12.03 Applicant employees must notify the Employer in writing of their desire to be considered for the vacancy during the posting period. At the conclusion of the posting period, the Employer will make its final decision, taking into consideration each applicant’s skill and ability, and seniority.
12.04 An employee assigned to a temporary position shall, upon returning to their permanent position, be made as soon as possible and returned to their rightful place on the seniority list, in no case will exceed eight (8) working days from the accordance with their last date of selection. Notices of posting announcement results will hire.
12.05 Although the conveyor truck operator shall be made considered to be within the same classification as a driver, a vacant conveyor truck operator position shall also be posted in accordance with the provisions of Article 12.02.

12.07 Nothing in this article shall interfere with the Employer’s right to hire new employees when there are no applicants, or no qualified applicants for a job postingvacant position.
12.08 The successful applicant to a vacant position shall undergo a trial period of eight (8) weeks. During the trial period, he shall have a forty (40) working day probationary period before the job becomes permanent. Either should either the employee or the Employer has decide that the right, within employee is not suitable for the forty (40) day period, to return or be returned to his former position. During this period position the employee shall be paid up returned to one dollar ($1.00) below the hourly rate in effect for the new classification or his current rate of pay, whichever is greatertheir former position. All other employees affected by this return shall similarly be returned to their previous position.

b. The Employer believes that the employee is not suitable for the position, and requires that she return to her former position. If she does not remain in the trial position, she will return to her former position and salary without loss of seniority. Any other employee, promoted or transferred as a result of the re-arrangement of positions, shall also be returned to her former position and salary without loss of seniority.

9.04 An employee who is successful in bidding on a new position shall be allowed a two-week familiarization period. In the event the employee advises the Employer before the conclusion of the familiarization period that she does not wish to continue in the new position, she shall be returned to her former position, wage or salary rate, without loss of seniority. If no suitable candidates are available; and any other employee who has been promoted or transferred because of the rearrangement of positions shall also be returned to her former position, wage or salary rate, without loss of seniority.
9.05 A new employee shall not be hired to a position where there is an employee on layoff who has the skill, ability, and qualifications.
9.06 For the purpose of any job postings pursuant to this Article, the Employer shall determine seniori seniority date. VACANCIES AND JOB POSTINGS. 12.01 Vacancies in regularly assigned A vacancy that requires a job posting occurs when:
a) The Company requires additional manpower at an existing or related work site;
b) an employee permanently leaves their position and the Company determines there is a need to fill the position;

VACANCIES AND JOB POSTINGS. 12.01 Vacancies 20.01 A permanent vacancy is created when a position is vacated by reason of promotion, resignation, retirement, termination, death or when there is a new permanent position.
1. The employee filling the temporary position will have their own position posted as temporary, and the successful applicant to that position will exercise their bumping rights when the leave is completed.
2. When the employee returns from the leave, the employee filling the position will return to the position they left, providing the original vacancy was not more than 18 months, and providing the position still exists. If the position no longer exists, then the employee will exercise their bumping rights as stated in regularly assigned jobs Article 21.
3. If a permanent position becomes available at the site where the leave is being filled, then the employee filling the temporary vacancy will have first right to fill the position, and newly created jobs the rest of the leave will be filled temporarily.
4. If the employee who is on this leave resigns from the Umbrella, or takes a different position with the Umbrella, then the employee filling the vacancy will be offered the position first – before being posted.
20.02 When a position is identified as vacant, the Umbrella shall first consider those employees who are laid off. If there are no employees in a lay off position, then the vacancy will be posted within five (5) days of the employee giving notice, unless mutually agreed between Union and Management. The vacancy will be posted for seven (7) working days.
20.03 An employee interested in a posted position will send a letter of interest, along with a resume outlining their related qualifications and experience, as required by the job posting.
1. The probationary period has been completed unless the position applied for is for more money or more hours.
2. There are no documented performance issues.
3. The person has the necessary skills and experience. In extenuating circumstances, an exception may be made with agreement between the Union and the Umbrella. If the new role requires different responsibilities, employees will serve a 225 hours worked probationary period for a part time position, and a 337.50 hours worked probationary period for a full time. Should they be unsuccessful, they will exercise their bumping rights and bump the most junior person on the seniority list with the equivalent position that they left. The employee will be notified of their new role within three (3) working days after the posting closes and they will start their new role within two (2) weeks of notification unless otherwise agreed to with the Union. The successful applicant’s name will be sent out on the original posting and posted in all centres for three (3) working days days. It is every employee’s responsibility to keep themselves informed of new job postings.
20.04 Any resulting vacancies will be filled in each work location on Employer bulletin boards accessible to all employees. Copies the same manner.
20.05 Each posting shall contain the following information: the centre the posting is for, the nature of such postings the position, necessary qualifications and required knowledge, preferred skills, hours of work, wages as per the Collective Agreement.
20.06 The Umbrella shall be forwarded send a copy of the posting to the Union StewardsRepresentative via e-mail, or fax, before it is sent to all Umbrella programs. A temporary vacancy shall mean up to four (4) weeks. All postings shall indicate:

