Layoff Rights. An employee on layoff status shall have the following rights:
A. The right to retain seniority credit during the period of layoff.
B. The right to be sent notices by mail of all postings for bargaining unit positions.
Layoff Rights. An employee on layoff status shall have the following rights:
a. The right to continue receipt of group insurance coverages through COBRA.
b. The right to retain seniority credit during the period of layoff.
c. Credit for salary placement, upon recall, for the same or similar work performed while on layoff status.
d. The right to be notified by email of all postings for bargaining unit positions.
e. The unchallenged right to unemployment compensation benefits when that employee has not been offered an equivalent bargaining unit position during layoff.
f. Recognition of additional certification, licensure, or entry-level requirements earned or reported while on layoff status for recall purposes provided such information is filed with the Employer prior to recall.
Layoff Rights. 1. When, for educational or budgetary reasons, or in the case of the adult education program, for insufficient enrolment or program cancellation, the Board determines that it is necessary to reduce the number of teachers employed by the Board, the teachers to be retained shall be those who have the greatest seniority, provided that they possess the necessary qualifications for the positions available as defined in Article C.25 (Definition of Qualifications).
2. Provided that they have more seniority, when teachers are advised that they are not to be retained pursuant to Article C.26.1 above, they may within seven (7) days, notify the Board that they claim another position which is being held by the most junior teacher for which they have the qualifications pursuant to Article C.25 (Definition of Qualifications).
3. The Board shall give each teacher it intends to terminate pursuant to this Article no less than thirty (30) days' notice in writing, such notice to be effective at the end of a school term, and to contain the reason for termination, and a list of the teaching positions, if any, in respect of which the Board proposes to retain a teacher with less seniority. The Board shall concurrently forward a copy of such notice to the Union. Where, due to a leave of absence, a position is filled for a period ending at a time other than the end of a school term, termination notice shall be effective at the end of that period. The effective date of layoff of a teacher in the adult education program shall be at the conclusion of the 30 day notice period and not at the end of a school term.
Layoff Rights. A. A unit member who is notified that the position held will be eliminated shall have the right to displace the least senior member in the district whose work the unit member is licensed and qualified to perform.
B. A unit member who displaces another unit member shall retain all benefits accrued in the previous position(s). Benefits do not include extended responsibilities.
Layoff Rights. An employee on RIFed or layoff status shall have the following rights:
i. The right to continue receipt of group insurance coverage at the employee's expense in accordance with COBRA.
ii. Teachers will be given credit for salary placement, upon recall, for teaching performed while on layoff status at institutions for which credit would be given at initial hiring.
iii. The right to be notified by email and postal mail of all postings for bargaining unit positions. The bargaining unit member is responsible for notifying the administrative office in writing any changes to e-mail and postal mailing address(es).
iv. Recognition of additional certification, license, or entry-level requirements earned or reported while on layoff status for recall purposes, provided such information is filed with the Superintendent prior to recall.
v. The right to priority status on the substitute list upon request.

1. The right to continue receipt of group insurance coverage at the employee’s expense.
2. The right to accumulate seniority credit during the period of layoff.
3. Credit for salary placement, upon recall, for the same or similar work performed while on layoff status.
4. The right to be notified by mail of all postings for bargaining unit positions.
5. The unchallenged right to unemployment compensation benefits when that employee has not been offered an equivalent bargaining unit position during layoff.
6. Additional certification, license, or entry-level requirements earned or reported while on layoff status shall be recognized for recall purposes, provided such information is filed with the employer prior to recall.
Layoff Rights. An attendant on layoff status shall have the following rights:
a. The right to retain and accrue seniority credit during the period of layoff.
b. The right to be sent notices by email of all postings for bargaining unit positions.
Layoff Rights. The following employees do not have layoff rights:
A. An employee appointed for less than one (1) year.
B. An employee appointed to a position funded solely from contract, grant, auxiliary or local funds; provided however, that should a permanent employee be involuntarily reassigned or otherwise involuntarily transferred to one of the above named positions, such employee shall not lose layoff rights.
C. An employee whose appointment expires without the requirement of a written notice of non-reappointment, including an employee serving on an appointment with an appropriately documented fixed term.
D. An employee without permanent status in any class.
Layoff Rights. An employee on lay off status shall have the following rights:
1. The right to continue receipt of group insurance coverage as defined under Article 35 Insurance A. 8. at the Board's expense for three (3) months and at the employee's expense for the remainder of the recall period.
2. The right to accrue seniority credit during the period of lay off.
3. The right to be notified by mail of all postings for bargaining unit positions.
4. The Board agrees not to contest an employee's application for unemployment compensation benefits.
5. An employee on the RIF list will be given priority consideration as a substitute employee in the district after active employees have been afforded the opportunity for substitution. Said employee will be contacted to substitute at the regular rate of pay in their department and substitute pay outside of their department, if the employee is qualified to perform the work.
Layoff Rights. 1. The right to continue group insurance coverage on the same terms as prevailed prior to layoff for a period not to exceed sixty (60) work days from the effective date of the RIF.
2. For layoff purposes only, Bargaining Unit Members employed under continuing contract shall be given preference over limited contract teachers.
3. Credit for salary placement, upon recall, for the same or similar work performed while on layoff status.
4. The right to be notified by mail of all postings for bargaining unit positions.
5. The unchallenged right to unemployment compensation benefits when that Bargaining Unit Member has not been offered an equivalent bargaining unit position during layoff.
6. Additional certification, license, or entry-level requirements earned while on layoff status shall be recognized for recall purposes, provided such information is filed, in writing, with the employer prior to recall.
