The parties further agree that the Administration, in conjunction with counselors, shall make a good faith attempt to balance classes with equitable distribution across the grade level among affected teachers at the beginning of the school year and at each card marking. If requested by the Association, reasonable documentation will be provided that shows that classes are balanced. In determining annual assignments for secondary teachers, the Administration agrees to minimize excessive and unnecessary disparities in the number of teaching preparations between core academic teachers within a single department by paying fifty dollars ($50.00) per marking period for every additional preparation hour over two (2). 1. It is the goal of both parties to endeavor to attain in the young fives and kindergarten class size of twenty (20). However, once a class size exceeds twenty-five (25) students, one (1) hour of aide time per day, shall be provided to the teacher. For each additional student assigned to the classroom above twenty-six (26), one-half (1/2) additional hour of aide time shall be provided. Instead of additional aide time the affected teacher may choose to receive compensation of two dollars ($2.00) per day for each student above twenty-five (25). 2. Otherwise, determination will occur the Monday of the first week of October. Pay will be calculated and paid at the end of each semester.

In the event that none of the above steps are implemented to correct the problem and the Board determines that it is necessary to exceed the above maximum class size limits, the following compensation formula shall be instituted: salary schedule amount 1 # of students membership X # of school X in excess of X days in Applicable class days on school maximum class size limit calendar class limits 3. Any individual with a disability, IEPC identified as emotionally impaired, mainstreamed into a regular education classroom shall be counted as two dollars ($2.002) per day students for each student over thirty (30) for each day that the numbers enrolled and in attendance purpose of this Article. The payment calculation definition of an IEP meeting includes any team meeting(s) prior to or following the actual IEP meeting. Each of those meetings would be considered separate meetings if necessary for one student and occur at different times and/or dates. A 504 meeting is also considered for compensation under this section of the contract. In addition, any teacher whose referral results in an IEP shall not begin have the option of attending and participating in the IEP. When an IEP is going to accrue until consider mainstreaming an identified student with a disability, the first day regular education elementary teacher or one (1) regular education secondary teacher, such as the case may be, shall have the option of attending and participating in the IEP. 5. A classroom teacher or special education teacher, who fittingly attends and participates in more than four (4) IEPs or 504 meetings held before or after regular school hours during a school year, shall be paid $25.00 for each IEP after the state count dayfourth. B. To the extent practicable, providing the state count day occurs Board will make available to teachers in October. Otherwiseeach school building adequate lunchroom, determination will occur restroom, and lavatory facilities, and at least one room, appropriately furnished, which shall be reserved for use as a faculty lounge. C. Teachers shall be permitted to place outgoing non-toll calls on the Monday of the first week of October. Pay office telephones in their building, but it is expected that personal, non-emergency calls will be calculated held to a minimum. Teachers will be given “to call” messages on incoming calls, to be returned by the teacher outside of classroom hours, but will be given immediate opportunity to return calls relating to grave emergencies, such as death or serious illness or injury of a close relative. D. To the extent practicable, parking facilities shall be made available to teachers within a designated area. The Board assumes no new additional liability respecting parking facilities or their use by teachers as a result of any provision of this Agreement and paid at that parking will be the end teacher’s own risk of each semesterloss or damage except as otherwise provided by law without regard to the provisions of this Agreement.

