Warranty Of Construction Manager. 23.1 Construction Manager warrants that the Construction Manager is properly licensed and/or certified under the laws and regulations of the State of California to provide all the services that it has herein agreed to perform. Construction Manager further warrants that all of the work performed under this Agreement by the Construction Manager shall comply with all applicable laws, rules, regulations and codes of the United States and the State of California. The Construction Manager also warrants that it shall comply with all applicable ordinances, regulations, and resolutions of the County in which the District is located. 23.2 Construction Manager certifies that it is aware of the provisions of the Labor Code of the State of California, that require every employer to be insured against liability for workers compensation or to undertake self-insurance in accordance with the provisions of that code, and it certifies that, if applicable, it will comply with those provisions before commencing the performance of the work of this Agreement. 23.3 Construction Manager certifies that it is aware of the provisions of California Labor Code that require the payment of prevailing wage rates and the performance of other requirements on certain “public works” and “maintenance” projects (“Prevailing Wage Laws”). Since the Construction Manager is performing work as part of an applicable “public works” or “maintenance” project, and since the total compensation is $1,000 or more, the Construction Manager agrees to fully comply with and to require its sub-consultant(s) to fully comply with all applicable prevailing wage requirements of the California Labor Code. Construction Manger shall cooperate with the DIR and provide certified payroll reports as required.

Warranty Of Construction Manager. 24.1 Construction Manager warrants that Construction Manager is properly licensed and/or certified under the laws and regulations of the State of California to provide the Services that it has herein agreed to perform. Construction Manager also warrants that it shall comply with all applicable ordinances, regulations, and resolutions of San Mateo County. 24.2 Construction Manager certifies that it is aware of the provisions of the California Labor Code of the State of California, requiring every employer to be insured against liability for workers compensation or to undertake self-insurance in accordance with the provisions of that code, and it certifies that, if applicable, it will comply with those provisions before commencing the performance of the work of this Agreement. 24.3 Construction Manager certifies that it is aware of the provisions of California Labor Code and California Code of Regulations that require the payment of prevailing wage rates and the performance of other requirements on certain “public works” and “maintenance” projects (“Prevailing Wage Laws”). To the extent that work is performed as part of an applicable “public works” or “maintenance” project, where the total compensation is $1,000 or more, Construction Manager agrees to fully comply with and to require its Consultant(s) to fully comply with all requirements of the Prevailing Wage Laws.

The Construction Manager agrees to fully comply with and to require its Subconsultants to fully comply with all applicable prevailing wage requirements of the California Labor Code.
Warranty Of Construction Manager. ‌ 23.1. Construction Manager warrants that Construction Manager is properly licensed and/or certified under the laws and regulations of the State of California to provide all the Services that it has herein agreed to perform. 23.2. Construction Manager warrants and represents that Construction Manager shall ensure that any of its employees or Subconsultants providing a Service(s) contemplated by this Agreement have, and maintain throughout their work, all license(s) required under law to provide that Service(s). 23.3. If the possession of a license(s) is required under law for the performance of a Service(s), or any part thereof, Construction Manager warrants and represents that the Service(s) will either be performed by appropriately licensed individuals or under the direct supervision and subject to the review and approval of appropriately licensed individuals.
Warranty Of Construction Manager. The Construction Manager warrants to the Owner that: (i) the Construction Manager possesses the skill and knowledge ordinarily possessed by well-informed members of its trade or profession and the Construction Manager will use its best efforts to ensure that the services provided under this Agreement will be performed, delivered, and conducted in accordance with the best professional standards and in accordance with industry standards, and (ii) the Construction Manager is fully experienced and properly qualified to perform the class of Work provided for herein, and that it is properly equipped, organized and financed to perform such Work, and (iii) following the date of acceptance of this Agreement, the services provided by the Construction Manager to the Owner will conform to the representations contained in this Agreement, including all attachments, schedules and exhibits. All warranties provided by the Construction Manager in this Agreement, including the provisions of Section 3.8.1, shall be cumulative, shall be deemed consistent and not in conflict, are intended to be given full force and effect and to be interpreted expansively to give the broadest warranty protection to the Owner.
Warranty Of Construction Manager. The Construction Manager warrants that the Trade Contractors selected by him are reputable, skilled, reliable, competent, qualified in the trade or field in which they are to perform on the Project, and thoroughly familiar with applicable codes. The Construction Manager will have primary responsibility for all Trade Packages. Trade Contractors are required to execute Construction Manager's standard subcontract, as amended to be consistent with this Agreement, with the Trade Contractors acting as Trade Contractors to Construction Manager. Construction Manager shall execute and administer all such Trade Package contracts and will assume full responsibility for each and every item of Work performed thereunder and the timely completion of all such Work in accordance herewith, including responsibility for all guarantees and warranties to be provided by each Trade Contractor.

Construction Manager agrees to furnish efficient business administration and management services and to perform in a manner consistent with the interests of the District. 23.3. To the extent applicable, the Construction Manager and all subcontractors performing the work for the Project(s) must comply with the Labor Code sections 1725.5 and 1771.1 and must be properly and currently registered with the California Department of Industrial Relations (“DIR”) and qualified to perform public works pursuant to Labor Code section 1725.5 throughout the duration of this Agreement. Failure to comply with these requirements shall be deemed a material breach of this Agreement and grounds for termination for cause.
