Applications, that is established based upon the date- and time- of receipt of the complete Interconnection Application as described in Section 4.7 of the Overview ProcessError! Reasonable Efforts – With respect to an action required to be attempted or taken by a Party under these procedures, efforts that are timely and consistent with Good Utility Practice and are otherwise substantially equivalent to those a Party would use to protect its own interests. Reference Point of Applicability – The location, either the Point of Common Coupling or the Point of DER Connection, where the interconnection and interoperability performance requirements specified in IEEE 1547 apply.   • Shift Rotation Routine shift rotation is not an approach to staffing endorsed by the Employer. Except for emergency situations where it may be necessary to provide safe patient care, shift rotation will not be utilized without mutual consent. If such an occasion should ever occur, volunteers will be sought first. If no one volunteers, the Employer will rotate shifts on an inverse seniority basis until the staff vacancies are filled.

  • Meal and Break Periods The unpaid meal period shall be thirty (30) minutes. If a represented employee does not receive this thirty (30) minute meal period, he/she may be relieved at the end of eight (8) hours. If the employee’s work day is not shortened (ie: if he/she works eight and one-half (8½) hours), he/she shall be compensated under the CBA for one-half (½) hour at time-and-a half (ie: paid for 45 minutes). Two 10 (ten) minute breaks shall continue to be provided for each full-time shift.
