Temporary Facilities During Construction. Tenant shall obtain in its name and pay for all temporary utility facilities, and the removal of debris, as necessary and required in connection with the construction of the Premises. Storage of Tenant’s contractors’ construction material, tools, equipment and debris shall be confined to the Premises and any other areas which may be designated for such purposes by Landlord. Landlord shall not be responsible for any loss or damage to Tenant’s and/or Tenant’s contractors’ equipment. In no event shall any materials or debris be stored in the malls or service or exit corridors of the Project.

Temporary Facilities During Construction. 1. Tenant shall pay for all temporary utility facilities, and the removal of debris, as necessary and required in connection with the demolition and/or construction of the Leased Premises. Storage of Tenant’s Contractors’ construction material, tools, equipment and debris shall be confined to the Leased Premises and in areas which may be designated for such purposes by Landlord. In no event shall any material or debris be stored in the mall or in service or exit corridors. 2. During construction, Landlord may provide temporary electrical and central air conditioning services (unless the Leased Premises is not served by such a central system) in an area designated by Landlord. The cost to Tenant for this service shall be Two Thousand and 00/100ths Dollars ($2,000.00) per month (or One Thousand and 00/100ths Dollars [$1,000.00] if the Leased Premises is not served by a central system) for Landlord provided facilities. 3. During initial construction, Tenant fixturing and merchandise stocking, Landlord may require Tenant to utilize trash removal service from designated truck courts. Tenant is responsible for breaking down boxes and placing trash in containers in the designated truck court areas. The cost to Tenant for this service shall be billed by Landlord to Tenant or otherwise by a third party vendor, of Landlord’s choosing. At any time, as determined by Landlord, Landlord may discontinue trash removal service and Tenant shall assume responsibility therefor. All such work shall be performed by contractors approved by Landlord.

Utility costs or charges for any service to the premises shall be the responsibility of Tenant from the date Tenant is obligated to commence Tenant’s Work. 2. During construction, temporary electrical service (110 volt) may be provided by Landlord. Tenant shall request, in writing, permission to connect temporary lines in the power source for service to its premises. If provided by Landlord, the cost to Tenant for this service will be One Hundred Fifty And 00/100 Dollars ($150.00) per month or Fifteen Cents ($.15) per square foot of Rentable Area of the Demised Premises, per month, whichever is greater. Payment is to be remitted to Landlord by the first of each month, after service is initiated. 3. During the period from the commencement of Tenant’s Work through the date that Tenant begins using the Demised Premises for its intended purpose, Tenant shall deposit all of its trash and debris in trash dumpsters provided by Landlord. Landlord shall provide trash removal service for such dumpsters. During such period, Tenant shall pay Landlord for such trash removal service a sum equal to TWENTY CENTS ($.20) per square foot of Rentable Area of the Demised Premises per month; such sum to be paid to Landlord within ten (10) days after billing therefor from time to time. Tenant shall not permit trash to accumulate within the Demised Premises or any other portion of the Project. Should this situation develop and Landlord be forced to remove Tenant’s trash, Tenant shall pay Landlord the cost to remove such accumulation of trash plus a (15%) administrative charge within ten (10) days after being billed therefor.

Tenant shall not permit trash to accumulate within its area or in any area adjacent to its space. Should the situation develop and Landlord be forced to remove Tenant's trash, the cost for such service will be paid by Tenant.

Landlord shall have the right to remove or cause the removal of any such material, debris or equipment upon reasonable notice to Tenant or Tenant’s Contractor and Landlord shall be reimbursed by Tenant for the cost of such removal promptly upon Landlord’s presentation to Tenant of invoices or other proof of cost.
