Vehicle Breakdowns. In the event of vehicle breakdowns, there will be spare vehicles available at all times, in the event of more than one breakdown, additional resources can be drawn from either approved hire companies and/or a spare vehicle from a neighbouring depot. In the event of unplanned absences, a number of pool staff will be employed on the Contract, and in extreme cases additional resources can be drafted in through a number of approved temporary staff agencies. A staff availability schedule will list all employees including operations staff, drivers and loading operatives that are available for out-of-hours emergency response. This will include nights and weekends if applicable. If necessary, Verdant will draw on additional staff resources from various locations. Verdant will further ensure that there is a sufficient reserve of fuel in case of fuel shortages, and shall maintain a priority suppliers list as a backup. In the event that bulk fuel facilities being available at any proposed depot emergency fuel cards will be kept at the depot to enable vehicles to be fuelled at local filling stations should there be supply problems at the designated depot.

Vehicle Breakdowns. Contractor shall maintain its transportation fleet in good condition, at least meeting all applicable state or federal inspection standards. In the event of a mechanical failure or breakdown of any vehicle while providing services, Contractor shall respond as quickly as possible with a spare vehicle for transport of students to their destination. In order to assure compliance with this obligation, Contractor shall maintain an adequate number of spare vehicles as a part of its fleet
Vehicle Breakdowns i. Failure to provide a replacement Vehicle to transport Learners to School in the morning; No remuneration for trip No remuneration for trip ii. Failure to provide a replacement Vehicle in the afternoon within 2 (two) hours of breakdown. Should the Service Provider fail to provide a replacement Vehicle such conduct will constitute a serious breach. The WCED will not compensate the Service Provider and reserves the right to institute breach procedures if no alternative arrangements are made to transport the Learners to and from School.
Vehicle Breakdowns. In the event of a vehicle breakdown, employees will be paid the Grade 2 rate as specified in clause 3.3, while waiting with the vehicle for it to be repaired to a maximum of 8 hours in any one day. If the repair is not completed within 8 hours then suitable accommodation will be made available for the employee at the company’s expense.
Vehicle Breakdowns. If a vehicle breaks down in service, the CONTRACTOR is required to dispatch a backup vehicle to the site of the breakdown. The backup vehicle shall arrive within thirty (30) minutes of the breakdown.

  • Breakdown The failure of a COVERED PART under normal service and usage of the VEHICLE. A COVERED PART has failed when it can no longer perform the function for which it was designed solely because of its condition.

  • Outages 9.7.1.1 Outage Authority and Coordination. Absent an Emergency Condition, the Party scheduling a removal of such facility(ies) from service will use Reasonable Efforts to notify one another and schedule such removal on a date and time mutually acceptable to the Parties. In all circumstances, any Party planning to remove such facility(ies) from service shall use Reasonable Efforts to minimize the effect on the other Parties of such removal.

  • Shortages Claims for shortages in the amount of Products shipped by Patheon will be dealt with by reasonable agreement of the parties.

  • Weather User understands and agrees that during the term of this agreement, User will strictly adhere to the Weather Protocols set forth in the Grand Park Emergency Management Plan. The Grand Park Emergency Management Plan is made available on the Grand Park website or by request a copy may be provided by the Commission. In the event of inclement weather, the Commission will retain final determination as to the ability of the facility to support the Event. a. If the facility is unable to support the event due to an "Act of God" the Commission will not provide a refund or credit to the User. User may obtain event insurance through a vendor of their choosing to cover the "Act of God" scenario. b. If the facility is deemed unable to support the event by the Commission, the Commission will work with the User to reschedule such activity as was affected by the facility closure. In such case that the activity may not be rescheduled, Commission will credit the User for such activity as was affected by the closure and allow the credit to be utilized toward a future event. c. If the facility is deemed unable to support the event by the User, the Commission will work with the User to reschedule such activity as was affected within the general time constraints of the User's Event. In such case that the activity may not be rescheduled, Commission will not credit the User.

  • Interruptions There shall be no abatement of rent and Lessor shall not be liable in any respect whatsoever for the inadequacy, stoppage, interruption or discontinuance of any utility or service due to riot, strike, labor dispute, breakdown, accident, repair or other cause beyond Lessor's reasonable control or in cooperation with governmental request or directions.

  • Equipment Procurement If responsibility for construction of the Connecting Transmission Owner’s Attachment Facilities or System Upgrade Facilities or System Deliverability Upgrades is to be borne by the Connecting Transmission Owner, then the Connecting Transmission Owner shall commence design of the Connecting Transmission Owner’s Attachment Facilities or System Upgrade Facilities or System Deliverability Upgrades and procure necessary equipment as soon as practicable after all of the following conditions are satisfied, unless the Developer and Connecting Transmission Owner otherwise agree in writing: 5.5.1 NYISO and Connecting Transmission Owner have completed the Interconnection Facilities Study pursuant to the Interconnection Facilities Study Agreement; 5.5.2 The NYISO has completed the required cost allocation analyses, and Developer has accepted his share of the costs for necessary System Upgrade Facilities and System Deliverability Upgrades in accordance with the provisions of Attachment S of the NYISO OATT; 5.5.3 The Connecting Transmission Owner has received written authorization to proceed with design and procurement from the Developer by the date specified in Appendix B hereto; and 5.5.4 The Developer has provided security to the Connecting Transmission Owner in accordance with Article 11.5 by the dates specified in Appendix B hereto.

  • Downtime There may be downtime during the Migration. The duration of the downtime will depend on the amount of data that Agency is migrating. Axon will work with Agency to minimize any downtime. Any VIEVU mobile application will need to be disabled upon Migration.
