Common use of Time Off in Lieu of Payment for Overtime Clause in Contracts

Time Off in Lieu of Payment for Overtime. (a) For the purpose only of providing care and support for a person in accordance with subclause (i) of this clause, and despite the provisions of Clause 20, Overtime, the following provisions shall apply. (b) An employee may elect, with the consent of the employer, to take time off in lieu of payment for overtime at a time or times agreed with the employer within 12 months of the said election. (c) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked. (d) If, having elected to take time as leave in accordance with paragraph (a) of this subclause, the leave is not taken for whatever reason payment for time accrued at overtime rates shall be made at the expiry of the 12-month period or on termination. (e) Where no election is made in accordance with the said paragraph (a), the employee shall be paid overtime rates in accordance with the Agreement.

(dc) If, having elected to take time as leave in accordance with paragraph (a) of this subclausesub-clause, the leave is not taken for whatever reason reason, payment for time accrued at overtime rates shall be made at the expiry of the twelve (12-) month period or on termination. (ed) Where no election is made in accordance with the said paragraph (a)) of this sub- clause, the employee shall be paid overtime rates in accordance with the Agreementagreement.

(eiv) Where no election is made in accordance with the said paragraph (ai), the employee Employee shall be paid overtime rates in accordance with the Agreement.

(ai) For the purpose only of providing care and support for a person in accordance with subclause (i25.2) of this clauseClause, and despite the provisions of Clause 2018, Overtime, the following provisions shall apply. (bii) An employee may elect, with the consent of the employer, to take time off in lieu of payment for overtime at a time or times agreed with the employer within 12 twelve (12) months of the said election. (ciii) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked. (div) If, having elected to take time as leave in accordance with paragraph (ai) of this subclause, the leave is not taken for whatever reason payment for time accrued at overtime rates shall be made at the expiry of the 12-month twelve (12)-month period or on termination. (ev) Where no election is made in accordance with the said paragraph (ai), the employee shall be paid overtime rates in accordance with the Agreement.

Time Off in Lieu of Payment for Overtime. (b) An employee A staff member may elect, with the consent of the employer, Hospital to take time off in lieu of payment for overtime at a time or times agreed with the employer Hospital within 12 twelve (12) months of the said election. (c) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked. (d) If, having elected to take time as leave in accordance with paragraph paragraph (a) of this subclause, above the leave is not taken for whatever reason reason, payment for time accrued at overtime rates shall be made at the expiry of the twelve (12-) month period or on termination. (e) Where no election is made in accordance with the said paragraph (a), ) the employee shall be paid overtime rates in accordance with the Agreementthis agreement.

(a) For the purpose only of providing care and support for a person in accordance with subclause (i26.7(a) of this clauseClause and where the Employee has exhausted their paid personal/carer’s leave entitlements, and despite the provisions of Clause 2017, Overtime, the following provisions shall apply. (b) An employee Employee may elect, with the consent of the employerEmployer, to take time off in lieu of payment for overtime at a time or times agreed with the employer Employer within 12 months of the said election. (c) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time overtime rate, that is an hour plus time for the applicable overtime penalty for each hour worked. (d) If, having elected to take time as leave in accordance with paragraph (a) of this subclause, the leave is not taken for whatever reason payment for time accrued at overtime rates shall be made at the expiry of the 12-month period or on termination. (e) Where no election is made in accordance with the said paragraph (a), the employee Employee shall be paid overtime rates in accordance with the Agreement.

(b) An employee may elect, with the consent of the employer, to take time off in lieu of payment for overtime at a time or times agreed with the employer within 12 months of the said election. (c) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, rate that is an hour for each hour worked. (d) If, having elected to take time as leave in accordance with paragraph (a) of this subclausesub- clause, the leave is not taken for whatever reason payment for time accrued at overtime rates shall be made at the expiry of the 12-month period or on termination. (e) Where no election is made in accordance with the said paragraph (a), the employee shall be paid overtime rates in accordance with the Agreement.

(c) Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, rate that is an hour for each hour worked. (d) If, having elected to take time as leave in accordance with paragraph (a) of this subclausesub- clause, the leave is not taken for whatever reason payment for time accrued at overtime rates shall be made at the expiry of the 12-month period or on termination. (e) Where no election is made in accordance with the said paragraph (a), the employee shall be paid overtime rates in accordance with the Agreement.
