Working Spouse Provision. 1. Spouses of employees who elect family coverage, who are eligible to participate, as a current employee, self-employed individual (other than a sole proprietor) in a business or organization (e.g., partner, member), or retiree in group health insurance and/or prescription drug insurance sponsored by their employer, business, organization, or any retirement plan, the spouse will be required to enroll in at least Single coverage through their employer, business, organization, or retirement plan sponsored group insurance coverage. 2. This requirement does not apply to any employee’s spouse who: a. Works less than twenty (20) hours per week AND is required to pay more than fifty percent (50%) of the single premium to participate in his/her employer’s, business’s, organization’s, or retirement plan’s group health insurance coverage and/or prescription drug insurance. b. Is employed by another Huron-Erie School Employee Insurance Association (HESE) district, provided the spouse does not receive any available payment (or any other form of remuneration) from that HESE district for waiving health insurance and/or prescription drug insurance coverage. 3. The spouse can be maintained on an employee’s family plan as secondary coverage; primary coverage will be the spouse’s insurer, or employer, business, organization, or retirement plan sponsored group health insurance, whichever is appropriate. 4. This provision shall be administered in accordance with the Huron-Erie Schools Employee Insurance Association working spouse coverage policy.

Working Spouse Provision. If a working spouse is eligible for health insurance coverage through his/her employer, then the spouse will (regardless of how much the employer pays toward the cost of such health insurance care coverage) be removed from the school’s policy by January 1, 2015. If the spouse elects not to take coverage that is available through his/her employment (without regard to cost), this plan will not provide any coverage for that spouse. The Working Spouse Rule does not apply when both husband and wife are employees of this employer. However, no person may be both an employee and a dependent of this plan. The Hospital and Medical Insurance Benefits shall be mutually agreed upon by the Board and the Association.
Working Spouse Provision. The City’s health plan shall be primary for employees enrolled in the plan. If a spouse or civil union partner is employed and his/her employer offers a group health plan, the City’s plan shall pay claims as a secondary payor, regardless of whether the spouse or civil union partner enrolls in their employer’s plan. This provision shall become effective for AFSCME personnel once all City personnel are subject to this same provision. Dependent children dually enrolled in the City’s plan and a spouse’s employer’s plan shall continue to be subject to coordination of benefits using the birthday rule.

  • Retirement Benefit Should the Director still be in the Directorship ------------------ of the Association upon attainment of his 70th birthday, the Association will commence to pay him $590 per month for a continuous period of 120 months.   • Severance Benefit (a) If the employment of the Employee with the Company is terminated by the Company for any reason other than Cause (as defined below) or if the Employee terminates his or her employment with the Company for Good Reason (as defined below), the Company shall pay the Employee, from the date of termination, in addition to any payments to which the Employee is entitled under the Company’s severance pay plan, twelve (12) months of base salary at the Employee’s annual base salary level in effect at the time of such termination or immediately prior to the salary reduction that serves as the basis for termination for Good Reason. Employee will also be entitled to payment of an amount of cash equal to $20,000. The aggregate base salary and other cash amount payable shall be paid by the Company to the Employee in one lump sum on the first day following the six (6) month anniversary of the date of the Employee’s termination. For purposes of this Agreement, the term “termination” when used in the context of a condition to, or timing of, payment hereunder shall be interpreted to mean a “separation from service” as that term is used in Section 409A of the Code. (b) Employee will also be entitled to twelve (12) months of health benefits continuation if terminated under circumstances described in subpart (a) above. To the extent any such benefits cannot be provided to the Employee on a non-taxable basis and the provision thereof would cause any part of the benefits to be subject to additional taxes and interest under Section 409A of the Code, then the provision of such benefits shall be deferred to the earliest date upon which such benefits can be provided without being subject to such additional taxes and interest. (c) Solely for purposes of this Agreement, “Cause” shall include: i. the conviction of a felony, a crime of moral turpitude or fraud or having committed fraud, misappropriation or embezzlement in connection with the performance of his duties hereunder, ii. willful and repeated failures to substantially perform his assigned duties; or iii. a violation of any provision of this Agreement or express significant policies of the Company. (d) Solely for purposes of this Agreement, termination for “Good Reason” shall mean termination of employment by the Employee within ninety (90) days after:
