Time Frame: Study will be completed within 2 years of permit issuance. Solutions for management-induced variables will be sought concurrently with findings and implemented within five years of permit issuance. ▪ Permittee agrees to construct and maintain enhanced tailwater berms to eliminate tailwater returning as warm surface flow to Kettle Springs Creek, if applicable. Participation in reach-wide Diversion Management Plan  The Enrolled Property is, and will continue to be, sprinkler irrigated, while utilizing the stored “Prior Rights” downstream, per current Upper Shasta River Flow Management Strategy. Upgrade/repair/maintain diversion facilities  Permittee has cooperated in studies to redesign and reconstruct HVR diversion located on the Enrolled Property (at -122.38123, 41.54835), including realignment and piping of conveyance facilities, at a potential loss of ±10 acres of sub-irrigated pasture.

Tailwater Reduction. Permittee agrees to maintain pickup ditch and will collect tailwater wherever possible and put to beneficial use in such a way that re-use of tailwater will not increase consumptive use. Soil Moisture Monitoring Program Multiple field moisture sensor stations will be installed, maintained and used in the main pasture to inform the irrigator when to irrigate to optimize irrigation application rate efficiency. The Permittee agrees to the development of irrigation management plans developed in collaboration with experts from academia (University of California, California State Universities, or other experts approved by the Agencies) to better manage efficient application of water throughout the irrigation season. The Agencies believe that irrigation management plans developed as a result of this program would result in a reduction in applied water during the irrigation season which would result in additional instream flow benefits coho salmon. Irrigation efficiencies based on soil moisture monitoring will be reported in the annual report. Interim Operation Plan To reduce adverse water quality impacts to Covered Species at the end of each irrigation cycle, the existing impoundment shall be drained in a manner that minimizes turbidity, siltation, and elevated water temperatures to Parks Creek downstream. Whenever feasible, initiation of drawdown through removal of dam boards or other obstacles should be released in the early morning (prior to 10:00 am) and/or during cool times of year, and will be released as gradually as possible to minimize fine sediment discharges.
Tailwater Reduction. If irrigation occurs within the Big Springs Unit, and if tailwater measurably affects stream temperature (i.e., changes stream temperature by more than 0.1 degrees Celsius from upstream to downstream), Permittee will continue to manage the tailwater capture pond installed within the Big Springs unit to prevent tailwater coming from upslope pastures from entering Big Springs Creek. The pond is equipped with temperature monitoring stations that inform the Permittee when the temperature of the water is suitable to return into Big Springs Creek. Tailwater that is warmer than the creek is held in the pond until its temperature is the same or lower than Big Springs Creek water. -When not irrigating, the Permittee will close the head gate after the spur ditch heading to Bass Lake to mitigate for any tailwater that may travel on to the property from adjacent properties. Off-Channel Stock watering -Permittee commits to maintain the existing off-channel stock water system if livestock are present.
Tailwater Reduction. Tailwater is a large concern in this reach, and the Enrolled Property topography includes sloped pastures with gullies. The Permittee commits to the construction and maintenance of approximately 1000-feet of tailwater infiltration berms at known tailwater return points within the Bunkhouse Pasture. The berm was designed to collect water from the pasture over time, allow it to percolate into the ground, and/or be released in the morning hours if cool enough via a xxxxxxxx valve and culvert. This project was constructed in 2017 with funds from the Shasta Valley RCD. HVR utilized this feature in 2017 with overall success and will maintain and manage the berm for the term of the agreement. Water Exchanges: -A water exchange of 1.5 cfs with MWCD has being negotiated under this Agreement to facilitate improvement to water quality by releasing additional spring water to the channel. Once the terms with MWCD are settled and a 1707 has been completed, the exchange would be exercised for the term of the agreement. In order to exercise the exchange, the installation of an additional pipeline (approximately 4000-feet) to deliver up to 1.5 cfs of MWCD water (in addition to current prior rights deliveries) in exchange for bypassing available cold spring water directly to the Shasta River from June 1 through September 15th is needed. This project has been designed, environmental review has been completed, and permits and implementation funds have been obtained, with the goal to construct in 2019-2020. In order for an exchange to occur, the overall spring production on the Enrolled Property must be over 0.75 cfs; this allows the Enrolled Property to fulfill the 0.25 cfs adjudicated right (#160/161) for irrigation purposes and the 0.5 cfs spring contribution due to efficiency improvements (as described above). If the overall spring production is between 0.75 and 2.25 cfs than the exchange agreement will be fulfilled on a 1:1 basis and if spring production decreases the exchange amount diverted will be decreased in equal proportion. This effort will be documented with the SWRCB through a Water Code section 1707 process by 2019-2020. The water exchange will be managed using real-time flow meters, measuring spring released to the river and exchange water used for irrigation.

