Upgrades & Updates. If the Software is licensed as an upgrade or update, then Licensee may only use the Software to replace a validly licensed version of the same software. Licensee agrees that the upgrade or update does not constitute the granting of a second license to the Software (i.e., Licensee may not use the upgrade or update in addition to the software it is replacing, nor may Licensee transfer the software which is being replaced to a third party).
Upgrades & Updates. Illumina may, at its sole discretion, provide updates or upgrades to the Software. In that case, Licensee will have the same rights and obligations under such updates or upgrades as it has for the versions of the Software initially provided to Licensee hereunder. Licensee recognizes that Illumina is not obligated to provide any upgrades or updates to, or support for, the Software.
Upgrades & Updates. Certified Reseller is responsible for providing all improvement(s), bug fixes, enhancement(s), modification(s), update(s) and upgrade(s) to the System to cause the System to operate under HSMS INC.’s latest version(s) or release(s) and HSMS INC.’s supported operating system(s).

The terms of this License will govern any software upgrades or updates provided by Claris to the Software, unless such upgrade or update is accompanied by a separate license in which case you agree that the terms of that license will govern such upgrade or update.
Upgrades & Updates x.Xxxxxxx is under no obligation to provide upgrades to the Software Product. If the Software Product is labeled as an upgrade, Licensee must be properly licensed to use a product identified by Emerson as being eligible for the upgrade in order to use the Software Product. A Software Product labeled as an upgrade replaces and/or supplements the product that formed the basis for Licensee’s eligibility for the upgrade. Licensee may use the resulting upgrade product only in accordance with the terms of this XXXX. If the Software Product is an upgrade of a component of a package of software programs Licensee licensed as a single product, the Software Product may be used and transferred only as part of that single product package and may not be separated for use on more than one Device.

Xxxxxxx may collect information, including but not limited to, information relating to the manner or frequency of your use of the Software Product. This includes details about the Xxxxxxx product, as well as data collected as part of the services. Some data Xxxxxxx collects is relatively static, such as data about the product (for example, serial numbers and Device IDs and the Xxxxxxx model and serial number), but other data is more dynamic, like information about current and past product usage levels, information about abnormal product functioning, information about the status and location of Software Product and/or your Device. Xxxxxxx collects this data directly from Licensee and the Software Product and transmits it through the network and/or Internet services of Licensee. Monitoring may continue until Licensee disconnects the Software Products and the services are cancelled or terminated. Note, if Licensee does not allow Xxxxxxx to collect this information, Xxxxxxx may not be able to provide the full capabilities of the Software Product and other services. All information we collect through or in connection with the Software Product and the use of Xxxxxxx mobile apps and devices is subject to our Privacy Notice found at xxxxx://xxx.xxxxxxx.xxx/en-us/privacy-notice. Xxxxxxx will collect, use, and disclose Licensee’s personal information and the personal information of its Additional Users as set out in that Privacy Notice, and Licensee and its Additional Users or third parties it has granted access or control consent to Xxxxxxx doing so. Upgrades & Updates. If the software represents an upgrade or update to an earlier version of the software, you must obtain a valid license for the previous version in order to use the upgrade or update. All upgrades and updates will be provided on the basis of a license exchange. You agree that by installing the upgrade or update you are voluntarily relinquishing your right to use the previous software version once the software has been installed. In exceptional cases, you may continue to use a previous version of the software after downloading the upgrade or update on your EMEREC PC, however, this may only be used for the purpose of simplifying the conversion to the upgrade or update. After the conversion, your right to continued use of the earlier software version will expire. This right shall only be granted on the condition that the upgrade or update and the previous version have been installed on the same EMEREC PC. Rosenbauer must grant licenses for upgrades and updates subject to additional or deviating licensing terms and/or costs.
Upgrades & Updates. If you have purchased a Developer or Production server license, you are eligible to receive all Major Upgrades and Minor Updates for the version of the Software that you license hereunder for a period of twelve (12) months from the date on which you purchase the License for the Software, as part of the included subscription with each license. You can further purchase an annual subscription of FusionExport Priority Support & Upgrade, which makes you eligible to receive all Major Upgrades and Minor Updates, valid for the entire duration of the subscription, starting from the date of expiry of included subscription with the license. One unit of active subscription is required to be purchased or renewed for each development or production server license. You may use the resulting updated Software only in accordance with the terms of this License.
Upgrades & Updates. Customer acknowledges that Signify may at any time change, revise, update or modify the operation, working methods, communication systems, or any element or components of the Interact Pro System, the App, the Services, and related Documentation at its discretion. Signify may make upgrades or updates to the App and the Services, and may do so remotely without notifying you. Updates or updates are subject to these Terms, unless such upgrade or update is accompanied by a separate license in which case the terms of that license will govern. If you do not want such updates or upgrades, your sole remedy is to cease accessing the App or using the Services. Your continued access to the App or use of the Services implies deemed acceptance of such updates and upgrades by you.
Upgrades & Updates. From time-to-time and at its sole discretion, N2H2 will provide Licensee with updates or upgrades for the BESS Xxxtem. Licensee shall be entitled to all updates or upgrades that are provided to licensees of the BESS Xxxtem generally. Licensee shall use the upgraded or updated BESS Xxxtem only in accordance with this Agreement which supersedes any prior license to any prior versions of the BESS System, and any license that may be provided in connection with the upgrade or update.
