Unpaid Leaves. A. Any teacher who is unable to perform his duties because of a personal illness or disability (including for this purpose maternity) which extends beyond the period for which sick leave pay is received under Article 6 shall be granted a leave of absence without pay for such time as is necessary to recover from such illness or disability, up to a maximum of one (1) calendar year. 1. It is understood that such sick leave shall be renewed if necessary upon application of the teacher. Unpaid Leaves. A. Any teacher who Maternity/Paternity Leave Employees may apply for maternity/paternity leave of absence for childbearing or child rearing for up to one year, provided sufficient notice is unable given to perform his duties because the appropriate supervisor prior to the commencement of a personal illness or disability (including for this purpose maternity) which extends beyond the period for which leave. At the termination of a leave for maternity, illness or incapacity, a doctor's statement if requested by the Superintendent.

Failure to notify the Superintendent by March 1, shall be deemed an election not to return to employment and as a resignation from the district. The Board or its designated representative will send the teacher a certified letter by February 15, advising them of the leave periodMarch 1 date.
B. Leave of absence f. A teacher granted an unpaid leave shall be advanced on the salary schedule if he/she has completed 90 days or one full semester, whichever is less, during the school term when the leave was granted. In a school term where less than one semester or less than ninety (90) days are completed by the teacher granted an unpaid leave, no advancement will be granted up to two (2) years to any teacher who joins recognized on the Peace Corps as a full time participant in such program. The regular salary increment occurring during such period schedule.
g. Upon return from an unpaid leave the Teacher shall be allowedreinstated to his/her former position or an open position for which he/she is certified and qualified.
C. Military h. A teacher on unpaid leave may continue to participate in the school district's health and life insurance program by making timely payments of absence premiums for themselves and/or families providing approval is secured from the insurance company.
i. Nothing in the procedure shall be construed as requiring a teacher to apply for an unpaid leave for maternity, illness or incapacity. A teacher not eligible nor desiring to apply for an unpaid leave may utilize sick leave for disability related to pregnancy and or delivery of a child or for teacher illness or incapacity.
j. Education Leave shall be granted to any teacher who with ten (10) years or more of full time teaching experience at Unit 230 School District for the purpose of engaging in study at an accredited college or university with a curriculum related to his/her professional responsibilities in his/her area of teaching. A planned course of study shall be inducted or shall enlist submitted to the Board for military duty to any branch approval in conjunction with the application of the armed forces of the United Statessaid leave. The regular salary increment occurring during such period granting of an Education Leave shall be allowed if increments have been granted to other teachers during contingent upon filling the vacancy created by the leave period.

Unpaid Leaves. A. A tenure teacher may be granted a one (1) year leave of absence without pay to further his/her education. A teacher upon return from such leave shall be placed on that step on the salary schedule he/she would have been on at the beginning of the contract year during which the leave was taken. Said teacher shall retain all his/her accumulated sick leave days accumulated prior to the leave but shall not accumulate one calendar year of seniority.
B. Teachers may be granted unpaid leave days by the Board for reasons not covered in this agreement.
C. More than five (5) unpaid leave days in one contract year for a teacher will result in a loss of seniority equal to the number of calendar days from the sixth contract day of the leave to but not including the first contract day the teacher returns to work.
D. For salary purposes any teacher granted unpaid leave time will receive full credit for each semester he/she taught at least half of that semester.
E. Unpaid Leaves. A. A tenure teacher may be granted a one (1) year leave of absence without pay to further his/her education. A teacher upon return from such leave shall be placed on that step on the salary schedule he/she would have been on at the beginning of the contract year during which the leave was taken. Said teacher shall retain all his/her accumulated sick leave days accumulated prior to the leave but shall not accumulate one calendar year of seniority.
B. Teachers may be granted unpaid leave days by the Board for reasons not covered in this Agreement.

In cases where special circumstances are involved, such requests may, however, be granted only once during a school year, and on the condition that the applicant reimburse the Board for one (1) day of pay for a contracted substitute teacher's lead-in time (or its equivalent), in the case of absence up of two (2) days or more of unpaid leave. Denial of any application for such leave will not be subject to the Grievance Procedure.
H. Teachers who are granted leaves as above provided shall retain their tenure status while on leave but will not receive credit on the salary schedule for the period of absence, except in the case of military leave, and except in the case of a maximum leave granted under Section B above where full credit on the salary schedule shall be allowed for time spent actively teaching as a teacher. Upon return, such teacher will be assigned to his/her former position if vacant, but if not, then to whatever vacant position of like nature there may be for which he/she is qualified.

