WAIVER OF QUALIFICATIONS. After consultation with the appropriate Union representative, Management may assign an employee without regard to OPM's standards and requirements for the position if: (1) The employee meets any minimum education requirement for the position; and (2) The employee has the capacity, adaptability, and special skills needed to satisfactorily perform the duties and responsibilities of the position. All waivers of qualification(s) must be properly documented and justified; this documentation must be maintained by the servicing Human Resources office subject to Union review.
WAIVER OF QUALIFICATIONS. 7.2.2.1. The University, in seeking to attract an outstanding person of professional or artistic stature, may waive the qualifications after consulting with the departments or schools involved. Notification of the waiver, and the reasons for the action, shall be given in writing to the Association President. 7.2.2.2. Further, when search for candidates possessing the minimum qualifications for the rank of instructor does not produce qualified candidates available by the time their services are required, then the University may hire a person with less than minimum qualifications for a temporary appointment of one year at the rank of instructor. Notification of the hiring, and the reason for the necessity of the temporary appointment, shall be given to the Association in writing. The search for candidates with minimum qualifications shall be renewed by November 15 of the year in which the temporary appointment took effect. If the search still does not produce qualified candidates available by the time their services are required, the temporary appointment may be renewed for one more year, with notification to the Association President as above.

In accordance with law and other authorities, when the Agency is unable to offer an assignment, the Agency may waive the qualifications of employees who will be separated due to reduction-in-force for vacant positions which do not contain selective placement factors, provided the Agency determines the employee is able to perform the work of the position without undue interruption to the mission of the Agency, and the employee meets any OPM- established minimum education requirements. B. Vacant positions which contain selective placement factors will be reviewed by the Human Resources Directorate to determine if these factors can be waived without seriously affecting the mission.
WAIVER OF QUALIFICATIONS. The employer may waive or modify OPM qualification requirements to place employees in vacancies to avoid separation IAW applicable laws and regulations.
WAIVER OF QUALIFICATIONS. The Employer agrees to carefully consider the feasibility of waiving qualification requirements in accordance with Government-wide regulations for otherwise eligible employees.

  • STAFF QUALIFICATIONS CONTRACTOR shall ensure that all individuals employed, contracted, and/or otherwise hired by CONTRACTOR to provide classroom and/or individualized instruction or related services hold a license, certificate, permit, or other document equivalent to that which staff in a public school are required to hold in the service rendered consistent with Education Code section 56366.1(n)(1) and are qualified pursuant to Title 34 of the Code of Federal Regulations sections 200.56 and 200.58, and Title 5 of the California Code of Regulations sections 3001(y), 3064 and 3065. Such qualified staff may only provide related services within the scope of their professional license, certification or credential and ethical standards set by each profession, and not assume responsibility or authority for another related services provider or special education teacher’s scope of practice. CONTRACTOR shall ensure that all staff are appropriately credentialed to provide instruction and services to students with the disabling conditions placed in their program/school through documentation provided to the CDE (5 CCR 3064 (a)).

  • Required Qualifications At all times during the term of the Contract, Vendor shall have available, under direct employment and supervision and/or subcontract agreement fully incorporating the terms and conditions of the Contract Documents, the required qualified and properly licensed (as applicable) personnel to properly fulfill all the terms and conditions of the Contract.

  • Blue Sky Qualifications The Company will use its best efforts, in cooperation with the Underwriters, to qualify the Securities for offering and sale under the applicable securities laws of such states and other jurisdictions (domestic or foreign) as the Representatives may designate and to maintain such qualifications in effect so long as required to complete the distribution of the Securities; provided, however, that the Company shall not be obligated to file any general consent to service of process or to qualify as a foreign corporation or as a dealer in securities in any jurisdiction in which it is not so qualified or to subject itself to taxation in respect of doing business in any jurisdiction in which it is not otherwise so subject.