A.11.7 In the event that an employee whose absence created the vacancy, returns to work later than the twelve (12) months mentioned in Article A.11.6, that employee may be returned to a similar position without loss of pay or seniority, but not necessarily to the same location. The Board will attempt to place the employee in the same geographical area.
A.11.8 Any successful applicant to fill a vacancy or new position will be placed in the vacancy or new position for a trial period not to exceed sixty (60) working days and if the employee proves satisfactory during this period of time, he will then be confirmed in his new classification.

a. The employee believes that she is not suitable for the position, and wishes to return to her former position; or
b. The Employer believes that the employee is not suitable for the position, and requires that she return to her former position. If she does not remain in the trial position, she will return to her former position and salary without loss of seniority. Any other employee, promoted or transferred as a result of the re-arrangement of positions, shall also be returned to her former position and salary without loss of seniority.

17.03 The provider will make available to the City, the Union, and the candidates a list of all persons taking the examination, ranking them in order from the highest to lowest. The City shall appoint the highest-listed person to the vacant position. Should that person refuse or be no longer eligible (through retirement, disability, etc.), the next highest shall be appointed, and so on.
17.04 Nothing in this section shall be construed to limit or prevent the Employer from temporarily filling a vacant position pending the Employer’s determination to fill the vacancy on a permanent basis. Such temporary assignments shall not exceed one hundred eighty (180) days.

VACANCIES AND JOB POSTINGS. 12.01 Vacancies 20.01 A permanent vacancy is created when a position is vacated by reason of promotion, resignation, retirement, termination, death or when there is a new permanent position.
1. The employee filling the temporary position will have their own position posted as temporary, and the successful applicant to that position will exercise their bumping rights when the leave is completed.
2. When the employee returns from the leave, the employee filling the position will return to the position they left, providing the original vacancy was not more than 18 months, and providing the position still exists. If the position no longer exists, then the employee will exercise their bumping rights as stated in regularly assigned jobs Article 21.
3. If a permanent position becomes available at the site where the leave is being filled, then the employee filling the temporary vacancy will have first right to fill the position, and newly created jobs the rest of the leave will be filled temporarily.
4. If the employee who is on this leave resigns from the Umbrella, or takes a different position with the Umbrella, then the employee filling the vacancy will be offered the position first – before being posted.
20.02 When a position is identified as vacant, the Umbrella shall first consider those employees who are laid off. If there are no employees in a lay off position, then the vacancy will be posted within five (5) days of the employee giving notice, unless mutually agreed between Union and Management. The vacancy will be posted for seven (7) working days.
20.03 An employee interested in a posted position will send a letter of interest, along with a resume outlining their related qualifications and experience, as required by the job posting.
1. The probationary period has been completed unless the position applied for is for more money or more hours.
2. There are no documented performance issues.
3. The person has the necessary skills and experience. In extenuating circumstances, an exception may be made with agreement between the Union and the Umbrella. If the new role requires different responsibilities, employees will serve a 225 hours worked probationary period for a part time position, and a 337.50 hours worked probationary period for a full time. Should they be unsuccessful, they will exercise their bumping rights and bump the most junior person on the seniority list with the equivalent position that they left. The employee will be notified of their new role within three (3) working days after the posting closes and they will start their new role within two (2) weeks of notification unless otherwise agreed to with the Union. The successful applicant’s name will be sent out on the original posting and posted in all centres for three (3) working days days. It is every employee’s responsibility to keep themselves informed of new job postings.
20.04 Any resulting vacancies will be filled in each work location on Employer bulletin boards accessible to all employees. Copies the same manner.
20.05 Each posting shall contain the following information: the centre the posting is for, the nature of such postings the position, necessary qualifications and required knowledge, preferred skills, hours of work, wages as per the Collective Agreement.

12.04 An employee assigned to a temporary position shall, upon returning to their permanent position, be made as soon as possible and returned to their rightful place on the seniority list, in no case will exceed eight (8) working days from the accordance with their last date of selection.