Unpaid Leaves. A. Any 21.1 Unless otherwise specifically provided by law, the granting of leave shall be at the discretion of the Board. When it is granted by the Board, it shall be allowed on the basis of policies designed to protect the operation of the schools against undue interruption because of absence of personnel.
21.2 Leave granted on the request of a teacher shall be for particular purposes or causes which shall be set forth in a written application for leave. The Board reserves the right to

21.4 Up to a year of educational leave may be granted teachers who are on a continuing contract or professional services contract. Upon return from such leave, the teacher shall be offered his/her former position or if it has been eliminated, a substantially similar position for which he/she is fully qualified.
21.5 Teachers may be granted up to one (1) year of medical leave for illness to themselves or members of their household. A statement of medical justification from a licensed physician must accompany the application for leave, and a licensed physician's statement may be required for reinstatement from leave.
21.5-1 Teachers who have been employed for at least twelve (12) consecutive months may apply for a leave of absence under the Family and Medical Leave Act and the provisions of Polk County School Board's Family and Medical Leave Procedures for up to twelve (12) weeks during a school year for eligible reasons. Teachers granted this leave who are eligible and receive insurance under Article XXIII shall maintain this coverage for the duration of the leave, paid for as it was prior to initiating leave. Use of sick leave is not required to be eligible for this leave. The School Board shall require medical certification from employees returning from medical leave, and the employee will be restored to the same position held prior to the start of the leave.
21.6 A parental leave of absence may be granted to a teacher for the purpose of child rearing to commence at the birth of a child or the date of the adoption of a child and may continue for up to twelve (12) months.
21.7 Teachers returning from medical leave or parental leave within one year shall have the right to return to the same, if certified or, if that position has been eliminated substantially equivalent position provided that annual contract teachers must have been recommended, or would have been recommended, for re-employment by their principals. The teacher shall notify the principal no later than November 1 if he/she intends to return the second semester or by March 1 if he/she intends to return the first semester. Such teacher shall be assigned by the beginning of the next semester. A teacher returning from medical leave more than one year after leave commenced shall notify the superintendent by November 1 if he/she intends to return the second semester or by March 1 if he/she intends to return the first semester, and shall, by the beginning of the next semester, be assigned to the first available vacant position in the District for which he/she is qualified, provided that if more than one (1) teacher has given notice pursuant to this paragraph. The teacher who is unable gave such notice at the earliest date shall be assigned to perform his duties because of a personal illness or disability (including for this purpose maternity) which extends beyond the period for which sick leave pay is received under Article 6 shall position in question.

Denial of any application for such leave will not be subject to the Grievance Procedure.
H. Teachers who are granted leaves as provided above shall retain their tenure status while on leave but will not receive credit on the salary schedule for the period of absence, except in the case of military leave, and except in the case of a maximum leave granted under Section B above where full credit on the salary schedule shall be allowed for time spent actively teaching as a teacher. Unpaid Leaves. A. Any 21.1 Unless otherwise specifically provided by law, the granting of leave shall be at the discretion of the Board. When it is granted by the Board, it shall be allowed on the basis of policies designed to protect the operation of the schools against undue interruption because of absence of personnel.

21.5-1 Teachers who have been employed for at least 1,250 hours over the previous twelve (12) months may apply for a leave of absence under the Family and Medical Leave Act (FMLA) and the provisions of Polk County School Board's Family and Medical Leave Procedures for up to twelve (12) weeks during a school year for eligible reasons. Teachers granted this leave who are eligible and receive insurance under Article XXIII shall maintain this coverage for the duration of the leave, paid for as it was prior to initiating leave. The employee will have the option to use available paid leave days (sick, personal chargeable to sick, and/or vacation) concurrently with FMLA leave. The School Board shall require medical certification from employees returning from medical leave, and the employee will be restored to the same position held prior to the start of the leave.