TEACHING CONDITIONS. A. Teachers are encouraged to be creative and innovative within the classroom insofar as the purposes of the curriculum are being fulfilled in a professional manner. It is understood that professional, legal and social standards must be observed within the context of a public school. B. Outside the classroom, when a teacher speaks or writes as a citizen, she/he shall be free from institutional censorship and discipline. It shall be the responsibility of the teacher to make it clear that he/she speaks or writes as an individual and not in behalf of the district. C. If an observation for purposes of evaluation is to be recorded, the teacher will be notified in advance, and the administrator will remain in the room during the recording. If an employee, acting under the rights granted in this Agreement (specifically excluding activities covered in B, above) or within the scope of Board policy, is subjected to court action with respect to exercise of those rights, the Board agrees to support such employee and to defend the contract provisions. D. Any complaint by a parent directed against a teacher shall be called to the attention of the teacher if the complaint is considered serious enough to result in a written record and/or to become the basis for the disciplinary action against such teacher. E. Disciplinary interviews will be considered in private. An affected teacher will, however, have the right, in all instances, to request the presence of a Union designated representative at said interview, and when such a request is made, the interview will not proceed until the representative is in attendance. Every effort will be made to see that the number of students in a study hall should not exceed 40:1. If available, by-assignment teachers will be assigned to study halls in addition to the regular study hall teacher for the first two weeks of each semester. H. A class size list containing the actual number of students in each class will be distributed to the Association president and members of the Superintendent's Advisory Committee no later than October 30 of each school year. Any middle school and high school classroom, except choir, band, physical education and study halls, that exceeds 35 students and any elementary class room, except art, music, and physical education, that exceeds 32 students will be offered an acceptable volunteer, a student teacher or an aide. I. The administration shall make every reasonable effort to transfer elementary students to insure equitable distribution among classes/bargaining unit members. J. The Board shall comply with all state standards with reference to class size as it relates to preschool programs and special education programs. K. Art, music and physical education classes shall not exceed forty-two (42) students. Section 11.5 (H) shall not be applicable. Principals will work closely with art, music, and physical education teachers in a building in order to make sure of the best possible scheduling of students, two and that adequate equipment is provided for the students. L. The Superintendent will work with all principals and staff to reduce class sizes: 1. by utilizing team teaching where possible, and 2. by any other means available. 11.6 When a personal emergency for a bargaining unit member exists, the principal or person in charge shall notify the bargaining unit member immediately. 11.7 Except as otherwise provided in this Agreement, the length of the bargaining unit members' work day shall not exceed seven and one-half (2) hours. The teacher work day is NOT contingent upon the students’ day. This includes a thirty (30) minute lunch period which will be determined by scheduling in each individual building. Unless otherwise specified in this Agreement, the day shall be continuous from the required beginning time to the end of the day. There shall be a uniform number of teaching hours of aide timein the elementary schools, per dayas nearly as possible. 11.8 In-day conference or planning time shall be in compliance with the Ohio Elementary and Secondary School Standards. This time shall not be considered time for travel for multi-school assignments. A. All bargaining unit members, including specialists, shall be provided to the teacherat least forty (40) minutes of continuous planning time. For each additional student assigned to the classroom above twenty-eight (28), one-half (1/2) additional hour of aide Such planning time shall be provided. Bargaining unit members are responsible for attending and participating in CORE functions as assigned in individual buildings. C. 1. Bargaining unit members with “by- assignment” periods may be required to substitute at any time during those periods. In the case of an extreme emergency, a bargaining unit member may be required to substitute during planning time no more than once per semester. This includes libraries and similar circumstances in elementary schools. No bargaining unit member shall be required to substitute when said bargaining unit member is the goal of both parties scheduled to endeavor to attain in the second through fifth grades have a class size assignment of twenty-eight his/her own unless he/she volunteers to “double up” the classes. Therefore, in an attempt to address the existing situation, the parties agree Board agrees that teacherit will strive to achieve a maximum pupil/teacher load of 23 for K, 25 for grades 1-aide assistance 4; 28 for grades 5-8; and 30 for grades 9-12 for the Academic Areas. Students identified by teachers as potential special students will be tested/processed in accordance with State and Federal guidelines. 2. Teachers referring and/or receiving students shall be released from regular duties to attend all IEPC meetings regarding students they have referred or are to receive. 