VEHICLE SUBSTITUTION. 5.1 TCC will endeavour to supply the Vehicle selected. However, should the vehicle booked be unavailable, TCC reserve the right to substitute an alternative Vehicle without prior notification. 5.2 Should the alternative Vehicle result in a downgrade, You will be entitled to a refund.

A vehicle substitution shall not constitute a breach of contract and does not entitle You to a refund of any kind.
VEHICLE SUBSTITUTION. 13.1 Vehicles are booked by Guest by vehicle category (as determined by Xxxxxx) and not by make or model. 13.2 Acting reasonably, Xxxxxx reserves the right to change Guest's selected vehicle type or its specification in the event of unforeseen circumstances such as accidents, operational issues, or other reasons. 13.3 In such circumstances, Guest shall not be liable to Apollo for any increased rental charges for the substitute Vehicle. However, Guest shall be responsible for any additional running costs pertaining to the substituted Vehicle. 13.4 In the event of a downgraded vehicle type, Guest may be eligible for a partial refund of the Hire Charges. 13.5 If no alternative vehicle is available for Guest, Apollo’s liability to Guest is limited to a refund of such portion of the Hire Charge as has been paid to Apollo by Guest. In all cases, no other refund will be available including compensation for additional arrangements booked by Guest (such as costs for flights, hotels, activities etc.).
VEHICLE SUBSTITUTION. For any bus that is unavailable for cleaning, due to maintenance or other reasons, the Authority’s Representative may identify three Authority-owned passenger vehicles to be cleaned as substitutes. These vehicles may include the Authority 15-passenger vans or smaller buses. Two (2) of these vehicles will equal one bus. The Authority is only obligated for payment for buses and vehicles actually cleaned if substitute vehicles are not available.

In all cases, no other refund will be available including compensation for additional arrangements booked by Guest (such as costs for flights, hotels, activities etc.). 15.1 Should Guest's rental be disrupted by a mechanical breakdown/Vehicle system malfunction (which has not been caused by Guest) which render the Vehicle unusable for more than 48 hours after first reporting to Bunk Campers, Guest shall be entitled to a maximum refund equal to the gross nightly rental rate for each night of the Hire Period affected until the breakdown/malfunction is rectified by Bunk Campers or one of its agents or representatives. 15.2 Failure of mechanical and Vehicle systems which include cabin heating/hot water, water pump, shower, toilet, refrigerator, gas hob/oven must be assessed by Bunk Campers, or an Bunk Campers authorised repairer. 15.3 Guest shall only be eligible for a refund under clause 15.1 if Guest notifies Bunk Campers of the breakdown/malfunction promptly upon its occurrence. Failure to so notify acknowledges that the breakdown/malfunction is of such a minor nature that Guest does not wish to make a claim for loss of time in respect of the rental. 15.4 Defects and repairs of the radio/CD player, Sat Nav, reversing camera, bike racks and cruise control etc. are considered minor and are excluded from the scope of this clause 15.

VEHICLE SUBSTITUTION. Enterprise reserves the right to provide Customer with a similar substitute vehicle at any time. If a permanent substitute vehicle is provided to Customer and such substitution did not arise from an act or omission by Customer as determined solely by Enterprise, then Enterprise will be responsible for the cost to remove Customer’s decals/trade dress and apply new decals, if applicable. Customer acknowledges that the Long Term Rate is discounted due to the longer term of the Agreement and warrants that Customer is responsible for any and all amounts due Enterprise under this Agreement, and by the individual’s signature below, personally guarantees payment to Enterprise for any and all amounts due Enterprise under this Agreement. Upon receipt of an invoice from Enterprise, Customer will pay Enterprise the Long Term Rate including the weekly rate, mileage, applicable taxes, surcharges and all other fees. Any amounts unpaid after 30 days of the invoice date will be considered past due and Enterprise may, in its sole discretion, terminate this Agreement. In the event of a resulting termination, Customer must immediately return the Vehicle to Enterprise and pay all amounts due Enterprise, including 20% of the sum of the remaining payments in this Long-Term Agreement at the Long Term Rate as outlined above plus applicable taxes and surcharges.

VEHICLE SUBSTITUTION. If for any reason the booked Vehicle should not be available, we reserve the right to substitute a higher-priced Vehicle at no additional cost. If this is not possible and we must place you in a lower-priced Vehicle, the price of the lower-priced Vehicle goes into effect and you have the right to get a full refund.