21.7 Teachers returning from medical leave or parental leave within one year shall have the right to return to the same, if certified or, if that position has been eliminated substantially equivalent position provided that Annual Contract teachers must have been recommended, or would have been recommended, for re-employment by their principals. Any period of leave after the exhaustion of the rights guaranteed under the Family Medical Leave Act shall be without pay and/or benefits for a period not to exceed one (1) year renewable at the discretion of the Board, for personal illness or disability upon exhaustion of all available leave days. The ending time for the leave will conform as Litchfield Education Association MEA/NEA September 1, 2020-August 31, 2024 nearly as possible to the start of a marking period but may be relaxed at the discretion of the Superintendent. (A teacher returning from such leave in the fall shall notify the Board of intent to return from leave no later than April 15 of the preceding year.) The District may require the teacher to provide a medical statement from the attending physician that the teacher is able to perform the essential functions of his/her position, with or without reasonable accommodation.
3. The Board, at its discretion, may grant teachers unpaid leaves of absence for periods not to exceed one (1) year. In order for an unpaid leave of absence request to be considered by the Board, the teacher shall apply in writing to the Superintendent. In order to receive timely consideration of such requests, teachers interested in making such requests are urged to apply at least three (3) months before the anticipated starting date of their leaves.
4. An unpaid The teacher may continue health insurance coverage at the teacher’s own expense. Any tenure teacher teaching at least one-half (1/2) of a semester before taking the leave of absence taken for the purpose of caring shall be granted credit for a child with a serious health condition or because of full semester’s experience on the birth of a child (and in order to care for that child) or due to placement for adoption or xxxxxx care, as defined salary schedule. Unpaid Leaves. A. 3. Teachers accessing B. 4. The Board has the right to receive medical certification from the teacher's health care provider regarding the necessity for leave taken for a serious health condition under this Section. The teacher will facilitate and cooperate in the furnishing of such information, which shall incorporate responses to the inquiries contained in U.S. Department of Labor FORM WH 380 (or its successor form).
5. The Board has the right to require that a second medical opinion (at Board expense) be obtained. If that opinion differs from that of the teacher's health provider, the teacher and the Board shall mutually designate a third health provider whose opinion relative to leave eligibility or initial fitness to return to work shall be considered final and binding on the Board and the teacher. The cost of this examination shall be paid by the Board.
6. If the Board has reason to believe that the condition of the teacher has changed, the Board shall have the right to require recertification during the leave period and medical certification of the teacher's fitness to return to duty at the expiration of the leave period.
B. Leave of absence will be granted of up to two (2) years may be granted to any tenure teacher who joins for the purpose of participating in exchange teaching programs, the Peace Corps, VISTA or Teachers Corps as a full full- time participant in such program. The regular salary increment occurring during , provided such period shall be allowedteacher states his/her intention to return to the school system.
C. Military A teacher who enlists or is inducted into the Armed Services of the United States shall be granted a military leave of absence in accordance with all applicable laws and regulations.
D. An unpaid maternity leave of absence shall be granted to any a pregnant teacher who beginning upon exhaustion of her accumulated sick leave and ending at the time she is physically able to resume her teaching duties.
E. An unpaid child care leave, up to one (1) school year in length, shall be inducted granted to a natural or adoptive parent upon written request. Such leave shall enlist begin at the time the teacher is able to resume his/her duties following childbirth or at the time an adoptive parent assumes custody of his/her child. If a vacancy exists for military duty to any branch which the employee is highly qualified, such teacher shall be re-employed at the conclusion of the armed forces leave of the United Statesabsence provided that 60 days advance written notice of desire to return is given and a satisfactory medical report is furnished showing he/she is able to resume his/her duties. D. F. The Board shall may, at its discretion, grant a leave of absence without pay pay, without fringe benefits, without salary credit, and upon such other terms or conditions as it may set, upon written application, stating reason and length of leave desired, provided application is made at least 30 days in advance and further, that a qualified and suitable replacement is found by the Board. By action of the Board, at its discretion, and subject to any teacher to campaign forsuch restrictions as the Board may set, or serve in, a public officeextensions of leave of absence may be made for individual cases under unusual circumstances.
E. Leaves G. Requests for short periods of unpaid leave during the school year for the primary purpose of vacation, travel or recreation normally will not be granted. In cases where special circumstances are involved, such requests may, however, be granted only once during a school year, and on the condition that the applicant reimburse the Board for one (1) day of pay for a contracted substitute teacher's lead-in time (or its equivalent), in the case of absence up of two (2) days or more of unpaid leave. Denial of any application for such leave will not be subject to the Grievance Procedure.
H. Teachers who are granted leaves as provided above shall retain their tenure status while on leave but will not receive credit on the salary schedule for the period of absence, except in the case of military leave, and except in the case of a maximum leave granted under Section B above where full credit on the salary schedule shall be allowed for time spent actively teaching as a teacher. Upon return, such teacher will be assigned to his/her former position if vacant, but if not, then to whatever vacant position of like nature there may be for which he/she is qualified.
I. A teacher who is on an approved leave in excess of one (1) year may be granted upon application for the following purposes:
1. Study related semester will give written notice to the teacher's certificated fieldsuperintendent of intent to return to work at the close of the approved leave. The regular salary increment occurring during such period Such written notice shall be allowedmade no later than April 1 for those who plan to return at the beginning of the fall semester, if increments were paid and no later than December 1 for those who plan to actively employed teachers during return at the beginning of the second (2nd) semester. Those who will be returning from leave periodat another time shall give thirty (30) calendar days written notice of their intent to return from leave.
2. Study to meet eligibility requirements for a certificate or degree other than that held by the teacher. J. The regular salary increment occurring during such period shall be allowed, if increments were paid to actively employed teachers during the leave period.
3. Child care leave to commence at the conclusion of a disability leave under Paragraph A of this Article (or, in the case of an adoption, on the date that custody is granted) or to care for a child of the teacher with a serious health condition. Any period of leave after the exhaustion of the rights guaranteed under the Family Medical Leave Act shall be without pay and/or benefits for a period not to exceed one year.
4. An unpaid leave entitles employees with at least 1,250 hours of absence taken for service during the purpose of caring for a child with a serious health condition or because of the birth of a child (and in order to care for that child) or due to placement for adoption or xxxxxx care, as defined by the Family and Medical Leave Act, shall be taken concurrently with the foregoing leave provisions to the extent of the teacher's eligibility under the Family and Medical Leave Act. Leave taken under this Section in connection with the birth of a child or due to placement for adoption or xxxxxx care must be concluded at the end of the previous twelve (12) month period beginning on the date up to twelve (12) work weeks of birth or placementunpaid leave during any twelve (12) month period.