3. Students properly tested/processed will be removed from the responsibility of the regular classroom teacher as mutually agreed to by the appropriate affected staff. 4. Students mainstreamed into a regular classroom will be counted when determining the maximum class sizes as stated above. Said students shall be equally distributed amongst appropriate grade level classrooms to the extent possible. C. The Board will furnish each teacher with a desk in the room he/she has his/her major assignment and a lockable file. D. The Board agrees at all times to keep the schools reasonably and properly equipped and maintained. E. Teachers shall be responsible for inventorying of supplies and equipment, duplicating teaching materials, operating audio-visual equipment for their room only. Teachers shall not be required to collect money for insurance, lunches, workbooks, and picture money. No bookkeeping as to milk money will be required. F. Under no conditions shall a teacher be required to drive a school bus as part of his/her regular assignment. G. The Board shall make available in each school restroom facilities exclusively for teacher use and a primary lounge facility shall be made available in each building. H. Adequate telephone facilities shall be made available to faculty for their reasonable use. I. Adequate surfaced parking facilities shall be made available to the faculty for their exclusive use. J. The private and personal life of any teacher is not within the appropriate concern or attention of the Board within the limits of professional behavior. The provisions of the Agreement and the wages, hours, terms and conditions, of employment shall be applied without regard to race, creed, religion, color, national origin, age, sex or marital status or membership in or association with the activities of any employee organization. K. Teachers shall not be responsible for routine custodial services. L. Substitute teachers shall be provided when special area teachers are absent. Special area teacher is defined as any teacher who pulls students from a regular classroom for the purpose of providing instruction or remediation. M. When a teacher is assigned a medically fragile student, the teacher shall not be required to perform routine, scheduled maintenance of a medical appliance or apparatus used by the student to sustain his/her bodily function nor render routine, scheduled care or maintenance of exceptional bodily functions related to the student’s impaired condition. The teacher shall be informed and instructed as to emergency measures, which may be necessary on occasion due to the student’s impaired condition. TEACHING CONDITIONS. In the event the Administration and the Association are in agreement that the elementary overload condition is the most appropriate option, the affected classroom teacher shall receive overload compensation at the rate of $10 per student enrolled, per day. Classroom teachers with students resulting in an important aspect overload condition on a part-time basis shall receive a prorated amount based upon the time the student is enrolled daily. The panel shall consider the request, using the guidelines below, and make a recommendation to the Board. The panel and building administrator shall consider the following guidelines, among others, to remedy the situation: 1. Transfer pupils to other classes; 2. Transfer pupils to other schools; 3. Provide additional professional assistance (part-time certified teacher); 4. Divide the overload into additional groups for teaching purposes; 5. Schedule excess load on a double session basis. The Board agrees that the building administrator shall take the necessary steps to correct the condition according to the Board's decision. In the event the teacher is not satisfied with the disposition, he may lodge a grievance. C. The Board recognizes that appropriate texts, library reference facilities, maps and globes, laboratory equipment, audio-visual equipment, art supplies, athletic equipment, current periodicals, standard tests and questionnaires, and similar materials are the tools of the teaching profession. A joint teacher and administrative committee will confer from time to time for the purpose of improving the selection and use of such educational tools, and will make recommendations for consideration by the Board. The Board agrees at all times to keep the schools reasonable and properly equipped and maintained. D. The Board shall attempt to make available during the school day in each school adequate lunch room, restrooms and lounge facilities exclusively for teacher use and at least one room appropriately furnished. E. In schools where continuous cafeteria service for teachers is not available, vending machines for beverages, candy, gum, etc. will be installed at the request of the Association building representative, the location to be determined by the building principal. F. Telephone facilities shall be made available to teachers for reasonable use, subject to control by the building principal. All long distance calls shall be properly logged and arrangements made for compensation of any phone calls which shall be chargeable to the number involved. G. Adequate parking facilities shall be made available for teachers and shall be reserved for their exclusive use and to the extent it is practicable. H. Notwithstanding their employment, teachers shall be entitled to full rights of citizenship, and no religious or political activities of any teacher, or the lack thereof, shall be grounds for any discipline or discrimination with respect to the professional staff, whenever at least a half-time position can be createdemployment of such teacher.
