VOD License Period. The VOD License Period for each VOD Included Program commences on its VOD Availability Date and ends on the earlier of: (a) a date established by Licensor in its sole discretion; provided, that (i) such date in the case of a Current Film shall in no event be earlier than 90 days after such Current Film’s VOD Availability Date, and (ii) such date in the case of a Library Film shall in no event be earlier than 12 months after such Library Film’s VOD Availability Date and (b) the termination of this Agreement for any reason. Notwithstanding the foregoing, Licensor may, in Licensor’s sole discretion, reduce the VOD License Period for any Current Film from ninety (90) days to a shorter period of no less than sixty (60) days upon written notice to Licensee (which may be given in the form of the VOD Current Avail List provided for such Current Film) thirty (30) days prior to the VOD Availability Date of such Current Film. Notwithstanding anything to the contrary herein, Licensor shall have the right to substitute a comparable new title to complete the VOD License Period of any Library Film that Licensor elects to withdraw, effective at any time after the initial 6 months of such Library Film’s VOD License Period have elapsed.
VOD License Period. The period during which Licensee may exhibit an Included Program on the Licensed Service in accordance with the terms hereof (the “VOD License Period”) shall commence on the VOD Availability Date for such Included Program and shall expire as follows. The VOD License Period for each Current Film shall expire on the earlier of (a) a date determined by Licensor it its sole discretion; provided that such date shall not be earlier than (i) 60 days following its Availability Date; and (ii) 30 days prior to the start of the subscription pay television window for such Current Film in the Territory; and (b) the termination of this Agreement for any reason. The VOD License Period for each Library Film shall expire on the earlier of (a) a date determined by Licensor it its sole discretion; provided that such date shall not be earlier than 12 consecutive months following its Availability Date, provided that Licensor may in its sole discretion elect to replace any one or more VOD Library Feature(s) after the first six months of its License Period with a comparable VOD Library Feature; and (b) the termination of this Agreement for any reason.

Notwithstanding anything to the contrary herein, Licensor shall have the right to substitute a new, comparable Library Feature to complete the VOD License Period of any Library Feature that Licensor elects to withdraw, effective at any time after the initial six (6) months of such withdrawn Library Feature’s VOD License Period have elapsed.

Notwithstanding the foregoing, withdrawal of any VOD Included Program shall not affect in any way said VOD Included Program’s availability to a VOD Subscriber once the relevant VOD Subscriber Transaction has occurred. SVOD License Period. The SVOD License Period for each SVOD Included Program shall commence on its SVOD Availability Date and shall end on the earlier of (a) a date established by Licensor in its sole discretion; provided, that such date shall in no event be earlier than (i) 8 months after such SVOD Included Program’s SVOD Availability Date in VOD/SVOD Avail Year 1 and (ii) 6 months after such SVOD Included Program’s SVOD Availability Date in VOD/SVOD Avail Year 2, and (b) the termination of this Agreement for any reason.
VOD License Period. The VOD License Period for the Program shall be as set forth in Section 3.2 of the VOD General Terms of the Agreement with respect to VOD Premium Current Films, except that Licensor may designate, in its sole discretion, a period at the beginning thereof (“Super Premium VOD Window”), during which the VOD Viewing Period, VOD Deemed Price and VOD Licensor’s Share shall be subject to the special terms set forth in Sections 3, 4 and 5 below, respectively.