  • PERSONNEL REDUCTION Section 1 In the event of layoffs in connection with decreasing the work force, and the recall to work of people so laid off, the following consideration shall govern. Skill and ability as determined by reference to the employee's work record, and length of service shall be the determining factors; however, employees shall be laid off by category of seniority. There shall be three (3) seniority categories: probationary, 1 year to 5 years seniority, and over 5 years seniority. In case of layoff, all employees in the lowest seniority category shall be laid off before proceeding to layoff of anyone in a more senior category. Where skill and ability within a category are approximately equal, length of service shall govern. Employees having the same seniority within a category shall draw lots to determine the order of layoff. No new employees shall be hired until all laid off employees have been given the opportunity to be re-hired. Employees who have been laid off will be offered re-employment in the inverse order of layoffs when they are needed again, provided they are physically qualified and possess sufficient training and experience to perform the duties of the available work. The City shall give laid off employees ten (10) days notice of its intention to rehire. The employees shall within ten (10) days period notify the City of their intention to, or not to, return to the employ of the City, and shall report to work no later than fifteen (15) days from receipt of said notice to rehire. If an employee fails to notify the City within the ten (10) calendar day period of his/her intentions to return to work, or fails to report to work within fifteen (15) calendar days from the date of notice, he/she shall be considered permanently severed from the employ of the City. At the time of a layoff the City shall provide all laid off employees with a complete physical examination. At the time of rehire, the City may require a physical examination prior to the employee's return to duty, and it is expressly understood that any employee found physically unfit to return to duty may be refused re-employment and removed from the employment list. The City shall not be obligated to rehire laid off employees who have been laid off for five (5) or more consecutive calendar years, beginning from the date of layoff.

  • Staff Reduction In the event the District adopts a reduced educational program by reason of financial necessity, including but not limited to, levy failure and/or decreased State or Federal support, certificated employees who will be retained to implement the District’s reduced or modified program and those certificated employees who will be non-renewed from employment or adversely affected in contract status shall be identified by the provisions contained in this Article. If the District is only reducing provisional employees, the following procedures do not need to be implemented.

  • Price Reduction Notwithstanding any other provision set forth in this Warrant, at any time and from time to time during the period that this Warrant is exercisable, the Company in its sole discretion may reduce the Purchase Price or extend the period during which this Warrant is exercisable.

As soon as security for the performance of this con- tract or the settlement of Claims incident thereto is no longer necessary, appropriate notice shall be given to surety or deposits that may have been made in lieu of surety bond shall be returned to Purchaser, subject to the conditions in B9.5.

  • Refund after Scaling Completed Any cash deposit, in excess of that required to meet charges under B4.2, shall be refunded or transferred within 15 days of Purchaser’s request after Scaling is completed, except for amounts estimated to be required under B9.5. B4.3 Payment Guaranteed by Xxxx or Deposited Securities. To guarantee payment, Purchaser may fur- nish and maintain an acceptable surety bond or deposit in a Federal Depository negotiable securities of the United States. The securities shall be deposited through the Re- gional Fiscal Agent accompanied by a power of attorney and agreement authorizing the bond-approving officer to sell or collect such securities if payment is not made within 15 days of billing by Forest Service. The penal sum of such surety bond or the market value at time of deposit of such negotiable securities shall be the maximum amount of the payment guaranteed. For payment purposes, penal sum of the surety bond or market value at time of deposit of negotiable securities shall be in lieu of the performance bond furnished under B9.1.

  • REDUCTION IN STAFF 15.1 Procedure According to provisions of Missouri Statute 168.124, the Board of Education may place on leave of absence as many teachers as necessary because of decrease in enrollment, school district reorganization, or financial conditions. Whenever the Board anticipates a reduction in teaching staff, the superintendent or his/her designee will notify the officials of the Association concerning the anticipated reduction in the teaching staff. A meeting between the Association officials and the superintendent or his/her designee will be scheduled for purposes of discussing the proposed reduction in staff within two weeks (2) following the above notification. Individual teachers will not be contacted prior to the above meeting. In placing teachers on leave, the Board shall be governed by the following provisions:
