SUPERVISION BY THE CONTRACTOR. CONTRACTOR will supervise and direct all work. CONTRACTOR shall be solely responsible for the means, methods, techniques, sequences and procedures performed. CONTRACTOR will employ and maintain on the work a qualified supervisor or superintendent, which shall be designated in writing by CONTRACTOR as CONTRACTOR's representative at the site. The supervisor shall have full authority to act on behalf of CONTRACTOR and all communications given to the supervisor shall be as binding as of given to CONTRACTOR. The supervisor shall be present on the site at all times as required to perform adequate supervision and coordination of the work.

The Contractor shall be responsible for supervision and direction of the work of its employees and subcontractors, and if work is done on the Company's premises, the Contractor shall, at all times, provide supervision acceptable to the Company of its personnel working on the Company's premises. The Contractor shall require its employees and, if applicable, its subcontractors, to comply with the Company's plant regulations and policies.
SUPERVISION BY THE CONTRACTOR. First: The Contractor shall perform the necessary supervision during and after execution of the works and as the Engineer deems necessary for the Contractor to fulfill its contractual obligations competently and correctly. The Contractor or its representative approved in writing by the Engineer shall constantly and continuously be at the work site and shall devote all its time to supervise work performance. If the Engineer withdraws its above-mentioned approval, the Contractor shall, immediately upon receipt of written notice of such withdrawal, transfer its representative from the work site as soon as possible. It must not use him again at the work site, and it must appoint a replacement to be approved by the Engineer. The new representative shall receive, on behalf of the Contractor, the instructions and directives issued by the Engineer or its representative within the limits specified in Article (2) of these conditions.
SUPERVISION BY THE CONTRACTOR. At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly supervise the work, or assign and have present on the work site, a competent supervisor whose work is satisfactory to the Buyer and who has authority to act for the Contractor. In the event that work is occurring simultaneously at different locations, each work site must have its own competent supervisor present on that site.
SUPERVISION BY THE CONTRACTOR. At the site of the Work, the Contractor shall employ a superintendent or xxxxxxx who shall have full authority to act for the Contractor. It is understood that such representative shall be acceptable to the Commissioner and shall be one who can be continued in that capacity for the particular job involved unless such representative ceases to be on the Contractor’s payroll. The Contractor’s superintendent or xxxxxxx must be able to read and speak the English language.

  • Acceptance by the Company It is understood that this subscription is not binding on the Company until the Company accepts it, which acceptance is at the sole discretion of the Company and shall be noted by execution of this Agreement by the Company where indicated.

  • Independent Contractor; Authority Notwithstanding the Services provided by the Administrator pursuant to this Agreement, the Administrator shall be deemed to be an independent contractor with respect to the Services. The management, policies and operations of the Parties (including the ultimate approval of the making or disposition of the Painting by the Issuer or Masterworks Cayman, and the terms and conditions thereof) shall be the responsibility of the Parties other than the Administrator.

  • Confirmation by the Company The Company must provide written confirmation to the Underwriter that the Underwriter’s instructions to restrict or prohibit trading have been executed. The Company agrees to provide confirmation as soon as reasonably practicable, but not later than ten (10) business days after the instructions have been executed.

  • Subcontractor Any vendor, subcontractor or other Person that is not responsible for the overall servicing (as “servicing” is commonly understood by participants in the mortgage-backed securities market) of Mortgage Loans but performs one or more discrete functions identified in Item 1122(d) of Regulation AB with respect to Mortgage Loans under the direction or authority of the Servicer or a Subservicer.
